Trieste - 1946 Allied Military G o vernmen£ VENEZIA GIULIA Order No. 244 CHARGES FOR WAGGONS AND IRREGULAR FORWARDING WHEREAS it is deemed, advisable to reduce the amount of charges and surcharges to be paid for reservations and use of railway cars and for the irregular forwarding of merchandise in that part of Veneria Giulia administered by the Allied Forces (hereinafter referred to as the „ Territory“) NOW, THEREFORE, T, ALFRED C. Affairs Officer, ORDER: ARTICLE I Section 1. — Paragraph (b) of Section 15 of Appendix No. I to „Conditions and Taiiffs for the transportation of merchandise on the State Railways“ shall be repealed and in lieu thereof said sub-paragraph shall read as follows : ,,(b) for any other transport: L. 500 per waggon“ Section. 2. — Paragraph 15 bis of aforementioned appendix No. 1 shall be repealed and in lieu thereof said sub-paragraph shall road as follows : „(15 bis) Sum to be deposited for requests Of accelerating transportation by railway waggons or tne like : L. 250 per waggon“. ARTICLE II Where a shipment of merchandise which is to be or has been forwarded or: State Railways appears to be in whole or part commodities other than those specified, in the loading-request filed by the sender under Article 31, Paragraph 1 of „Conditions and Tariffs“, the Railway Administration is authorized to collect a surcharge of twice, the transportation rate with a minimum of L. 2500, this surcharge to be in addition to any other penalties provided by any other law or regulation. ARTICLE III Where, by making an irregular de laration, any one forwards as luggage or in small lots by fast or slow train any merchandise which at the time is restricted by Article i, paragraph 10, of Decree No. 2138 of the Minister of Communication, dated 7 January 1941, the Railway Administration may collect a surcharge of double the transportation rate with minimum of L. 125, this surcharge to be in addition to any other penalties provided by law or regulation. ARTICLE IV The provisions of Article . 51, paragraph 1, of „Conditions and Tariffs“ for the transportation of merchandise on the State Railways shall be applicable to the surcharges aforementioned in this Order. ARTICLE V Article 3 of Minister of Communication’s Decree dated 2 June 1942, No. 3854, is hereby repealed. ARTICLE VI This Order shall become-effective within-the Territory on the date of its publication . in the Allied Military Government Gazette. TRIESTE, 23rd December 1946. ALFRED C. Senior Civil Affair* Officer 329 Order No. 271 LEVY ON INCREASED VALUE OF ASSETS REVALUED IN ACCORDANCE WITH GENERAL ORDER No. 33 WHEREAS it is denied necessary to apply a levy of 25% on the increased value of assets revalued in accordance with General Order No. 86 in those parts of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the ..Territory“), NOW, THEREFORE, I, ALFRED O. BOWMAN, Colonel J.A.G.D. Senior Civil Affairs Officer ORDER; ARTICLE I The last para of art. 1 of R. IX 5 October 1930, No. 1744, converted into the Law 14 January 1937. No. 91, is hereby repealed. ARTICLE 2 Increases in the value of assets revalued in accordance with General Order No. 86, if transferred to capital shall be subject to a levy of 25%. The provisions of this article shall not apply to increases in value of assets revalued in terms of the provisions of R. IX 5 October 1930, No. 1745 converted into the Law 4 January 1937, No. 40. ARTICLE 3 Increases in value of assets revalued in accordance with General Order No. 80, if transferred to the reserve fund, shall not be considered as part of the reserve funds to which the provisions of art. 1 of R. I). L. 5 October 1936, No. 1744, converted into the Law 14 January 1937, No. 91, and of art. 29 of R. D. L. 19 October 1937, No. 1729, converted into the Law 13 January 1938, No. 19, apply, unless a levy of 15% has been paid thereon by the company. If at any time the above increases, which were transferred to reserve funds are re-trans -ferred to capital, they shall be liable to a levy of 10%, in addition to the 15% already levied in accordance with the foregoing para. ARTICLE 4 The payment of the levy shall be made to the Treasury by the Company, (which may recover thg relative amount from its share-holders) within 60 days of the date on which the transfer to the capital was decided. In case of failure in the observance of the above time-limit, the levy plus a 10% fine shall be collected from the Company in a single instalment through direct tax rolls and under the usual direct taxes procedure, but without obligation on the part of the tax-collector to pay non-collected sums. ARTICLE 5 The Companies concerned may- within 60 days settle their debt with the financial Administration by the transfer of shares for the corresponding face value. If the shares are not transferred within the above time-limit cf 60 days, the Company shall lose its right to settle the debt as provided for by the first para of this Article, and the amount due shall be collected in cash in accordance with art. 4. Companies may redeem the shares in question at their face value, plus 5% interest '-per annum, within one year from the established time-limit of 60 days. The shares shall be issued in the name of the Intendente di Finanza. 330 ARTICLE 6 The provisions of this Order shall apply to any transfer to capital of increases in stock effected after 30 August 1946. Companies which have decided on a revalutation prior to the effective date of this Order may cancel their decision within the month following that in which the Order comes into force. In this case they shall be entitled to refund of any fiscal charge in connection with their decision and to exemption from any charge for its subsequent cancellation. ARTICLE 7 The same rules as established for the settlement of disputes in connection with income .tax shall be applied in the case of disputes arising from the application of this Order. Senior Civil Affairs Officer- Order No. 279 COST OF LIVING BONUS TO PERSONS ENTITLED TO WORKMEN’S COMPENSATION ANNUITIES FROM EX AUSTRO-HUNGARIAN INSTITUTES . WHEREAS, it is deemed advisable and necessary to extend the Temporary Bonus as provided for in Part B of General Order No. 17 dated 13 October 1945 in favour of persons entitled to Annuities under occupational accident and occupational sickness insurance based on R.D.L. 17 August 1935, No. 1765, to those entitled to the Workmen's Compensation annuities derived from ex Austro-Hungarian Institutes in that part of Venezia Giulia administered by the Allied Forces, ■ NOW, THEREFORE, I, ALFRED C. Affaire Officer, ORDER: ARTICLE I GRANT OF TEMPORARY BONUS As and from the 1st July 1946, and until further notice, the temporary bonus provided for in Articles IX, X and XI of General Order No. 17 dated 13 October 1945 (Part B) shall be payable also to persons entitled to workmen’s compensation annuities (rendite di infortunio) for permanent disability of frc.m fifty to one hundred per cent (50-100%), as well as to those deriving title from workers deceased in consequence of labour accidents as referred to in Articles 1 and 3 of R. D. L. 24 September 1941. No. 1555. ARTICLE II AGENCY RESPONSIBLE FOR PAYMENT Istituto Nazionale per gli Infortuni sul Lavoro which has been entrusted with the assessment and payment of workmen’s compensation annuities in terms of R. D. L. 24 September 1931. Senior Civil Affairs Officer 332 Order No. 283 FACULTY OF SCIENCE OF THE UNIVERSITY OF TRIESTE WHEREAS it has been decided by the Academic Senate of the University of Trieste that it is advisable to make certain alterations to the provisions set forth in Order No. 177 concerning the Faculty of Science of the University and WHEREAS upon study and consideration Allied Military Government has recognized the expediency of such action, NOW, THEREFORE, I, ALFRED C. BOWMAN, Colonel ,J.A.G.D„ Senior Civil Affairs Officer, ORDER: 1. — As from the effective date of this Order the Faculty of Science, instituted in the University of Trieste by Order No. 177, shall adopt the designation: „Faculty of Mathematical, Physical, and Natural Sciences“. 2. — In addition to the degree courses in Mathematics, Mathematics and Physics, Physics, and the two preparatory years of Engineering, there shall be instituted as from the effective date of this Order a two year’s course of studies preliminary to the degree course in chemistry. 3. — During the Academic year 1946-1947 only the first year of the course of preliminary studies to the degree course in chemistry shall be open. 4. — The institution of the two year’s course shall not effect the number of permanent (di ruolo) posts provided for the Faculty of Science. ■r. — Allied Military Government Venezia Giulia, shall recognize said two year’s course and all certificates and diplomas granted for the completeness of such course. 6. —- The internal organization of the said course shall be subject to the same rules and regulations now in force for the other University courses. 7. — This Order shall become effective upon the date it is signed by me. Senior Civil Affairs Officer Order No. 294 EXTENSION OF TIME LIMITS ON PROPERTY EVALUATION FACILITY AND INDIRECT TAXES AND DUTIES ON BUSINESS TRANSACTIONS WHEREAS, it is deemed advisable to extend certain time limits in those parts of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the „Territory") NOW, THEREFORE, l, ALFRED C. BOWMAN, Colonel, J.A.G.D., Senior Civil Affairs Officer, ORDER: ARTICLE I EXTENSION OF TIME LIMIT ON PROPERTY EVALUATION FACILITY The special facility granted in Article 21, para 1 of General Order No. 39, is hereby extended to 31 May ,947 and shall be applicable to unsettled disputes on the valuation of property transferred by an inheritance, or by a public deed or private contract registered prior to ,:.5 April 1946. 333 ARTICLE II EXTENSION OP TIME LIMIT ON INDIRECT TAXES AND DUTIES ON BUSINESS TRANSACTIONS The expiry date concerning indirect taxes and duties on business transactions, which was postponed to 31 December 1946 by Article 1 of Order No. 213, is hereby extended to 31 December 1947. Senior Civil Affairs Officer Order No. 295 APPROVAL OF A PROVISIONAL BY-LAW OF THE „COOPERATIVE OPERAIE DI TRIESTE, ISTRIA E FRIULI“ WHEREAS by R. D. 24 October 1933 Ho. 1906 the „Cooperative Operaie di Trieste, Istria e Friuli“, with Head-office in Trieste (hereinafter referred to as „Cooperative Operaie“), has been legally recognized as „ente morale“ and whereas, on the basis of such decree, a by-law contrary to democratic principles was imposed on it : WHEREAS it is considered advisable to-repeal the above mentioned R. D. as well as Ministerial Decree 31 January 1940, by which the by-law in force at present was approved, and to re-establish provisionally the last pre-fascist by-law of the above institution, in order that, according to the latter, the officials be democratically elected to their offices ; within that part of Venezia Oiulia administered by the Allied Forces (hereinafter referred to as the „Territory“), NOW, THEREFORE, I, ALFRED C. BOWMAN, Colonel J.A.O.D., Senior Civil Af-fairs Officer ORDER ARTICLE I REPEAL OF CERTAIN PROVISIONS OF LAW R. D. 24 October 1935, No. 1906, by virtue of which the „Cooperative Operaie“ was legally recognized as „ente morale“, and Ministerial Decree 31 January 1940, approving the by-law of the said institution in force at present, are hereby repealed. ARTICLE II PROVISIONAL BY-LAW OF „COOPERATIVE The last pre-fascist by-law of the „Cooperative Operaie“, decided upon by the ordinary Meeting on 2 and 3 July 1922, shall be considered as re-established hereby as from the effective date of this Order and up to the time when it will be amended or substituted in accordance with the procedure provided for therein. 334. ARTICLE III CESSATION OF SUPERVISORY COMMITTEE As from the effective date of this Order, the Supervisory Committee appointed by Area Order No. 2, Trieste Area, shall limit its functions exclusively to the supervision of the activities of the „Cooperative Operaie“, and shall cease such functions as soon as the society’s offices will be covered through a regular election to be carried out in accordance with the provisions set forth by the by-law. Senior Civil Affairs Officer Order No. 296 RULES RELATING TO THE PRACTICE OF THE MEDICAL PROFESSIONS WHEREAS it is considered necessary and advisable to provide for rules relating to the practice of medical professions in those parts of Venezia Giulia administered by the Allied Forces (and hereinafter referred to as the '„Territory“'), NOW, THEREFORE, I, ALFRED O. BOWMAN, Colonel. J.A.G.D., Senior Civil Affairs Officer, ORDER: ARTICLE I DUTIES AND POWERS OF THE COUNCILS FOR THE ORDERS OF MEDICAL PROFESSIONS The Councils for the Orders of physicians and surgeons, of veterinarians and of pharmacists and for the Colleges of midwives established by General Order No. 20, shall have the following duties and powers : a) To set up and to keep the Roll of the Order or of the College and to publish it at the beginning of every year ; b) To pay attention to the preservation of the dignity and independence of the Order or of the College ; c) To designate the representatives of the Order or of the College to provincial or communal commissions, bodies and organizations ; d) To promote and to further all suggestions intended to favor the cultural progress of the membors ; e) To contribute to the studies and the activity of local authorities relating to measures generally concerning the Order or the Collego ; f) To exercise their disciplinary powers against the medical professionists inscribed in the Rolls subject, however, to other disciplinary and penal provisions of the existing laws and regulations ; g) To mediate, whenever requested, in the disputes between two medical professionals or between a medical professional and a person or body for whom the medical professional has performed or is performing his professional work, as regards expenses, fees or other questions connected with professional practice, providing for the conciliation of the dispute and, whenever an agreement has not been reached, giving their opinion on the disputes. 335 ARTICLE II AI PEALS AGAINST DECISIONS OF COUNCILS I 1) An appeal may be filed with the General Assembly of members at a general meeting against a decision of the Council in matters set forth in Article III of General Order No. 20. 2) An appeal may be filed with the Central Commission established by Genera] Order No. 20 against decisions in matters set forth in paragraph a and / of Article I of this Order. ARTICLE III ROLLS OF PROFESSIONS Section 1. — Each Order or College shall keep a permanent Roll on which all professionista of the relative category residing in the district, shall be inscribed. Section 2. — A list of dentists temporarily authorized to practice their profession according to the existing, temporary provisions, shall be attached to. the Rolls of Physicians and Surgeons. ARTICLE IV OBLIGATORY INSCRIPTION ON THE ROLLS The inscription on the relative Roll is nelossary for the practice of any of the medical professions. ARTICLE V REQUIREMENTS FOR THE INSCRIPTION ON THE ROLLS Section 1. — The following is required for the inscription on the Roll : 1) Italian citizenship ; 2) Full enjoyment of civil -rights ; 3) Proof of good conduct ; 4) Attaimnent of an academi, title granted or confirmed by an university or other authorized institute of higher education and the qualification for professional practice, and for the profession of midwives, the attainment of the degree issued by the appropriate schools ; 5) Residence within the district of the Order or College. Section 2. — Foreigners may likewise be inscribed on the Rolls provided that they have attained their legal title of qualification in Italy or other country, provided they are citizens or subjects of a state with whom the Italian Government has stipulated, on the base of reciprocity, a special agreement authorizing them to practice their profession in Italy provided they submit proof of good conduct and of full enjoyment of civil rights. ARTICLE VI POSITION OF MEDICAL PROFESSIONALS EMPLOYED BY A PUBLIC ADMINISTRATION Medical piofessionals employed by a Public Administration who, according to Regu* lations applying to them, are not prohibited to exercise their profession, may be inscribed on the Roll. They shall be subject to the rules of the Order or College as regards the practice of their profession. 336 ARTICLE VII REMOVAL FROM THE ROLLS Section 1. — Removal from the Roll of a member shall be ordered by the Council, in its official capacity or on request of the Area President or of the Public Prosecutor, in the case of a) Loss, to whatever reason due, of the Italiaii citizenship or of the full enjoyment of civil rights ; b) Transfer of the member’s residence to another country; c) Transfer of the member’s residence to another district ; d) Resignation from inscription ; ' e) ~ Cessation of the agreement set forth in para 2 of Article V of this Order ; f) Delay of payment of contributions set forth in Article III of General Order No. 20. Section 2. — The removal, except the cases under d) and e), can not be ordered unless the person concerned has been heard. ARTICLE VIII VALIDITY OF EXISTING PROVISIONS The provisions of General Order No. 20 as amended by General Order No. 75 shall re-• main in full force inasmuch as they are not inconsistent with this Order. Area Order n. 120 of the 14th November 1946, NOW THEREFORE, I, FRED 0. MAVIS, Lt, Gol. Inf., Area Commissioner for Go-rizia Area, hereby ORDER: ARTICLE I. Section I of Area Order n. 120 is hereby cancelled and substituted as follows : SECTION la). — The consumption of electricity by domestic users for lighting and domestic appliances shall be limited to 180 KW per month for a family of four persons or less. For each person in excess of four, the allowance shall be increased by 30 K. W. per month the maximum being 300 K. W. per month. SECTION 16/ — In cases where, a house, apartment or other living accomodation provided with only one electricity meter has been structurally adapted for habitation by more than one family and the only common use is in respect of the entrance hall and stairway, then the allowance for each such family shall be as provided for in Section 1 a). SECTION 1 c). — In cases where two or more families live in the same house, apartment or other premises, which have not been adapted for separate habitation, and the occupants share in common the kitchen, bathroom, lavatory or living rooms and the electricity is supplied through one meter, the allowance of electricity shall be 75% of the allowanced set out in Section 1 a) for each additional family living therein, namely 135 K. W. per month for each additional family of four persons or less, plus 25 K. W. per month for each person in excess of four up to a maximum of 225 K. W. per month. ARTICLE II All other provisions of Area Order n. 120, remain in full force and effect and the penalties referred to therein shall be applicable to this Order as if they had been specified herein.
