Army Director General, Civil Affairs CESSATION OF „CASSA INTEGRAZIONE SALARI PER I LAVORATORI DEL CREDITO, DELL’ ASSICURAZIONE E DEI SERVIZI TRIBUTARI APPALTATI“ WHEREAS it is deemed advisable and necessary to provide for the cessation of „Cassa Integrazione Salari per i Lavoratori del Credito, delVA ssicurazione e dei Servizi Tributari Appai-tati“ within the Zone of the Free Territory of Trieste administered by the British-TJnited States Forces, NOW, THEREFORE, I, RIDGELY GAITHER, Brigadier General, U. S. Army, Director General, Civil Affairs, ORDER: ARTICLE I With effect from 1 January 1945 the reimbursements due by „Cassa Integrazione Salari per i Lavoratori del Credito, dell’Assicurazione e dei Servizi Tributari Appaltati“, constituted by collective contract dated 21 April 1943 for indemnities and allowances provided for by collective bargaining, shall cease, without prejudice to the obligation of firms to pay out of their own funds to the workers entitled thereto the indemnities and allowances provided for by such contracts, in so far as they are due. ARTICLE II The contribution in terms of Article 7 of the collective contract dated 21 April 1943 shall continue to be paid by the firms who are subject to the said collective contract until such date as will be fixed by a further Order. ARTICLE III Applications for (a) payment of allowances („prestazioni“) due by the „Cassa Integrazione Salari per Lavoratori del Credito, dell’Assicurazione e dei Servizi Tributari Appaltati“ and relating to iperiods prior to 1 January 1945 ; (b) reimbursements to employers relating to periods prior to 1 January 1945 ; and (c) contributions due by employers relating to periods prior to 1 January 1945, must be made within the time limit of one month from the effective date of this Order. Applications lodged after the expiry of the time limit shall be null and void. ARTICLE IV Section 1. — Appeals may be lodged against the decisions of the „Istituto Nazionale della Previdenza Sociale“ concerning claims relating to the payment of allowances („prestazioni“) or contributions with the Allied Military Government, Department of Finance, within the period of 30 (lays from the communication thereof : the Department’s decision shall be final. Section 2. — The party concerned may, however, take action before the judicial authorities within 90 days from the communication of the Allied Military Government’s decisions. Army Director General, Civil Affairs Order No. 388 AMENDMENT TO ORDER No. 302 WHEREAS it is considered advisable and necessary to amend Order No. 302 dated 27 July 1948 which made provisions for a contingency allowance to workers employed in watching and cleaning services of town buildings within that Zone of the Free Territory of Trieste administered by the British-United States Forces, NOW, THEREFORE, I, RIDGELY GAITHER, Brigadier General, U. Army Director General, Civil Affairs ESTABLISHMENT OF AN ADVISORY COMMITTEE TO ADVISE ON MATTERS CONCERNING GRANTING OF AUTHORIZATION FOR TRANSPORT OF GOODS WHEREAS it is considered necessary to establish an Advisory Committee to advise on matters concerning the granting of authorizations for transport of goods on behalf of third persons by motor vehicles within that Zone of the Free Territory of Trieste administered by the British-United States Forces (hereinafter called the „Zone“), NOW, THEREFORE, I, RIDGELY GAITHER, Brigadier General, U. S. Army, Director General, Civil Affairs, ORDER: ARTICLE I ESTABLISHMENT OF AN ADVISORY COMMITTEE Section 1. — There is hereby established an Advisory Committee to advise on matters concerning the authorizations for the transport by motor vehicles of goods on behalf of third persons; The Advisory Committee shall have its seat at the „Ufficio Autotrasporti“ and shall be composed^ as follows : (a) The Director of „Centro Autotrasporti“. (b) A representative of the „Ispettorato della Motorizzazione Civile“ appointed by the Director of said „Ispettorato“. (c) A representative of the „Camera di Commercio, Industria e Agricoltura“ appointed by its President. (d) A representative of the „Associazione Industriali — Sezione Auto trasportatori“ appointed by the President of said „Associazione“. (e) A representative of the „Associazione Artigiani —- Sezione Auto trasportatori“ appointed by the President of said „Associazione“. Section 2. — There shall be a substitute for each member of the Committee appointed i*1 conformity with Section 1 hereof who shall substitute the member when necessary. Section 3. — Members of the Committee and their substitutes shall be paid an attendance bonus to be fixed by the Allied Military Government. Section 4. —- The „Centro Autotrasporti“ shall appoint a Secretary to the Advisory Committee. The Secretary shall be paid a special compensation for such work to be fixed by Allied Military Government. ARTICLE II TASKS OF THE ADVISORY COMMITTEE The Advisory Committee shall advise the Department of Transportation, Allied Military Government, on a) the maximum number of permanent authorizations to be granted by the Department of Transportation, Allied Military Government, for the transport by motor vehicles of goods on behalf of third persons ; b) appeals against decisions taken by the „Ispettorato della Motorizzazione Civile“ in matters relating to temporary authorizations for the transport by motor vehicles of goods on behalf of third persons ; c) any other relevant matter submitted to it by the Department of Transportation. Civil Affairs T)rder No. 395 GENERAL REVISION OF DRIVING LICENSES FOR DRIVERS OF MOTOR VEHICLES WHEREAS it is deemed advisable and necessary to order a general revision of driving licenses for drivers of motor vehicles in relation to Article 91 of the Consolidated Text of provisions for the protection of roads and for traffic, approved by R. D. 8 December 1933, No. 1740, within that Zone of the Free Territory of Trieste administered by the British-United States Forces (hereinafter referred to as the „Zone“), NOW, THEREFORE, I, RIEGELY GAITHER, Brigadier General, U. S. Army-Director General. Civil Affairs, ORDER: ARTICLE I GENERAL REVISION OF THE DRIVING LICENSES FOR DRIVERS OF MOTOR VEHICLES A general revision of driving licenses of any grade or type issued by the competent Authorities of the Zone prior to 1 January 1946 for drivers of motor vehicles is hereby ordered. ARTICLE II PROCEDURE OF REVISION The following documents shall be produced by holders of driving licences to the „TJfficio Registrazione Autoveicoli“ who on being satisfied that they are in order shall then endorse on the licenses a certificate to the effect that such licenses have been revised: (a) for licenses of the 1st grade and motor-vans (motocarri): (1) certificate of good conduct or penal certificate, or passport, or license for carrying arms, or valid postal identity card, or certificate of recent date showing that the holder is in the service of a public administration ; (2) medical certificate issued within the period of three months prior to the date of application by the „Ispettorato Sanitario delle Ferrovie dello Stato“ or by the „ufficiale sanitario“ of the Commune of residence, in accordance with Article 91 of the Consolidated Text of the provisions for the protection of roads and for traffic ; (3) qualification certificate „certificato di idoneità“ issued by the „Ispettorato Comparti-mentale della Motorizzazione Civile e dei Trasporti“ of Trieste, after submission of the appropriate application with the documents specified in paragraphs (1) and (2) above ; (4) certificate of residence. (b) For licenses of the 2nd grade: (1) general certificate of the Penal Records Office issued within the period of three months prior to the date of application. (2) medical certificate of a date not earlier than three months, prior to the date of application, issued in accordance with the provisions of Article 91 of the Consolidated Text of the provisions for the protection of roads and for traffic by the Authorities indicated in (a) (2) of this Article ; (3) qualification certificate „certificato di idoneità“ issued by the „Ispettorato Comparti-mentale“ after submission of the documents specified in (b) (1) and (2) of this Article ; (4) certificate of residence. (c) For licenses of the 3rd grade: (1) general certificate of the Penal Records Office of a date not earlier than one month prior to the date of application. (2) medical certificate of a date not earlier than three months, prior to the date of application, issued in accordance with the provisions of Article 91 of the Consolidated Text of the provisions for the protection of roads and for traffic by the Authorities indicated in (a) (2) of this Article; (3) qualification certificate „certificato di idoneità“ issued by the „Ispettorato Comparti-mentale della Motorizzazione Civile e dei Trasporti“ of Trieste, after submission of an appropriate application with documents specified in (c) (1) and (2) of this Article; (4) certificate of residence. ARTICLE III RENEWAL OF DRIVING LICENSES Deteriorated, incomplete driving licenses or those on which the photos are out of date, shall not be considered valid and the parties concerned shall apply for a duplicate license by producing the documents as required for revision. TIME - LIMIT FOR REVISION Holders of driving licenses subject to revision in terms of Article I of this Order shall submit applications to the „Ispettorato Compartimentale della Motorizzazione Civile e dei Trasporti“ of Trieste for technical tests (accertamenti tecnici) during the period from 1 January to 30 April 1949. Thereafter the „Ispettorato“ shall in conjunction with the applicant fix the date for the tests. Applicants who for justified reasons are unable to present themselves within the said period must regularize their position by 30 June 1949. ARTICLE V VALIDITY OF DRIVING LICENSES After 30 June 1949 driving licenses issued prior 1 January 1946 will be considered null and-void unless endorsed with the certificate provided for in Article II. ARTICLE VI PENALTIES Any person subject to the conditions of this Order driving a motor vehicle after 30 June 1949, without having complied with the provisions of this Order, shall be liable to the penalties provided for by Article 94 (10) of the said Consolidated Text of the provisions for the protection of roads and for traffic. ARTICLE VII EFFECTIVE DATE This Order shall come into force on the date of its publication in the Official Gazette and shall become effective as from 1 January 1949. Army Director General, Civil Affairs I ORGANIZATION OF ALLIED MILITARY GOVERNMENT (Amendment to Order 308 dated 26 July 1948) WHEREAS it is deemed necessary to re-adjust the organization of Allied Military Government as established by Order No. 308 dated 26 July 1948 in the British-United. States Zone (hereinafter referred to as the „Zone“) of the Free Territory of Trieste, NOW, THEREFORE, I, RIDGELY GAITHER, Brigadier General, U. S. Army, Director General, Civil Affairs, ORDER: ARTICLE I Article V of Order No. 308 dated 26 July 1948 is hereby substituted by the following new Article V : „ARTICLE V „DIRECTORATE OF FINANCE AND ECONOMICS / „Section 1. — The Chief Officer of the Directorate of Finance and Economics shall be Director of Finance and Economics and is charged with the supervision, direction and control of all matters affecting the economic development of the Zone, governmental finance and all technical agencies which are directly responsible to the central government. He shall also have and exercise all of the powers, duties and functions of a Minister of Finance under the laws applicable within the Zone. He shall be directly responsible to the Director General. The Deputy Chief Officer of the Directorate of Finance and Economics shall be Deputy Director of Finance and Economics. Section 2. — The Departments assigned to and constituting the Directorate of Finance and Economics are as follows : (a) Department of Finance (b) Department of Production (c) Department of Commerce (d) Department of Public Services (e) Department of Transportation (f) Dèpartment of Port Authority (heretofore designated Port Directorate) Section 3. — The Chief Officer of the Department of Finance shall be Chief, Department of Finance. In addition to such powers, duties and functions as shall be granted by the Director of Finance and Economics with the advice and consent of the Director General, the Chief, Department of Finance shall have and exercise the powers, duties and functions of a Minister of the Treasury under the laws applicable within the Zone. Section 4. — The Chief Officer of the Department of Production shall be Chief, Department of Production. He shall have and exercise such powers, duties and functions as shall be granted by the Director of Finance and Economics with the advice and consent of the Director General. Section 5. — The Chief Officer of the Department of Commerce shall be Chief, Department of Commerce. He shell have and exercise such powers, duties and functions as shall be granted by the Director of Finance and Economics with the advice and consent of the Director General. Section 6. — The Chief Officer of the’Department of Pub'bc Services shall be Chief, Department of Public Services. He shell have and exercise such povers, duties and functions as shall be granted by the Director of Finance end Economics with ti e advice and consent of the Director General. He shall also have and exercise all the powers, duties and functions of (a) a Minister of Public Works, and (b) a Minister of Posts and Telegraphs under the laws applicable within the Zone. Section 7. — The Chief Officer of the Department of Transportation shall be Chief, Department of Transportation. In addition to such powers, duties and functions as shall be granted by the Director of Finance and Economics with the advice and consent, of the Director General, he shall have and exercise all the powers, duties and functions of a Minister of Transport under the laws'applicable within the Zone. Section 8. -— The Chief Officer of the Department of Port Authority shall be Director of the Port. In addition to such powers, duties and functions as shall be granted by the Director of Finance and Economics with the advice and consent of the Director General, the Director of the Port shall exercise the powders, duties and functions of a Director of the Free Port under the applicable provisions of Annex VITI to the Peace Treaty with Italy. ARTICLE II CONSOLIDATION OF DEPARTMENTS Section 1. — With effect from the date of this Order the Department of Public Works and Posts and Telecomunications shall cease to exist as separate Departments and will be consolidated with and be an office of the Department of Public Services. Section 2. — With effect from the date of this Order the Department of Industry shall cease to exist as a separate Department and will be consolidated with and be an office of the Department of Production. Army, Director General, Civil Affairs, ORDER: ARTICLE I With effect from the first pay period subsequent to 30 September 1948, the contributions for family allowances referred to in Orders No. 325 dated 5 March 1947, and No. 207 dated 21 May 1948 are modified as follows : 15% for the Industrial Sector (Table A - l) ; 11% for the Agriculture Sector restricted to clerks (Table B) ; 10% for the Commercial Sector (Table C) ; 7.90% for the Credit Sector (Table D) ; 12.90% for the Insurance Sector (Table E) ; 8.50% for the Tax Collecting Agencies Sector (Table F) ; 10% for the Professions and Arts Sector (Table G) ; 9.40% for the Artisan Firm Sector (Table H). Army Director General, Civil Affairs Order No. 378 DETERMINATION OF THE RATE OF INTEGRATIVE CONTRIBUTIONS DUE FOR SOCIAL INSURANCE FOR THE YEAR 1948 WHEREAS it is deemed advisable and necessary to determine the rate of integrative contributions due for social insurance for the year 1948 in that Zone of the Free Territory of Trieste administered by the British-United States Forces. Army, Director General, Civil Affairs, ARTICLE I The integrative contributions for social insurance due for the year 1948 are fixed as follows : . a) F rom 1 January 1948 to the beginning of the pay period subsequent to 30 September 1948 at the percentages established for the year 1947 by Order No. 416 dated 24 July 1947 ; b) Prom beginning of the pay period subsequent to 30 September 1948 at the following percentages of wages computed in accordance with the provisions established by General Order No. 47 dated 20 March 1946 and within the limits established by Order No. 371 dated 3 December 1948: (1) 1.97% for workers subject to compulsory insurance for invalidity, old age and survivors ; (2) 0.56% for workers subject to compulsory insurance under the Fund for the personnel of the Public Telephone services ; (3) 0.46% for workers subject to compulsory insurance under the Fund for the personnel of the Consumer tax administration ; (4) 0.64% for workers subject to compulsory insurance under the Fund for the personnel of the Direct Tax Collecting and Receiving Agencies ; (5) 3.74% for workers subject to compulsory insurance against involuntary unemployment ; (6) 2.47% for workers subject to compulsory insurance against tuberculosis. Army Director General, Civil Affairs Order No. 379 CONTRIBUTION DUE BY EMPLOYERS TO „CASSA PER IL TRATTAMENTO DI RICHIAMO ALLE ARMI DEGLI IMPIEGATI PRIVATI“ WHEREAS by Order No. 371 dated 3 December 1948 provisions were made for the increase of the maximum limit of wages for the purpose of computing the contributions for family allowances, which limit is applicable for computing the contribution due to „Cassa per il Trattamento di Richiamo alla^Armi degli Impiegati Privati“ in terms of Order No. 130 dated 15 May 1946, and WHEREAS it is necessary to modify the rate of contribution due to „Gassa per il Trattamento di Richiamo alle Armi degli Impiegati Privati“ in that Zone of the Free Territory of Trieste administered by the British-United States Forces, NOW, THEREFORE, I, RIDGELY GAITHER, Brigadier General, U. S. Army, Director General, Civil Affairs, ARTICLE I Section 1. — With effect from the beginning of the first pay period subsequent, to 30 September 1948, the contribution due to „Casgp per il Trattamento di Richiamo alie Armi degli Impiegati Privati“ by the employers of Agricultural, Commercial, Credit and Insurance concerns and of the Professions and Arts, is hereby fixed at the rate of 0.80% of the gross wages paid to employees qualified as clerks (impiegati) in terms of the laws in force, or to those who are granted, pursuant to collective working contract or equivalent provisions or internal regulations, equal or higher treatment than that fixed by law where employers are called into the Army. $ Section 2. — Cooperative Bodies, though constituted de facto, are also liable for the same contribution for wages paid to depending workers with the qualification or treatment referred to in the preceding Section, including the partners with similar qualification or treatment, who perform duties which are compensated by the Bodies concerned. Army Director General; Civil Affairs Order No. 381 INCREASE OF AVERAGE WAGES IN RESPECT OF PARTICULAR CATEGORIES OF WORKERS FOR THE PURPOSE OF COMPUTING THE PAYMENT OF CONTRIBUTIONS FOR FAMILY ALLOWANCES AND SOCIAL INSURANCES AND DETERMINATION OF THEIR MINIMUM LIMIT WHEREAS by the provisions of Order No. 371 dated 3 December 1948, it is necessary to adjust, in conjunction with the new maximum limit of wages subject to contribution, the limit of average wages established for the contributions for family allowances and other social insurance benefits and to fix the minimum limit of such wages in that Zone of'the Free Territory of Trieste administered by the British-United States Forces, NOW, THEREFORE, I, RIDGELY GAITHER, Brigadier General, U. Army Director General, Civil Affairs, ORDER: ARTICLE I The average wages established for specified categories of workers for the purpose of computing the payment of contributions for family allowances and for social insurances are increased by 175%. The mimum limit of average wages referred to in the previous Article is established at Lire 375 daily. ARTICLE III This Order shall be in force on the date of its publication in the Official Gazette of the Allied Military Government and shall become effective from the beginning of the first pay period subsequent to 30 September 1948. Army Director General, Civil Affairs Order No. 397 AMENDMENT TO THE CODE FOR ROAD TRAFFIC („CODICE DELLA STRADA“) — DRIVING LICENSES FOR DRIVERS OF MOTORCYCLES WHEREAS it is considered necessary and, urgent, in the interest of public safety, to extend the compulsory possession of driving licenses to drivers of motorcycles registered within the Zone of the Free Territory of Trieste administered by the British- United States Forces ; NOW, THEREFORE, I, RIDGELY GAITHER, Brigadier General, U. S. Army, Director General, Civil Affairs, ORDER: ARTICLE I The first para of Article 69 of R. D. 8 December 1933 No. 1740 (hereinafter referred to as the „Code for Road Traffic“) is hereby repealed and substituted by the following : „For the circulation of motor vehicles contemplated under letter (b) of Article 54, the „„Ispettorato per la Motorizzazione Civile“ shall issue an authorization for circulation in which „there shall be indicated the data of identification necessary for fiscal purposes. No other doc-„ument shall be required for the said motor vehicles.“ ARTICLE II No. 1, paragraph 5 of Article 54 of the Code for Road Traffic, is hereby repealed. Therefore motor vehicles mentioned under letter (b), of Article 54 of the Code for Road Traffic, i. e., motorcycles, motorcycles with sidecars and three-wheelers, shall be subject to the provisions of Title III of the said Code for Road Traffic. After Article 85 of the Code for Road Traffic there shall be inserted the following Article 85 bis : „85 bis. — Qualification certificate for the driving licenses for motorcycles. — Any person „desiring to obtain a qualification certificate for a driving license for motorcycles, motorcycles „with sidecars and three-wheelers shall undergo an examination and make application therefor „to the „Ispettorato per la Motorizzazione Civile“ of Trieste. The application shall be submitted „together with the documents indicated in Article 83. „The qualification certificate shall not be issued to persons under 16 years of age. „Those persons coming under the cases of dishonour provided for by Article 84 shall „not be admitted to the examination for qualification.“ ARTICLE IV After Article 86 of the Code for Road Traffic there shall be inserted the following Article 86 bis : „86 bis. — Qualification examination for driving licenses for motorcycles. — The qualification examination for driving licenses for motorcycles, motorcycles with sidecars and three-„ wheelers shall consist of the practical driving test only in accordance with para 7 of Article 86. „Candidates must also prove that they are acquainted with road signals and with the principal traffic regulations.“ ARTICLE V After Article 88 of the Code for Road Traffic there shall be inserted the following Article 88 bis : „88 bis. — Issuance of the driving licenses for motorcycles. — After having obtained „the qualification certificate mentioned in Article 85 bis, the applicant shall produce it at the „„Ufficio Registrazione Autoveicoli“ together with the certificate of residence in the Free Ter-..ritory of Trieste, British-United States Zone, and with the documents indicated in Article 83. „The said Office, upon recognizing the validity of said documents, shall issue the driving license „and inscribe the qualified drivers in an appropriate register.“ ARTICLE VI After Article 90 of the Code of Road Traffic there shall be inserted the following Article 90 bis: „90 bis. — Authorization to apprentice drivers for the driving of motorcycles. — Persons „who have submitted an application for the examination to qualifify as driver of motorcycles „shall be allowed to practice in places not much frequented and under the care of a licensed „driver.“ ARTICLE VII After Article 95 of the Code for Road Traffic there shall be inserted the following Article 95 bis: „95 bis. — Withdrawal of driving licenses for motorcycles. — Driving licenses for motorcycles may be withdrawn in the cases provided for by Article 94.“ In the text of the first paragraph, Article 96, of the Code for Road Traffic, after the words „the driving license of first or of second grade“ there shall be inserted the words .,or the driving license for motorcycles“ ; after the words „in Article 90“ there shall be inserted the words „or in Article 90 bis.“ ARTICLE IX After Article 108 of the Code for Road Traffic there shall be inserted the following Article 108 bis : „108 bis. •— Indemnity. — Article 108 is hereby made applicable to motorcycles, motorcycles with sidecars and three-wheelers.“ ARTICLE X This Order shall come into force on the date of its publication in the Official Gazette and shall have effect as from 1 April 1949. The approval of the „Ispettorato per la Motorizzazione Civile“ will only be given on production of a valid policy of indemnification-insurances as provided for by Article 29 of the Law 28 September 1939, No. 1822.
