The fundamental principle of copyright law predicts that for the use of a work protected by copyright one must always obtain the prior approval of the rights holder. However, rights holder can often not be traced. This may also happen due to the fact that right holders do not take steps necessary to ensure a visible link between them and the protected parts, and therefore even those interested in the possible use of the work are not able to obtain their contact details. Consequently, there is a danger that the works important in terms of cultural heritage may not be restored via lasting mediums and would therein be forgotten. At the European level the problem of orphan works is being resolved by the Directive 2012/28/EU on certain permitted uses of orphan works, but its implementation remains largely in the discretion of the Member States. In the article, taking into account the strengths and weaknesses of current and proposed regimes for treatment of orphan works as well as the characteristics of Slovenian copyright law regime, a proposal is made on how to properly transpose the aforementioned directive into the Slovenian legislation. This proposal pursues to establish a fair bal-ance between the interests of rights holders of missing works for their remuneration, and the public interest to preserve Slovenian cultural heritage and its cultural identity.
