Trieste - 1946 / Allied Mil ifary Governmenf VENEZIA GIULIA General Order No. 80 AMENDMENTS TO THE CONSOLIDATED TEXT OF THE LAWS GOVERNING PUBLIC SAFETY, WITH REGARD TO SHOPS („PUBBLICI ESERCIZI“) WHEREAS, it is considered advisable and necessary to amend the Consolidated Text of the laws governing public safety, approved by decree 18 June 1931, No. J/3, with regard to shops (Esercizi Pubblici) ; NOW, THEREFORE, I, ALFRED C. BOWMAN, Colonel, J.A.G.D., 'Senior Civil Affairs Officer, ORDER: ARTICLE I PROVISIONS IN FAVOUR OF CLUBS OF WELFARE PUBLIC BODIES a Shops (spacci) attached to welfare clubs of public bodies shall not be included in the limited number of shops (esercizi pubblici) considered by Article 95 of the Consolidated Text of the laws governing public safety, approved by R. 1). 18 dune 1931, No. 773. The sale of spirits containing more than 21 percent of alcohol, however, shall not bo permitted in the above shops (spacci). ARTICLE II • PROVISIONS IN FAVOUR OF CERTAIN COOPERATIVE STORES (COOPERATIVE DI CONSUMO) Cooperative scores (Cooperative di consumo) having not less than one hundred members, regularly consistuted and functioning as such on the effective date of ihi 3 Order, may, within six months from the date of this Order, be granted a license for the retail sale of wine in their own premises to their own members notwithstanding the provisions set forth in Article 95 of the Consolidated Text of the laws governing public safety. ARTICLE III PROVISIONS IN FAVOUR OF PERSONS PERSECUTED FOR POLITICAL OR RACIAL REASONS Even if the limited number of shops (esercizi pubblici) provided for in Article 95 of the Consolidated Text of the laws governing public safety is reached or exceeded, persons may be given back police licenses held by them for the sale and the consumption of alcoholic drinks, provided they prove that they had been deprived thereof after 28 October 1922, for political or racial reasons and provided they submit applications within six months from the effective date of this Order. 235 ARTICLE IV EFFECTIVE DATE This Ordër shall take effect on the date it is signed by me. Senior Civil Affairs Officer General* Order No. 81 (55 B) PAYMENTS TO THE FISHING CONSORZIO OF VENEZIA GIULIA WHEREAS, it is deemed advisable to amend General Order No. 55, and to make provision for revenue for the Fishing Consorzio, in those parts of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the „Territory“), NOW, THEREFORE, I, ALFRED C. BOWMAN, Colonel, J.A.G.D., Senior Civil Affairs Officer, ORDER: ARTICLE I PAYMENTS TO CONSORZIO BY FISH COLLECTING CENTERS That the following paragraph shall be added to Article V of General Order No. 55, dated June 19, 1946, as Section 2 thereof: „Each Fish Collecting Center will pay to the Consorzio per la Tutela della Pesea nella Venezia Giulia (hereinafter called the Consorzio) 0.50 percent of the monies it collects as its share for the collecting, handling and distribution of fish.“ ARTICLE II EFFECTIVE DATE This Order shall come into effect as of 1 October 1946. BOWMAN, Colonel, J.A.G.D., Senior Civil Affairs Officer ORDER: ARTICLE I ABOLISHMENT OF PREVIOUS PROVISIONS The contribution on wine introduced by the Ministry of Agriculture and Forestry Circular N. 53, dated 2 February 1942, as amended, payable at present in favour of DITERAL, successors to SEPRAL, is hereby abolished. Senior Civil Affairs Officer 237 Order No. 235 ENGAGEMENT OF REPATRIATES PARTISANS AND CERTAIN OTHERS IN PUBLIC ADMINISTRATIONS AND PRIVATE CONCERNS WHEREAS it is deemed necessary and advisable to issue provisions for the compulsory engagement of repatriates, partisans and certain other categories of persons, in public administrations and private concerns, in those parts of Venezia Giulia administered by the Allied Forces (hereinafter referred to as „the Territory“), NOW, THEREFORE, I, ALFRED C. BOWMAN, Colonel, J.A.G.D., Senior Civil Affairs Officer, hereby ORDER: PART I PUBLIC ADMINISTRATIONS ARTICLE I ENGAGEMENTS TO NON REGULAR EMPLOYMENT Section I. — Fifty percent of the engagements (assunzioni) to non regular employment in Public Administrations and Public Bodies shall be reserved to mutilated persons, invalids and combatants of the war 1940-1943 and/or of the liberation war, to partisans, to military and civilian persons returned from imprisonment, to those deported by the enemy, to orphans (orfani) and to the widows of the fallen. Section 2. — The engagements made under the provisions of Section 1 shall be subject to the possession by the person engaged of the requisites required for employment. The respective rate shall be computed separately for each professional qualification or category. Section 3. — The engagement of war mutilated persons, war invalids, and w-ar-orphans to be made in accordance with the existing provisions relating to such persons, shall be computed in the rates provided for by Section 1. Section 4. — The computation of the engagements made in accordance with, the provisions of this Article shall be effected at semi-annual periods. ARTICLE II RE-ENGAGEMENT OF NON REGULAR EMPLOYEES Section 1. — The provisions ensuring the keeping of the post in case of re-call to the armed Forces, shall remain in force. The non regular employees of Public Administrations and Public Bodies shall be entitled to re-engagement (riassunzione) to service : a) if they have been deported or interned by Fascists or Germans, or b) called to the armed Forces to comply with the obligations of conscription and subsequently retained in military service, provided that they at the time prior to their being called to the armed Forces, have been employed with the said Administration and Bodies for not less than one year ; or c) have abandoned service in order to take part in the struggle for liberation and have the qualification of combatant partisans. Section 2. — For the purpose of seniority th'e period of service prior to the deportation or internment or call to the armed Forces or abandonment of service, shall not be computed. 238 Section 3. — The non regular staff employed in substitution for the personnel called to the armed Forces shall not be entitled to re-engagement to service. In case the services to which those entitled to re-engagement were assigned have been transferred to other Administrations or Bodies the re-engagement to service shall be provided by the latter. ARTICLE III TIME LIMITS FOR APPLICATION OF RE-ENGAGEMENT Application for re-engagement to service as provided in the preceding Article shall be made within two months from the effective date of this Order, or within two months from the date of repatriation or discharge from military service. ARTICLE IV PERCENTAGE OF NON REGULAR EMPLOYEES ENGAGED Section I. — (a) The Public Administrations and Public Bodies shall engage in the non regular service (servizio non di ruolo), within the term of sixty days from the effective date of this Order : 1) persons who were combatants of the war 1940-43 and/or of the war for liberation, 2) widows and orphans of persons deceased in the aforesaid wars and in the struggle for liberation, provided that they have become the only support, of their family, 3) combatant partisans and persons returned from deportation and internment effected by the Germans, or Fascists, or from internment in Africa, at a rate not lower, for each category of the non regular staff, than five percent of the regular posts (posti stabiliti nei ruoli organici) for the corresponding groups of the regular personnel (per i corrispondenti gruppi del personale di ruolo). (b) For the Administrations which have not a regular staff (personale di ruolo), the aforesaid percentage shall be based upon the number of employees who were serving on December 31st, 1945. Section 2. — In computing the percentage mentioned in the preceding Section the following personnel shall be considered : a) the personnel re-engaged in accordance with Article II of this Order, b) the personnel having the qualifications indicated in the para (a) of Section 1 and having been engaged before the effective date of this Order, but after the 31st December 1945. * ARTICLE V ENGAGEMENTS AND RE-ENGAGEMENTS IN EXCESS OF THE CONTINGENT NUMBER (a) Whenever the contingent (or establishment) of personnel of non regular staff assigned to each Administration, in accordance with RDL 4 February 1937, No. 100, does not provide a sufficient number of available posts for the purpose of the re-engagement and engagement provided for in Article II and IV, such re-engagements and engagements shall be effected in excess of the number prescribed. (b) In the Administrations to which a contingent (establishment) of non regular personnel has not already been assigned, such contingent shall be granted, by this Order, to such an extent as is necessary for the engagements provided for in the preceding Article. (c) The posts assigned in accordance with the foregoing, paras shall be cancelled when a vacancy occurs, except as provided for in para (b) of Article VII. 239 ARTICLE VI CONDITIONS FOR ENGAGEMENT AND RE ENGAGEMENT Only those persons deprived of sufficient means for living, either as concerns themselves or their families living with them, may be re>engaged to service in accordance with Article II, or employed by reason of Article IV. For such engagement priority shall be given to those having family charges. ARTICLE VII DURATION OF THE PERIOD OF ENGAGEMENT OR RE-ENGAGEMENT (a) The personnel engaged or re-engaged in accordance with Articles II and IV, shall remain in service for at least one year, except for dismissals as provided in Article 8 RDL 4 February 1937 No. 100. (b) In case of dismissal such personnel shall be substituted with other personnel being in the position as stated in Articles IV and VI, for the duration of the period established in the preceding- para. ARTICLE VIII ENGAGEMENT COMPUTABLE WITH REGARD TO PERCENTAGE The re-engagements to service in accordance with Article II shall not be considered as being new engagements with regard to the percentage provided for in Article I of this Order. The engagements to service provided for by Article IV shall, however, be computable in the aforesaid percentage. ARTICLE IX DISMISSALS Section i. ■— The non regular staff of Public Administrations may, for the purpose of engagement of those belonging to the categories set forth in Article IV, be dismissed before the termination of the contract, or of the expiration established in the provision of engagement and beyond the cases set forth by Article VIII of R. decree law 4 February 1937, No. 100 provided that such persons do not draw the essential means for their own living, and for that of their families living with them, chiefly from their employment. In the aforesaid dismissals an inverse order of seniority shall be followed. Section 2.. — An indemnity equal to one month of the total emoluments received at the time of dismissal, shall be due to the staff dismissed in accordance with the foregoing Section, for each year of actual service or for a period of not less than six months. If, in accordance with the provisions governing the employment conditions (rapporto d’ impiego) of the Staff of Public Bodies, a more favourable treatment is established, such treatment shall be applicable. ARTICLE X CONSTITUTION OF COMMISSIONS FOR THE DISMISSAL Section I. — An Office Commission shall be constituted for each local Office of Public Administrations or Autonomous Public Agencies or Quasi Public Agencies, for the purpose of making proposals for the dismissal of non regular personnel referred to in Article IX and of personnel engaged by the Republican Fascist Government (even if the engagement of the latter has been made effective in terms of Section 2 of Article III of General Order No. 60), who have not had the qualification of combatant partisan. 240 Section 2. — The Office Commissions referred to in the previous Section shall be constituted within 10 days from the publication of this Order by the heads (or substitutes thereof when such heads are members of the Territorial Commission referred to in Section 4) of the single local Offices, who will preside ; and by two members, one of whom shall be a regular employee, and the other one a non regular employee, if possible belonging to one of the categories referred to in Article I of this Order. Section 3. — The composition of the Office Commissions referred to in the previous Sections of this Article shall be approved by the Area Presidents of the Areas where the local Offices are situated. Section 4. — (a) The proposals of the Office Commissions referred to in the previous Sections shall be examined by a Territorial Commission for the engagement of Repatriates which shall be established at Trieste. (b) The appointment of such Territorial Commission shall be made within 10 days from the publication of this Order, by the First President of the Court of Appeals of Trieste who shall preside or delegate the presidentship to a magistrate of a grade not lower than the 5th. The members of such Territorial Commission shall consist of the following six officials : 1) the Intendente di Finanza of Trieste, or one of the officials of the Finance Administration delegated by him. of a grade higher than VII, 2) the Superior Director of the Postal Service of Trieste, or a postal official delegated by him, of a grade higher than VIII, 3) the Chief Accountant of the Office of the Area President of Trieste, or another permanent official of the Office of the Area President delegated by him, 4) the Territorial Inspector of Istituto Nazionale della Previdenza Sociale, or an official of such Institution delegated by him, 5) the Territorial Inspector of Istituto di Assistenza per Malattia ai Lavoratori, or an official of such Institution delegated by him, 6) the President of Opera Nazionale Invalidi di Guerra of Trieste, or of Opera Orfani di Guerra of Trieste. (c) The decisions of the Territorial .Commission for thè engagements of repatriates shall not be appealable. The proposals of the Office Commission referred to in Section 1 shall be submitted to the Territorial Commission within 60 days from the date of the approval of Area Presidents under Section 3 of this Article. The decisions of the Territorial Commission shall be issued within 30 days from the reception of the proposals from the Office Commis’-'ieh. Section 5. — There shall be established at each office of Area President an Area Commission for the engagements of repatriates in the local Public Bodies. These Area Commissions shall be constituted within 10 days from the date of publication of this Order by the Area President, who shall be the chairman thereof and .who shall appoint as members, four regular officials of the most important local Public Bodies of each Area. The Area President may delegate an official of his Office of a grade not inferior to VII to preside the meetings of these Commissions .Two of the members of the Commissions shall be chosen from officials belonging to one of the categories referred to in Article I of this Order. The decisions of these Commissions shall not be subject to appeal. ARTICLE XI PERSONNEL EXCLUDED FROM THE PROVISIONS OF THE PREVIOUS ARTICLES Section I. —- Personnel of Ordinary Magistracy, lawyers of the State, teachers, shall be excluded from the computation of the regular personnel, in connection with the application of Article IV. Section 2. — Separate instructions will be issued by the Allied Military Government for Railway employees. 241 PART II PRIVATE CONCERNS ARTICLE XII ENGAGEMENT OF NEW PERSONNEL Section i. — (a) Private concerns, in whatever form constituted, having more than 20 employees, shall in new engagements, give employment at the rate of 50% to persons of the categories specified in Article I of this Order. (b) Re-engagements effected under collective contracts shall not be considered as new engagements. . Section 2. — The provisions of Sections 2, 3 and 4 of Article I of this Order shall apply to this Article. ARTICLE XIII RE ENGAGEMENT OF PERSONNEL NOT ON PROBATION Section i. — The existing provisions, either legislative, or relating to regulations or contracts, concerning the conservation of the post in case of call to the Armed Forces for exigencies of war shall remain in force. The personnel, not on probation, mentioned in the aforesaid provisions, shall be entitled to re-engagement in the following cases : a) if they were deported or interned by fascists or Germans after 8 September 1943 ; or b) called to the Armed Forces to comply with the obligations of conscription and retained in military service after the regular term of conscription ; or c) were combatant partisans who abandoned the service for the purpose of participating in the struggle for liberation. Section 2. — a) The re-engagement shall be provided in the concern in which the employees were in active service at the time of deportation, or of internment, or of call to the Armed Forces, or of abandonment of service, and shall be subject to the condition that the persons concerned are lacking of means indispensable for their own living, or of their families cohabiting with them. b) For seniority purposes, the period of service prior to the re-engagement shall not be computed. ARTICLE XIV TIME LIMITS FOR APPLICATION OF RE-ENGAGEMENT Application for re-engagement to service, as considered by the foregoing Article, shall be made within 40 days from the effective date of this Order ; otherwise it shall be null and void. For those, who on the aforesaid date have not yet been repatriated or discharged from military service, the term shall elapse from the date of repatriation or discharge from military service. ARTICLE XV PERSONNEL ENGAGED IN SUBSTITUTION FOR THOSE RE CALLED TO MILITARY SERVICE a) The provisions of Article XIII and XIV shall be applicable also to those employees, who in accordance with Article XXXI of the law 10 June 1940, No. 653, have been employed in substitution of those re-called to the service in the Armed Forces. b) For the personnel indicated in the foregoing para, the re-engagement to service in cases under and in accordance with Article XIII, shall be provided also if the persons concerned are called to service in the Armed Forces for exigencies of war. 242 ARTICLE XVI COMPULSORY ENGAGEMENT OF A PERCENTAGE OF EMPLOYEES Section i. — a) Private concerns which on December 31, 1945 had at least 10 employees shall within the period of 30 days from the effective date of this Order, employ veterans of the war 1940-43 and/or of the war of liberation, combatant partisans and persons who were deported or interned by the enemy after September 8, 1943, — at the rate of 5 percent of the employees in active service on December 31, 1945. b) The engagement to service, to be effected at the rate of one for each 20 employees or fraction of such number (exceeding nine), shall be provided in favour of those deprived of the necessary means for their own living or of the families cohabiting with them. Section 2. — a) In computing the percentage established in Section 1, the following shall be considered : 1) personnel re-engaged in accordance with Articles XIII and XV of this Order ; 2) personnel having the qualification set forth in Section 1 of this Article and engaged to service by the concern prior to the effective date of this Order. (b) The engagements decided under the provisions which ensure the keeping of the post for those called to the Armed Forces shall not be computed in the percentage mentioned in the first par,a. ARTICLE XVII FEMALE PERSONNEL The female personnel, who with regard to the peculiar nature of the concern, perform functions normally and traditionally performed by women, shall not, for the purpose of the percentage mentioned in the preceding Article, be computed in the total number of employees of the concern. ARTICLE XVIII DURATION OF ENGAGEMENT AND RE-ENGAGEMENT (a) Employees engaged or re-engaged to service in accordance with Articles XIII, XV and XVI must remain.in service for at least one year from the date of re-engagement or engagement, except in cases of dismissal for a just reason or of cessation of the concern’s activity. (b) In case of dismissal for a just reason the persons considered in the foregoing para shall be substituted with other personnel being in the conditions considered by Article XVI for the duration of the year mentioned in the preceding para. ARTICLE XIX ENGAGEMENT AND RE-ENGAGEMENT COMPUTABLE FOR THE PURPOSE OF THE PERCENTAGE The re-engagements to service mentioned in Articles XIII and XV shall not be regarded as new engagements for the purpose of the percentage provided for in Article XII. The engagements decided in accordance with Article XVI shall be, however, computable in the aforesaid percentage. ARTICLE XX PRINCIPLES FOR ENGAGEMENT The engagement to service provided for in Article XVI must be effected through the Laboroffices and shall be chosen by the employer ; the professional capabilities of the applicants shall be taken into account. 243 ARTICLE XXI SUPERVISION FOR OBSERVANCE OF THESE PROVISIONS The supervision for compliance with the provisions contained in Part II of this Order is hereby intrusted to the Labor Office. ARTICLE XXII PENALTIES Section i. — (a) Employers contravening the provisions of this Order shall be liable to punishment- by a fine (ammenda) of Lire 100.— for each working day and for each post reserved by this Order to the persons indicated therein and not assigned in accordance with this Order. In each case the fine may not be inferior to Lire 2000.—. fbj The penalty for non compliance with the obligation established by the first para of Article XVIII shall be a fine (ammenda) of from Lire 5000.— to Lire 20.000.—. Section 2. — Those who obtain by fraudulent means their engagement or re-engagement to service in accordance with the provisions contained in this Order, shall be liable to punishment by imprisonment up to six months. PART III GENERAL RULES ARTICLE XXIII MAXIMUM LIMIT OF PERCENTAGE IN DISMISSALS (a) As to dismissals of non regular staff, which Public Administrations and private concerns may deem necessary to provide for in case of excessive number of personnel, the employees considered in Article I of this Order shall not be comprised in excess of 50 percent of the total number of dismissed dependents. ■ (b) For the purpose of this Article, the rate of dismissals shall be computed separately for each professional qualification or category. (c) The computation of dismissals shall be made for six months periods. (d) Employers contravening the provisions of this Article shall be liable to punishment by a fine (ammenda) of from Lire 1000.— to Lire 20.000.—. ARTICLE XXIV EVIDENCE OF QUALIFICATION OF PARTISAN OR OF REPATRIATE Section I. — For the purpose and to the effect of this Order the term „fighting partisan“ and „combatant partisan“ shall be construed as being those persons so registered and certified as such by the Chief Partisan Officer of Allied Military Government Venezia Giulia. Registration upon the rolls of the Chief Partisan Officer Allied Military Government shall be sufficient proof of such status. Proper certificate thereof shall be supplied by the Partisan Division. Section 2. — For the purpose and to the effect- of this Order, the qualification of repatriate released from deportation and of civilian repat riate released from imprisonment shall be established by proper certificate thereof of the Commune where the applicant is residing. ARTICLE XXV EXEMPTION FROM STAMP DUTIES AND TAXES The applications for the re-engagement and engagement to service submitted by these in the condition provided for by this Order as well as the documents relating to such applications shall be exempt from stamp duties and taxes. 244 ARTICLE XXVI EFFECTIVE DATE This Order shall take effect on the day of its publication,in the Allied Military Government Gazette. Senior Civil Affairs Officer Order No. 242 FORMATION OF TERRITORIAL FOOD ADMINISTRATION WHEREAS it becomes necessary to coordinate the existing food services into one central organization, within those parts of Venezia Giulia administered by the Allied Forces. (hereinafter referred to as the ,,Territory“), NOW, THEREFORE, I, ALFRED O. BOWMAN, Colonel, J.A.G.D., Senior Civil Affairs Officer, ORDER: ARTICLE I FORMATION OF TERRITORIAL FOOD ADMINISTRATION Section 1. —-A Territorial Food Administration (Direzione Territoriale dell’Alimen-tazione : hereinafter referred to as „DITERAL“) shall be formed with its main office in Trieste, and jurisdiction in food matters over the whole Territory of Venezia Giulia. Section 2. — The DITERAL shall be represented in each Area of Gorizia, Trieste and Pola by the existing Provincial Food Section (Sezione Provinciale dell’Alimentazione), which shall be renamed Food Section (Sezione per T Alimentazione) but shall continue to be known by the abbrevation SEPRAL. ARTICLE II MANAGEMENT Section 1. — The Managing Director of DITERAL and his deputy shall be appointed by Allied Military Government. Section 2. — The administrative Board (Consiglio di Amministrazione) shall be composed of the Managing Director of DITERAL as chairman, and 2 members appointed by Allied Military Government. This board shall be responsible for the proper management of DITERAL. 245 Section 3. — A Board of Controllers (Collegio dei Sindaei) consisting of a Representative of Intendenza di Finanza as chairman, a representative selected by the Trieste Area President and a Public Accountant selected by Allied Military Government shall act in an advisory capacity to the Administrative Board and perform such auditing or other duties as are vested in „Collegio dei Sindaei“ by law for similar corporations. ARTICLE III APPOINTMENT OF DIRECTOR OF SEPRAL The Director of each Area Food Section (SEPRAL) shall be appointed by the Director of DITERAL, with the approval of Allied Military Government. ARTICLE IV SALARIES OF PERSONNEL Section 1. —• Members of the Administrative Board and Board of Controllers and Director of SEPRAL shall be paid such salaries, fees or allowances as shall be determined by Allied Military Government. ARTICLE V » TRANSFER OF SEPRAL ASSETS AND LIABILITIES Section 1. — All assets, rights, benefits and interests formerly belonging to SEPRAL shall be transferred to DITERAL. Section 2. — DITERAL shall assume all the liabilities of SEPRAL. ARTICLE VI FUNCTIONS OF DITERAL Section 1. — DITERAL shall: a) Finance, receive, warehouse and distribute through commercial or other channels all foodstuffs supplied by Allied Military Government or allocated from any other source to the Territory. b) Organize and control the distribution throughout the whole Territory of those foodstuffs and other items it is deemed necessary to ration. c) Control raw materials and ¡production of all factories manufacturing, transforming, handling and distributing rationed foodstuffs. cl) Procure under Allied Military Government Authority all food supplies deemed necessary for the Territory, and control the rationed or unrationed distribution thereof within the Territory. e) Exercise control over all foodstuffs entering or leaving the Territory. f) Provide for the collection of all revenue due foi the payment of all administrative expenses, and for the preparation of accounts as required by law. g) Perform such duties as shall be delegated by Allied Military Government. 246 ARTICLE VII AMENDMENT TO ORDER No. 59 The last sentence of Article II, Order No. 59 dated January 10, 1946, is hereby revoked and in lieu thereof shall be substituted : „The Director of each Area Food Section (SEPRAL) shall for his respective Area, preside over the Commission“. D. L. 2g August 1941, No. 913, in that part of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the „Territory“), NOW, THEREFORE, I, ALFRED C. BOWMAN, Colonel, J.A.G.D., Senior Civil Affairs Officer, ORDER: ARTICLE I ABROGATION OF R. D. L. 29 AUGUST 1941, No. 913 — REPEAL OF PROHIBITION CONCERNING THE ALIENATION OF MOTORVEHICLES, DETACHED PARTS AND SPARE PIECES THEREOF TO FOREIGN CITIZENS AND BODIES R. D. ARTICLE II APPROVAL BEFORE REGISTRATION Automobile Register Officials will, before registering any transfer of motorvehicles, detached parts or spare pieces thereof to foreign citizens and bodies, obtain approval from the Allied Military Government. Senior Civil Affairs Officer 247 Order No. 260 FISCAL FACILITIES IN FAVOUR OF THE SHIP BUILDING INDUSTRY WHEREAS it is deemed opportune and desirable to grant fiscal facilities in favour of the ship-building industry in those parts of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the „Territory“), NOW, THEREFORE, I, ALFRED C. BOWMAN, Colonel, J.A.G.D., Senior Civil Affairs Officer, ORDER: ARTICLE I FISCAL FACILITIES FOR CONTRACTS RELATING TO SHIP BUILDING Article 12, 1st para, of RDL 10 March 1938, .No. 330, is amended to read as follows : „Written as well as verbal contracts for the building, re-fitting, modification and conversion of ships are subject to registration against payment of the fixed registry tax. The relative supplies are exempt from the payment of license fees“. ARTICLE II PROCEDURE OF REGISTRATION OF CONTRACTS In order to obtain the registration against payment of the fixed rate of tax, the parties concerned shall file with the Registry Office a declaration of the appropriate Harbour Office confirming that the scope of the contract is in accordance with the provisions of this Order. Such declaration shall be filed at the time when the document constituting evidence of the agreement entered into by the parties, is presented for registration. The fixed registry tax covers : a) in relation to the building of ships, all that is needed in order to put the ship, including her equipment, in an efficient condition for the special use for which she is intended ; b) in case of alterations, conversion of re-fitting, all that is needed for the relative works on the hull, engines, auxiliary apparatuses and equipment. ARTICLE III AUTHORITIES COMPETENT TO GRANT FACILITIES Article 14-, 1st para, of RDL 10 March 1938, No. 330, is amended to read as follows: „The granting of the concession provided by this Order is subject to the inappellable judgment of Allied Military Government, except as regards the fiscal facility, concerning the registry tax referred to in the 1st para of Article 12, which is under the exclusive authority of the Finance Administration“. ARTICLE IV APPLICABILITY TO CONTRACTS ALREADY ENTERED The provisions of the foregoing Articles shall also apply to contracts agreed upon before the effective date of this Order, but which have not yet been registered, provided that they shall be regularized within 90 days of the effective date of this Order. 248 Contracts already entered in Harbour Offices’ books and provisionally registered under, Article 124, 125, 126, 127 and 128 of the Regulations approved by R. D. 13 April 1939-No. 1101, may be definitely exempted from the Registry Tax, apart from any other formality. Registry taxes, however, which have been already paid at the ordinary full rate, shall not be reimbursed. ^RTICLE V APPLICABILITY TO CONTRACTS FOR THE SALVAGE OF SHIPS The provisions of Article 1, 2 and 3 hereof apply also to contracts for the recovery of foundered or damaged ships. ARTICLE VI REPEAL OF PREVIOUS PROVISIONS The provisions of part. VII, chapter I of-the Regulations approved by R. D. 13 April 1939, No. 1101, and any other provisions inconsistent with the Articles of this Order are hereby repealed. Senior Civil Affairs Officer Order No. 261 EXTENSION OF TERM FOR THE BENEFITS GRANTED TO WORKERS CALLED INTO THE ARMED FORCES WHO ARE PRISONERS OF WAR WHEREAS, it is deemed advisable and necessary to extend the term for the treatment granted to workers called into the Armed Forces and the Family Allowances connected therewith to those workers who are prisoners of War, in that part of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the „Territory“), NOW, THEREFORE, I, ALFRED O. BOWMAN, Colonel, J.A.G.D., Senior Civil Affairs Officer, ORDER: ARTICLE I EXTENSION OF TERM The benefits provided for by Law of 10 June 1940, No. 653, and by R. D. L. 20 March 1941, No. 123, converted, with amendments, into Law of 1 August 1941, No. 985, in favour of private employees (impiegati) and similar categories called into the Armed Forces and taken 249 Prisoners of War, and the payment of Family Allowances provided for by R. D. L. 26 October 1940, No. 1945, converted, with amendments, into Law of 18 April 1941, No. 391, and by R. D. L. 29 December 1941, No. 1582, converted into Law of 11 July 1942, No. 994, in favour of labourers (operai) or similar categories called into the Armed Forces who were taken Prisoners of War, shall be granted for the entire period of captivity, even if the duration should be in excess of the period of 60 days after the cessation of hostilities. Senior Civil Affairs Officer Order No. 268 FUNCTIONS OF SUPERINTENDENTS OF SCHOOLS AND OF OTHER SUBORDINATE BODIES FOR ELEMENTARY SCHOOLS WHEREAS it is considered advisable and necessary to define the functions of the Superintendents of Schools and of the other subordinate bodies for elementary schools, within that part of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the „Territory“) ; NOW, THEREFORE, I, ALFRED O. BOWMAN, Colonel, J.A.G.D. Senior Civil Affairs Officer, ORDER: ARTICLE I BODIES OF SCHOOL ADMINISTRATION The Administration of elementary schools within the Territory shall be vested in the following administrative Bodies : 1) Education Division of the Allied Military Government. 2) Superintendents of Schools and 3) the Councils of Discipline and School Councils according to the competence established by Order No. 137 dated 22.May 1946 and by Order No. 219 dated 27 September 1946. 250 ARTICLE II FUNCTIONS OF THE SUPERINTENDENT OF SCHOOLS Section 1. — The Superintendent of Schools shall : 1) Supervise, personally or through the school Inspector and Director, the teaching in public and private elementary schools ; 2) announce competitions for the appointment of teachers according to the directives issued by the Education Division of the Allied Military Government ; 3) approve the classifications relating thereto ; 4) provide for the appointment and transfer of teachers ; ' 5) make final decisions on their appeals against service certificates and against punishments of „censura“ ; 6) take any measure usefull to the teaching in elementary schools ; 7) order the closing of schools in urgent eases ; 8) appoint Commissioners for investigations to be made in Communes not complying with the obligations towards schools, subject to approval of Area Commissioner ; 9) exercise all other functions conferred on him by laws and regulations. Section 2. ■—• Measures regarding appointments without competitions in cases considered by law, and re-engagements of elementary schools teachers, shall be subject to ratification by the Education Division of the Allied Military Government and approval of the Area School Council. ARTICLE III REPEAL OF CERTAIN PROVISIONS Articles 1, 2 and 4 of R. D. L. 26 September 1935, No. 1866 and any other provision, contrary to or in any way inconsistent with this Order are hereby repealed. Senior Civil Affairs Officer 251 Order No. 270 REPAIR OF WAR DAMAGED HOUSES IN DISTRESSED AREAS WHEREAS, there are Communes■ and fractions of Communes (hereinafter referred to for convenience as Distressed Areas), in that part of Venezia-Giulia adininistered by the Allied Forces, wherein houses were destroyed or substancially damaged by reason of the war or by the Germans or Fascists as a reprisal against Partisan activities; and WHEREAS, the Allied Military Government has undertaken to repair or reconstruct all or some of the houses located in such Distressed Areas without any cost to or other obligation, now or in the future, of the owners thereof: NOW, THEREFORE, I, ALFRED C. BOWMAN, Colonel, J.A.G.D., Senior Civil Affairs Officer, ORDER: ARTICLE I Section i. — The following Commune or fractions of Commune is hereby declared to be a Distressed Area : PREBENICO Section 2. — The provisions of Article I, Sections 1 and 3, of Order No. 146, dated June 6, 1946, are hereby made applicable to the Areas indicated in Section 1 above. Senior Civil Affairs Officer Order No. 272 INCREASE OF LEVY IN FAVOUR OF CHAMBERS OF COMMERCE WHEREAS, it is considered opportune to increase the levy in favour of the Chambers of Commerce in those parts of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the ..Territory"), NOW, THEREFORE, I, ALFRED C. BOWMAN, Colonel, J.A.G.D., Senior Civil Affairs Officer, ORDER: ARTICLE I The maximum percentage rate of tax i.i favour of Chambers of Commerce as established in Article 1 of R. D. 31 October 1941, No. 1418, is hereby trebled. The new' rate shall, however, in no case exceed 5%. ARTICLE II The new rate shall be applicable for the year 1947 and following years. Senior Civil Affairs Officer Order No. 273 PAYMENT OF A „WINTER BONUS“ TO PRIVATE EMPLOYEES (EXCEPT AGRICULTURAL) AND TO UNEMPLOYED AND DISABLED WORKERS WHEREAS, it is considered advisable and necessary to provide for the payment of an extraordinary Winter Bonus to Private Employees and to Unemployed and Disabled workers in that part of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the „Territory'') in order to enable them to provide themselves with the most urgent necessities for the incoming winter ; NOW, THEREFORE, I, ALFRED C. BOWMAN, Colonel, J.A.G.D., Senior Civil Affairs Officer, ORDER: ARTICLE I PAYMENT OF A „WINTER BONUS“ Section i. — The payment in a lumpsum of an extraordinary allowance, called „Winter Bonus“, on the conditions specified in the following Articles, is hereby provided for in favor of persons employed or registered as unemployed, and of disabled workers (grandi invalidi del lavoro), residing in the Territory. Section 2. — For the purpose of this Order, the residence shall be that resulting from the registration of the persons concerned in the Communal Register of the Permanent Population on 1 September 1946. ARTICLE II PAYMENT TO EMPLOYED WORKERS Section i. — All manual and clerical workers in private employment (excluding agricultural workers), who appear as employed on 1 September 1946, shall be entitled to receive a lumpsum Winter Bonus of 3.000 lire if they are heads of a family, and of 1.500 lire if they are not qualified as such. Section 2. •— For the purposes of this Order workers temporarily absent owing to sickness, accident, vacation, pregnancy, child-birth, regular leave, suspensions not of a disciplinary nature, and paid furlough (aspettativa con assegni) not exceeding six months, shall he considered as employed. Seamen who on 1 September 1946. were assisted by the „Casse Marittime“ for sickness or accidents shall be excepted. They shall receive the Bonus from the aforesaid „Casse“. Section 3. — The Winter Bonus shall not be due to : a) Workers with average total gross monthly earnings above 25.000 lire, taking into consideration the period from 31 August 1945 to 31 August 1946. 1) For the purposes of this subdivision the allowances mentioned in Article I, Section 3 of General Order No. 47 shall not be considered as part of the earnings. 2) As to seamen, the following allowances shall be considered as part of the earnings : the sums paid as conventional food allowances (to be computed at the rate of 100%) and all payments of a continuous and fixed nature, including indemnities due for risks deriving from mines (indennità per rischio mine). b) Workers paid exclusively by sharing the products. c) Workers performing the work at home (lavoratori a domicilio). 253 Section 4. — Partners of Cooperative Societies and generally of all Cooperative Bodies, even if not legally recognized, working for the said societies or bodies as' well as workers on the roster of Port Companies and Port Groups, shall be entitled to the Winter Bonus. ARTICLE III OBLIGATION OF EMPLOYERS FOR THE PAYMENT OF THE WINTER BONUS The Winter Bonus, except as differently provided for in the following Articles, shall be a charge on the employers and shall be paid directly to the employees within thirty days from the effective date of this Order. ARTICLE IV SPECIAL PROVISIONS FOR DOCKWORKERS Section 1. — a) The payment of the Winter Bonus to partners and workers employed by the Port Companies or Port Groups shall be made directly by the Cassa Unica Assegni Familiari to the respective Companies or Groups upon their request, specifying all data necessary for the payment certified by the Employment Section and by the Port Section of the appropriate Labor Office. b) As to the payments due under this Article, the Istituto della Previdenza Sociale shall keep a separate accounting. Section 2. — An Allied Military Government provision will establish the rate and the duration of a contribution to be charged to the Forwarding Agents and Consignees of Gcods, per each ton of goods handled by the dock labourers. The amount of the contribution shall be paid to the Cassa Unica Assegni Familiari to discharge the latter of the payment effected. ARTICLE V SPECIAL PROVISIONS FOR EMPLOYEES OF OWNERS OF BUILDINGS AND FOR CERTAIN OTHER CATEGORIES OF WORKERS Section 1. — Workers employed by owners of buildings. Artisan Firms (Aziende Ar-tigiane) including workers employed by bakeries operating for third persons, shall receive the Winter Bonus directly from the Cassa Unica Assegni Familiari, upon an application in writing filed by the respective employers, and containing the list of the employees concerned. Section 2. — In order to cover the payment of the Winter Bonus, the aforesaid employers shall pay to the Cassa Unica Assegni Familiari a contribution of 8% of the gross earnings of the workers for the periods of pay accruing after 30 November 1946, and current on 30 April 1947. t ARTICLE YI SPECIAL PROVISIONS FOR UNEMPLOYED PERSONS Section 1. — The Winter Bonus, payable in a lumpsum by the Cassa Unica Assegni Familiari, shall be due to those persons who, on 1 September 1946, were regularly registered in the records of unemployed persons of the appropriate Labor Office. . Section 2. — For the purposes of the payment of the aforesaid Winter Bonus, the „Ispet-torato“ for Venezia Giulia of the Istituto della Previdenza Sociale shall provide for the issuance of the necessary regulations for the application thereof in consultation with the Territorial Labor Office. Section y. — In the event of a refusal on the part of the Cassa Unica Assegni Familiari to pay the Bonus, the parties concerned shall have the right to appeal to the competent Labor Office whose decision shall be final. 254 ARTICLE VII PROVISIONS FOR DISABLED WORKERS Section i. — The Winter Bonus shall be due to the workers who have been seriously disabled as a consequence of their work (grandi invalidi) and recognized as such by Article 61 of R. D. 17 April, 1935, No. 1765 ; it shall be paid in the amount of 3.000 lire to those who are in the family conditions specified in the aforesaid Decree for the purpose of the assignment, of supplementary allowances, and of lire 1.500 to the others who do not fulfill those conditions. Section 2. — The Winter Bonus shall be further due in the amount of 3.000 lire and of 1.500 lire to each family group of three or more survivors and respectively of one or two survivors of workers killed in an accident on their work, who receive (titolari) the pensions as provided for under R. D. 17 August 1935, No. 1765, provided that the children are younger than 15 years of age or unable to work, and that the surviving spouse and the other survivors have reached the age of 65 or are unable to work. ' Section 3. — The Winter Bonus due according to the foregoing Sections shall be payable for accidents which occurred before 1 September 1946 by and at the charge of the Istituto di Assicurazione Contro gli Infortuni sul lavoro. ARTICLE VIII ABSORPTION OF PREVIOUS GRANTING OF WINTER BONUS Section I. — The Winter Bonus shall not be paid in addition to payments made by employers, under this or any other denomination, in a lumpsum or on account, on advance, or on loan, after 31 July 1946, in anticipation of the substantial provisions of this Order, with the exclusion of advances on transactions for category contracts and of private arrangements made within the single firms. In case such payments are lower than the amounts fixed by this Order, the difference shall be paid as Winter Bonus in accordance with the provisions hereof. Section 2. — The absorption referred to in the foregoing para shall not extend to such cases in which it has been specifically excluded. ARTICLE IX GENERAL PROVISIONS Section i. ■— For the application of this Order, those workers shall be considered as heads of a family who have such qualification and receive family allowances in accordance with the laws in force. I Section 2. — a) The Winter Bonus, payable under this Order, is of a personal nature and may be received only once, excluding double payments even where the persons concerned may be included in more than one of the categories of persons specified in this Order as being entitled thereto. b) In the event of a worker simultaneously serving various employers, each employer shall contribute his share of the Winter Bonus in proportion to the working hours of the worker at the respective concern or, in cases where this principle is not applicable, in proportion to the wages paid by the concerns. Section 3. — The Winter Bonus shall be reduced to two-thirds in case of workers paid in kind or with food-stuffs in proportion of not less than one-third of the earnings. Section 4. — a) The Winter Bonus shall not be considered as part of the earnings and shall not be subject to seizure or pledging. 255 b) It shall not be subject to deductions or contributions for any kind of social insurance, and shall be exempt from taxation of any kind whatsoever. Section 5. — The applications for the Winter Bonus shall be filed with the employers or respectively with the Istituto della Previdenza Sociale, as the case may be, within 15 days from the effective date of this Order. After such date the applicants shall be barred from the right of applying. Section 6. — (a) If the obligation of the Cassa Unica Assegni Familiari in connection with the payment of the Winter Bonus should exceed the amount of the contributions as established in this Order, Allied Military Government may provide for further contributions from the employers obligated under this Order. (b) Allied Military Government shall reimburse in full the-Cassa Unica Assegni Familiari for the sums paid by them under Article VI hereof. ARTICLE X PENALTIES Any person violating any of the provisions of this Order shall, upon conviction by an Allied Military Court, be liable to a fine or imprisonment or both, as the Court may determine. ARTICLE XI EFFECTIVE DATE This Order shall become effective within the Territory on the date of its publication in the Allied Military Government Gazette. Senior Civil Affairs Officer 256 Order No. 274 WINTER BONUS FOR PUBLIC EMPLOYEES AND FOR CERTAIN CATEGORIES OF WAR MUTILATED PERSONS AND INVALIDS WHEREAS, it is considered advisable and necessary to grant an extraordinary Winter Bonus to all public employees and to certain categories of war mutilated persons and invalids in that part of Venezia Giulia, administered by Allied Forces (hereinafter referred to as the „Territory"), in order to enable them to provide themselves with the most urgent necessities for the incoming winter ; NOW, THEREFORE, I, ALFRED C. BOWMAN, Colonel, J.A.G.D., Senior Civil Affairs Officer, ORDER: ARTICLE I GRANTING OF A WINTER BONUS The payment of a Winter Bonus is hereby authorized in favour of the public employees specified in Article II and V of this Order, serving on 1 September, 1946, and in favour of war mutilated persons and invalids specified in Article VI hereof. ARTICLE II STATE EMPLOYEES TO WHOM THE WINTER BONUS IS PAYABLE Section i. — The Winter Bonus shall be paid to : a) temporary (non di ruolo) and permanent (di ruolo) civilian and wage-earning (sa-lariato) State personnel, including temporary (non di ruolo) teachers, even if prisoners of war. Personnel with respect to whom an actual employment (rapporto d’ impiego o di lavoro) of a continuous nature with the Public Administration does not exist, shall be excluded from the payment; b) personnel of the Post and Telecommunications Offices referred to in Order No. 230 of 5 October 1946, with the exclusions set forth in the preceding para (a). The payment of the Winter Bonus to substitutes (supplenti) referred to in Article IV of the said Order, shall be paid by their receiving agents (ricevitori) and administrating contractors (gerenti), to whom the expense shall be reimbursed by the Post and Telegraph Administration ; c) personnel of the Venezia Giulia Police Force, Italian Red Cross, Fire Brigade (Corpo Vigili del Fuoco)., Section 2. — As to the personnel mentioned in Section 1 prisoners of war (or internees) abroad, the Winter Bonus shall be families with the procedure set forth by Article 41 of R. D. 19 ARTICLE III AMOUNT OF THE BONUS Section i. — The amount of the Winter Bonus is hereby established as follows : a) 3.000 Lire net from any deduction, to personnel receiving the additional allowances for cost of living bonus referred to in Section 5 and in Section 7 of Article II of General Order No. 63, or the special allowance set forth by Article 91 of R. D., 31 December 1928, No. 3458 and amendments and extensions thereto ; of this Article who are paid to their respective May, 1941, No. 583. 257 b) 1.500 Lire net from any deduction, to personnel not receiving the additional allowances or the special allowance referred to in the preceding para (a). Section 2. — The amounts referred to in Section 1 of this Article, shall be reduced by 50% for personnel who on 1 September 1946 were receiving food rations in kind or allowances in lieu thereof. ARTICLE IV PERSONNEL EXCLUDED FROM THE PAYMENT OF THE WINTER BONUS Section I. — The Winter Bonus shall not be paid to personnel receiving total gross earning above 25.000 lire monthly. Section 2. — For the purpose of Section 1, the following shall be considered as forming the total earnings : the salary, the personal allowances computable for the pension and the cost of living bonus (excluding the additional allowances for the dependent family members). For the same purpose, the cost of living bonus, in respect of personnel receiving food rations in kind or allowances in lieu thereof, shall be computed in full, without taking into consideration the deductions deriving from the receiving of the said rations or allowances. ARTICLE V EXTENSION OF THE PAYMENT OF THE WINTER BONUS TO OTHER PUBLIC EMPLOYEES Section i. — The Winter Bonus, in the amounts and at the conditions set forth in the foregoing Articles, may be granted according to the rules and the procedure established by Article VIII of General Order No. 63, also to employees of the following bodies : Area Administrations, Communes or Districts ; welfare and charitable institutions ; parastatal agencies and, generally, all public institutions {„Istituti di diritto pubblico“) even with autonomous organization („con ordinamento autonomo“), subject to the control („vigilanza“) or supervision („tutela“) of the Government or for the maintenance of which the Government contributes regular subsidies ; agencies attached to or directly depending on Area Administrations, Communes or Districts and the other aforementioned bodies. ‘Section 2. — Personnel subject to the legal regulations („disciplina giuridica“) of the collective labor contracts shall be excluded .from the provisions of this Article. ARTICLE VI EXTENSION OF THE PAYMENT OF THE WINTER BONUS TO MUTILATED PERSONS AND INVALIDS OF THE WAR 1910-1945 Section i. — The Winter Bonus shall also be paid to mutilated persons and invalids of the war 1940-45 to whom the right to a war pension or war allowance of one of the first five categories, has been or will be granted with effect as from a date not later than 1 September 1946, and who are not entitled to the Winter Bonus under the foregoing Articles., Section 2. — The Winter Bonus referred to in Section 1 of this Article shall be paid at the rate of: — 3.000 Lire net, to persons with own family dependents (famiglia acquisita a carico) ; — 1.500 Lire net, to others. ARTICLE VII EXCLUSION OF DOUBLE PAYMENT OF THE WINTER BONUS Section i. — The Winter Bonus payable under the provisions of the foregoing Articles shall be of a personal nature and shall be paid only for one of the reasons originating the right thereto. 258 Section 2. — Those persons who are entitled to the payment of the Winter Bonus in accordance with the provisions of this Order and have transferred their residence from .Italy to the Territory after 26 July 1946, shall be paid the Winter Bonus only upon approval of an application filed with the Allied Military Government. Section 3. — The Winter Bonus, as set forth in the foregoing Articles shall not be paid to persons entitled thereto under the provisions of Order No. 273. ARTICLE VIII EFFECTIVE DATE This Order shall become effective within the Territory on the date of its pubblieation in the Allied Military Government Gazette. Senior Civil Affairs Officer 259 Administrative Order No. 75 ADMINISTRATIVE PROVISIONS FOR THE ENACTMENT OF ORDER No. 38 WHEREAS, Order No. 38, dated 12 November IQ45, provides for the incorporation of the local Offices of the National Economic Board of Agriculture (Ü.N.S.E.A.), (hereinafter referred to as „the said Offices'"), into the reorganized Inspectorates of Agriculture, (hereinafter referred to as „Inspectorates" ). in those parts of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the „Territory"), and WHEREAS it is considered necessary to issue administrative instructions for the termination of employment of former employees of the said Offices and for their integration into the Inspectorates and, finally, for the administration of the property and funds of the said Offices, NOW, THEREFORE, I, ALFRED C. BOWMAN, Colonel, J.A.G.D., Senior Civil Affairs Officer ORDER: ARTICLE I PERSONNEL Section 1. — The incorporation of the said Offices into the Inspectorates, provided for by Order No. 38, shall be considered completed as of 30 April 1946. Section 2. — The'employment of the former employees of the said Offices shall be considered terminated as of 30 April 1946. These employees shall be paid such salaries and allowances, including dismissal allowances and other payments accrued in their favor, due them up to and including 30 April 1946, in accordance with the regulations governing the said Offices. Section 3. — The former employees of the said Offices who have been re-engaged in the Inspectorates shall not be considered career employees of the latter. Such employees shall be classified under one of two categories, namely : a) Those who have been given grades in the Inspectorates by Allied Military Government. b) Those who have not been given grades. Section 4. — Personnel under a) of Section 3 shall be paid the salaries corresponding to those of State Officials having the same grades. Section 5. — Personnel under b) of Section 3 shall be paid the salaries and allowances of temporary (avventizi) State Employees as provided by existing legislation. V> here personnel under b) of Section 3 were receiving from the said Offices salaries higher than those of temporary (avventizi) State Employees, the difference shall continue to be paid as personal allowances (assegno ad personam) .Such personal allowances shall be absorbed by any increase of basic salaries authorized by Allied Military Government after 30 April 1946. ARTICLE II ADMINISTRATION OF FUNDS Section 1. — The said Offices shall close their administration of funds as such as of 30 April 1946. The payments referred to in Section 2 of Article I shall be included in such administration. Section 2. ■— The funds received by the said Offices up to 31 December 1946, not including expenses or salaries incurred prior to 1 May 1946, shall be reimbursed to the State Treasury by the Territorial Inspectorate of Agriculture, which shall request from Allied Military Government the funds necessary to effect such reimbursement. Section 3. — As from 1 January 1947 there shall be submitted only one budget to Allied Military Government by the Territorial Inspectorate of Agriculture which shall include all Area Inspectorates. ‘ 260 ARTICLE III ADMINISTRATION OF PROPERTY The administration of all the properties belonging to „the said Offices“ shall be transferred to the Territorial Inspectorate of Agriculture not later than 31 December 1946. Area Commissioner Gorizia Area Area Order No. 120 CONSERVATION OF ELECTRICAL POWER IN THE GORIZIA AREA WHEREAS the shortage of electric current in the Gorizia Area has become critical, AND WHEREAS it has become necessary to restrict the consumption of electricity, NOW, THEREFORE, I, FRED 0. MAVIS, Lt. Col. Inf., Area Commissioner for Gorizia Area, by virtue of the power vested in me by General Order N. 84, Art. III., hereby ORDER: ARTICLE I RESTRICTION IN THE USE OF ELECTRIC CURRENT Section 1. — The consumption of electricity by domestic users for lighting and domestic purposes and appliances is limited to 150 KWO per month for each family of four or less persons, for each person in excess of four the allowance is increased by 30 KWO per month with a maximum for the whole family of 300 KWO per month. 269 Section 2. — All Cinemas and Theatres will be opened between the hours of 1630 and 2300 only. The prohibition referred to in Article II Section 2 applies also to Cinemas and Theatres. Section j. — All bars, wine-shops, and restaurants will close at 2300 hrs and in addition will reduce their consumption so as not to exceed sixty six and two thirds per cent of. the consumption figure for the month of October 1946. Section 4. — Street lighting will not be switched on until 30 minutes after sunset and will be switched off one hour before sunrise. The average intensity of all street lighting will be reduced by 40%. Section 5. — AH current throughout the area will be switched off daily (including Sunday) between the hours of 0830 and 1130. Section 6. —- Barbers and Hairdressers will not use electric currënt for lighting or operating appliances after 1830 hrs. Section 7. — Industrial enterprises taking their supply direct from S.E.L.V.E.G. shall not be restricted as to hours but will reduce their consumption so as not to exceed 80% of the consumption figure for the month of October 1946. Section 8. — No shops, offices, commercial, industrial or artigiani enterprises will use electricity for lighting or power purposes between 1730 and 0700 hours. Section 9. — All flighting in public rooms in all Hotels and Pensions will be switched off not later than 2300 hours and in addition all such establishments will reduce their consumption so as not to exceed sixty six and two thirds per cent of the consumption figure for the month of October 1946. Section 10. — The term „restriction“ shall for the purposes of this Order be so interpreted as to include „prohibition“. ARTICLE 11' ■ -J PROHIBITION IN THE USE OF ELECTRICAL CURRENT Section 1. — The use of electricity for space heating in' all premises whatsoever is prohibited. Section 2. — The use of electric current for the illumination of shop windows and external signs and advertisements is prohibited. ARTICLE III EXEMPTION FROM THE TERMS OF THIS ORDER Section I. — .Private and Communal generating plants not connected to the Gri d System exempted from the provisions of this Order. Section 2. -— Prohibition of the use of electrical current for lighting and other purposes during certain hours does not in any way preclude the use of other forms of illumination or energy supply. Section 3. — All premises which are provided with private generating sets are exempt from the provisions of this Order. ARTICLE IV MODIFICATIONS OF THE TERMS OF THIS ORDER IN RESPECT OF CERTAIN PREMISES Section 1. — Bakers and Chemists engaged in essential duties shall be exempt from the provisions of Article 1., Sect. 8. 270 Section 2. — For security purposes shops shall be permitted to maintain internal illuminations at the rate of 40 watts for each display window between the hours of 1730 and 0700. Section 3.1— Hospitals, and Doctors’ Consulting Rooms shall be exempt from the provisions of Article I., Section 8., and also from the provisions of Article II., Sect. 1. ARTICLE V POWER TO APPLY FOR EXEMPTION FROM TERMS OF ORDERS Section i. — Any establishment, institution, or private individual, may, in the interests of public health or security, be exempt, wholly or in part from the provisions of this Order, on written application, being made to the Area Commissioner. The decision of the Area Commisrioner on such applications shall be final. , ARTICLE VI PENALTIES Section I. — Any person violating the provisions of this Order shall be liable to immediate disconnection of the electricity supply to his premises or establishment for a period of one week, for the first offence, and a period of two weeks for the second and each subsequent offence. , Section 2. — Upon conviction by an Allied Military Court, any person violating any provision of this Order shall be liable to punishment by fine or imprisonment, or both, as the Court may determine. In addition, thereto, the Court may, on such conviction, order the forfeiture-of the electrical appliances used. Section 3. — Violations of the provisions of this Order shall be reported to the Supply Officer of the Allied Military Government, who shall order the discontinuance of the electrical supply and or report the violation to the Area Legal Officer for prosecution of the offender before the Allied Military Courts. ARTICLE VII POWER TO AMEND OR ALTER ORDER Section i. — The Area Commissioner shall have the power to make such alterations or amendments in this Order, as he may. from time to time, consider necessary in the interest of the Area.
