The paper presents case law developed by the European Court of Human Rights and Court of Justice of the European Union in the field of sexual orientation law. It focuses on the cases related to legal recognition of same-sex partnerships, the rights deriving from same-sex partnership (economic and social rights, immigration) and the relations between parents and children (the right to contacts, adoption, recognition of parenthood in birth certificates and recognition of foreign birth certificates in cases of surrogacy). The paper points at those instances where the courts changed their case law reflecting the societal changes and increased acceptance of sexual orientation issues in communities. The paper offers terminological clarifications that should contribute to the development of legal terminology in this field.
