Trieste - 1947 Allied Milif ary Government VENEZIA GIULIA Order No. 438 INDEMNITY FOR INCREASED PRICE OF BREAD TO ASSISTED PERSONS WHEREAS it si considered advisable and necessary to grant an indemnity for the increased-price of bread to persons assisted by the State and by welfare Institutions, within that part of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the „Territory"'), NOW, THEREFORE, I, JAMES J. CARNES, Colonel Infantry, Senior Civil Affairs Officer, hereby i ORDER: ARTICLE I GRANTING OF INDEMNITY FOR INCREASED PRICE OF BREAD TO PERSONS ASSISTED BY THE STATE AND BY WELFARE INSTITUTIONS Section 1. — An indemnity for the increased price of bread at the rate of 300 Lire monthly, to be borne by the Allied Military Government, is hereby granted with effect as from 11 June 1947 in favour of persons belonging to the follow1ng categories: a) Persons inscribed in the lists of the poor, and continuously assisted by the „Enti Comunali di Assistenza“ out of their funds. b) Persons receiving daily allowances borne by the State, according to the existing provisions, in possession of the following qualification : (aa) relatives (wife, children and parents, brothers and sisters in so far as disabled and supported) of military personnel, prisoners of war interned or dispersed (provided that no war pensions or allowances are being, paid) ; (bb) relatives of civilians deported, interned or dispersed, (provided that no war pensions or allowances are being paid) ; (cc) refugees („profughi“), displaced persons („sfollati“) or distressed persons (,,si-nistrati“) as a consequence of war; (dd) repatriates from Italian Africa or from-e broad, and relatives of citizens residing in Italian Africa or abroad. c) Combatant partisans ; soldiers discharged after 1st January 1945 ; soldiers returned from war prison ; civilians deported by the enemy beyond the boundery after 8 September 1943. Section 2. — Those soldiers discharged after 1st January 1945 or returned from war prison who have adhered the so-called Italian social republic or have collaborated with-the enemy shall be excluded from such benefit. Section 3. — Fos the granting of the indemnity for increased price of bread as mentioned in the Article I, Section 1 (c), the following conditions must concur: A.M. G. Gazette - Voi. II, No. 27-11 September 1947 837 a) that the repatriate or partisan be unemployed involuntarily for lack of work ; b) that the repatriate or partisan live in conditions of ascertained need. ARTICLE II PAYMENT OF THE INDEMNITY Section 1. — a) The above indemnity shall be paid for each titular and for each family member living together with and supported by him. and shall be given only to those provided with the personal ration-card for bread and „pasta“. b) Persons entitled to the indemnity on the basis of more than one qualification shall receive only 9 single indemnity. ^ c) In case any of the family member is entitled to the indemnity on the ground of a qualification of his own. the head of family shall not be entitled to receive the quota for such member. Section" 2. — In particular cases, the Chief Welfare Officer in conjunction with the Chief Finance Officer may order that the indemnity provided for by the preceding Articles be paid to the Institutions assisting the persons entitled thereto and not directly to such persons. ARTICLE III EFFECTIVE DATE This Order shall take effect on the .date it is signed by me. Dated at Trieste, this 3rd day of September 1947. JAMES J. CARNES Colonel, Infantry Senior Civil Affairs Officer Order No. 448 PROVISIONS RELATING TO CIVIL MARRIAGES AND REGISTRATION OF RELIGIOUS MARRIAGES WHEREAS it is considered advisable and necessary to make provisions facilitating the celebration of civil marriages and the registration of religious marriages within that part of Venezia Giulia administered by the Allied Forces (hereinafter called the „Territory“) ; NO IT, THEREFORE, I, JAMES J. CARNES. Colonel Infantry, Senior Civil Affairs Officer, ORDER: ARTICLE I DISPENSATION FROM PUBLICATION OF MARRIAGE Section 1. — Whenever it is impossibile, for reasons arising from the state of war, to comply with the provisions set forth in Articles 93, 94 and 97, of the Civil Code, dispensation from the publication of marriage upon the sole presentation of the public declaration („atto di notorietà“) mentioned in Article 100, paia 2 of the Civil Code, may be granted. 838 A.M. Gazette - Vol. II, No. 27 - 11 September 1947 Section 2. — The granting of such dispensation shall be made by the Procuratore dello Stato of the Tribunal within whose jurisdiction the Vital Statistics Office that would otherwise be competent to receive the request for publication, is located. Section 3. — After such dispensation has been granted, the persons concerned may obtain the celebration of their marriage by submitting to the Vital Statistics Official public declarations („atti di notorietà“) made before the Pretore or the President of the Commune of the place where the marriage is to be celebrated in lieu of the documents required by Article 97 of the Civil Code, and in addition to the order of dispensation. ; |f Ifjlf A 5 v ARTICLE II AUTHORIZATION FOR MARRIAGE OF MINORS If for the celebration of the marriage the consent of the persons mentioned in Article 90 of the Civil Code is required, and cannot be obtained because of the state of war, the competent Procuratore dello Stato may authorize the marriage. ARTICLE III DISPENSATION FROM THE OBLIGATION OF PRODUCING CERTAIN DOCUMENTS Section 1. — If, for reasons arising from the state of war, the marriage has been celebrated without the prescribed publications and no dispensation therefrom has been granted and, furthermore, it is impossible to secure the documents required by Article 13 of the Law 27 May 1929, No. 847, the Vital Statistics official may proceed with the registration merely upon the presentation of a public declaration („atto notorio“), confirmed under oath by four persons, who may be related to the spouses, from wich it shall appear that there are no such impediments as mentioned in Article 12 of the said Law. Said declaration shall also contain the exact details regarding the name, surname, age, profession, place of birth, domicile and residence of the spouses, as well as the surname and name, domicile and residence of their parents. Section 2. — a) The Vital Statistics Official shall verify the contents of the said public declaration („atto notorio“) by making such inquiries as he may deem opportune. b ) Where any discrepancies beWeen the findings of the inquiries and the sworn decla rations appear, the Vital Statistics Official shall suspend the registration and forward the documents to the appropriate Tribunal which shall decide on the issue in Chambers upon hearing the public attorney („pubblico ministero“). Section 3. — a) Any foreigner, desiring to contract marriage within the Territory and who, for reasons arising from the state of war, cannot present the declaration mentioned in para 1, Article 116, of the Civil Code, may be authorized to submit in lieu thereof a public declaration („atto notorio“) similar to that specified in Section 1 of this Article, from which it shall appear that, according to the laws to which he is subject, there is no impediment to the marriage. Such declaration shall also contain the exact details regarding the name, surname, agq^and profession, place of birth, domicile and residence of such foreigner, as well as the name and surname, domicile and residence of his parents. b) The authorization shall be requested from the Procuratore dello Stato of the Tribunal in whose jurisdiction the marriage is to be celebrated. The above mentioned public declaration („atto notorio“) shall be attached to such request. A.M.G. Gazette - Voi. Infantry Senior Civil Affairs Officer Order No. 451 REVISION OF CONTRACT PRICES FOR PUBLIC WORKS WHEREAS it is considered advisable and necessary to bring up to date the provisions concerning the revision of contract prices for Public Worlcs in those parts of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the „Territory“), NOW, THEREFORE, I, JAMES J. CARNES ,Colonel Infantry, Senior Civil Affairs Officer ORDER: ARTICLE I IMPLEMENTATION OF CERTAIN PROVISIONS OF ITALIAN LAW Section i. — Except as expressly provided for in Article II of this Order the following provisions of Italian Law are hereby made part of this Order, as if they had been herein set forth in full: a) Articles 1 and 3 of D.L.L. April 5th 1945, No. 192;' b) Articles 1, 2 and 5 of D.L.L. April 5th 1946, No. 226 ; c) Articles 1 and 2 of D.L.C.P.S. November 23rd 1946, No. 463. Section 2. — Copies of the three above mentioned Decrees have been deposited at the Offices of the Genio Civile in the Territory, and may be freely inspected by any person concerned. ARTICLE II AMENDMENTS TO THE IMPLEMENTED PROVISIONS OF ITALIAN LAW Section i. — All references to the Italian State, Ministries, Bodies, Offices, Ministers or Officials acting on its behalf, contained in the Decrees mentioned in Article I of this Order, shall be considered to be deleted and substituted by similar references to the Allied Military Government. No provision contained in the said Decree shall vest either in the Italian State or in any person or Body acting on its behalf with any power with regard to persons, property or matters within the Territory. 840 A.M. No. 27-11 September 1947 Section 2. — The provisions of the Italian Laws implemented by this Order shall apply exclusively to those contracts which (a,) have not less than three months before completion ; (b) have been in progress on or subséquent to 1 October 1946. Contracts completed by 12 August 1947 as evidenced by regular report of accomplishment are specifically excluded from the provisions of this Order. Any rule contained in the Decrees mentioned in Article I of this Order and inconsistent with said provision shall be considered as substituted by the same. ARTICLE III EFFECTIVE DATE This Order shall become effective on the date it is signed by me. Dated at Trieste, this 6th day of September 1947. JAMES J. CARNES Colonel, Infantry Senior Civil Affairs Officer Order No. 452 PROVISIONS RELATING TO THE REPRESSION OF PROSTITUTION WHEREAS it is considered advisable to make certain amendments to the existing provisions concerning the repression of prostitution within that part of Venezia (hulia administered by the Allied Military Government (hereinafter referred to as the „Territory“), NOW, THEREFORE, I, JAMES J. CARNES, Colonel Infantry, Senior Civil Affairs Officer, hereby ORDER: ARTICLE I Section i. —- Para 4 of Article 191 of the Consolidated Text of the Lawson Public Safety, approved by RD 18 June 1931, No. 773, is hereby amended by adding thereto as follows : „The contravener shall be punished by imprisonment („arresto“) from 6 months to two years and by a fine („ammenda“) of from one thousand to ten thousand lire.“ Section 2. Article 202 of the aforesaid Consolidated Text is hereby amended by adding thereto as follows : „If, contrary to the order („ordinanza“) of closing down, the premises continue to be kept open or running, or if same are re-opened without the prior permission of the Public Safety Authorities, the manager of the premises shall be punished by imprisonment (reclusione“) from three months to two years and by a fine („multa“) of from one thousand to ten thousand lire“. Section 3: — Para 3 of Article 208 of the mentioned Consolidated Text is hereby amended by adding thereto as follows : A.M.G. Gazette - Vol. II, No. 27-11 September 1947 .841 „Contraventions to the provisions of this Article shall be punished by imprisonment („arresto“) from six months to two years and by a fine („ammenda“) of from one thousand to ten thousand lire, provided that they do not constitute a graver offence. “ ARTICLE II Section i. -— Except in cases where the fact constitutes a graver offence, whoever solicits another to promote or encourage prostitution („faccia opera di adescamento“), independently of the illegal operation or management of the premises used for prostitution, shall be punished by imprisonment („arresto“) from six months to two years and by a fine („ammenda“) of from one thousand to two thousand lire. Section s. — If anyone encourages a person who may not be charged („non imputa-bile“) to carry out such solicitation, Article 111 of the Penal Code shall be applicable. ARTICLE III This Order shall take effect within the Territory on the date of its publication in the Allied Military Government Gazette. Dated at Trieste, this 2nd day of September 1947. JAMES J. CARNES Colonel, Infantry Senior Civil Affairs Officer Order No. 453 INCREASE OF CONTRIBUTIONS TO THE UNIVERSITY AND OTHER INSTITUTES OF INSTRUCTION WHEREAS it is deemed advisable and necessary to increase the State contributions in favour of the University and Institutes of instruction of higher grade in that part of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the „Territory“), NOW, THEREFORE, I, JAMES J. CARNES, Colonel Infantry, Senior Civil Affairs Officer, hereby ORDER: ARTICLE I INCREASE OF STATE CONTRIBUTIONS IN FAVOUR OF UNIVERSITY AND OF INSTITUTES OF INSTRUCTION OF HIGHER GRADE The contributions granted by the State for the maintenance of the University and of Institutes of instruction of higher grade, astronomic observatories, scientific Institutes and obstetrics schools, are hereby increased 5 times over the contributions granted on January 1, 1947. 842 A.M. Gazette - Vol. II, No. 27-11 September 1947 ARTICLE II DATE OF COMING INTO FORCE AND DATE OF APPLICATION This Order shall come into force within the Territory on the date that it is signed by me and the provision contained therein shall be effective as from 1st January 1947. CARNES Colonel, Infantry Senior Civil Affairs Officer Order No. 454 PROVISIONS RELATING TO THE EXPIRATION OF THE RIGHT TO RUN PHARMACIES ,.DI DIRITTO PERSONALE“ WHEREAS, it is considered advisable and necessary to extend the time limits concerning the expiration of the right to operate pharmacies ,,di diritto personals“, in that part of Venezia Giulia administered by the Allied Forces hereinafter referred to as the „Territory“), NOW, THEREFORE, I, JAMES J. CARNES, Colonel, Infantry, Senior Civil Affairs Officer, hereby ORDER: ARTICLE I Section i. •— The time limit provided for by Article 375, para 2, of the Consolidated Text of the Sanitary Laws, approved by R.D. 27 July 1934, No. 1265, and coneerning the expiration of . the right to operate pharmacies ,,di diritto personale“ now existing and being operated in the Territory, in accordance with the Austrian Law of 18 December 1906, No. 5 B.L.I., is hereby extended up to six months after the termination of the present state of war. Section 2. — The transfer of pharmacies mentioned in the preceding Section may take place as from June 28, 1943, and up to the expiration of the extension, only in favour of pharmacists regularly inscribed in the Professional Roll. Section 3.'— In case of succession, the transfer of pharmacies may take place in accordance with the second para of Article 369 of the Consolidated Text of the Sanitary Laws. Section 4. — The heirs of the owner („titolare“) may transfer the pharmacy in favour of pharmacists inscribed in the Professional Roll, within the time limit provided for by Articles 2 and 3 of the Law 23 December 1940, No. 1868, and extended by Section 3 of Order No. 429 dated 26 July 1947. Gazette - Vol. II, No. 27 - 11 September 1947 843 Order No. 455 (63 B) PROVISIONS RELATING TO PENSIONS COMMISSIONS WHEREAS it is considered advisable, and necessary to make amendments and additions to Order No. 63 by increasing the size of the pensions commissions to be appointed thereunder, in that part of. Venezia Giulia administered by the Allied Forces (hereinafter referred to as the „Territory“) ; NOW, THEREFORE, I. JAMES J. CARNES, Colonel Infantry, Senior Civil Affairs Officer, hereby ORDER: ARTICLE I AMENDMENTS TO ORDER No. 63 - PENSIONS COMMISSIONS Section 1 of Article I of Order No. 63 is hereby deletedand substituted by the following Sections : „„Section 1. — Area Pension Commissions shall be constituted in each Area of the Territory with the duties and functions hereinafter stated, as follows : TRIESTE AREA The Trieste Area Commission will consist of two Sections, each of which shall sit as a Commission. The Commission of Trieste Area shall be presided over by a Chairman who will be responsible for the allocation of work and control of the two Sections into which the Commission is divided. GORIZIA AREA The Gorizia Area Commission will consist of one Commission. POLA AREA The Pola Area Commission will consist of one Commission. Section 2. — Each Area Commission or Section sitting as a Commission shall consist of six members, one of whom will be chairman. The First Section of the Trieste Area Commission will be presided over by the chairman, the second Section will be presided over by the Deputy chairman acting as chairman while sitting as a Commission.““ ARTICLE II RE-NUMBERING OF SECTION Section 2 of Article I of Order No. 63. is re-numbered. Gazette - Vol. II, No. 27-11 September 1947 Order No. 456 PROVISIONS CONCERNING THE MODIFICATION OF THE TABLES OF ORGANIZATION OF PUBLIC BODIES PERSONNEL WHEREAS it is considered advisable ' and necessary to amend the provisions limiting the possibility of modifying the tables of organization of Public Bodies Personnel in that part of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the „Territory“) ; NOW, THEREFORE, I, JAMES J. CARNES, Colonel Infantry, Senior Civil Affairs Officer, hereby ORDER: ARTICLE I R. D. L. August 16th, 1926, No. 1577 and R. D. L. November 25th, 1926, No. 2108, concerning limitations to the possibility of modifying the tables of organization of the Personnel of the Provinces, of the Communes and of the Welfare Public Institutions („Istituzioni pubbliche di assistenza e beneficenza“) are hereby repealed. ARTICLE II Section i. In case of alterations of the rolls of the personnel and of the pertinent administrative provisions („norme regoJamentari“), that may cause an increase of th3 total expense of the organization („organico“) as fixed when this Order becomes effective, the relative decisions of the Commîmes or of the Provinces, shall be submitted for approval to the Finance Division and Welfare Division of the Allied Military Government upon hearing the opinion of the President of the Area Council. Section 2. — The decisions taken by the Provinces, by the Communes of Trieste, Gorizia and I^ola and by the 1st Class Welfare Institutions shall not be effective if they are not previously approved by the Area Commissioner, and Chief Welfare Officer. ARTICLE III This Order shall become effective on the date of its publication in the Allied Military Government Gazette. Dated at TRIESTE, this 6th day of September 1947. / JAMES J. Gazette - Vol. II, No. 27 - 11 September 1947 845 Order No. 458 AMNESTY AND PARDON FOR OFFENCES IN CASES OF SUSPENSION OF THE PEOCEEDING OR OF THE EXECUTION OF PUNISHMENT DUE TO REASONS OF WAR WHEREAS, it is deemed advisable to grant an amnesty and -pardon for offences in cases in which the proceeding or the execution of punishment has been suspended for reasons of war, in those parts of Venezia Giulia administered by the Allied Military Government (and hereinafter referred to. as the “Territory,,), NOW, THREFORE, I, JAMES J. CARNES, COLONEL, Infantry, Senior Civil Affairs Officer, ORDER: ARTICLE I Section i — Amnesty is hereby granted for any and all offences punishable by a fine or by imprisonment not exceeding, as to the maximum, 10 years even if joined with a fine, in those cases where the proceeding is still suspended pursuant to Articles 2, 5 and 11 of the Law 9 July 1940, No. 924, and concerning accused persons who w’ere performing service in the Armed Forces, in the formations of the Allied Forces or of partisans in the war of liberation, or who were interned in the enemy’s concentration camps. Section 2 — Amnesty is granted also in cases within the provisions of Section 1 above where the suspension has taken place without an explicit order of the Court. Section $ — There shall be likewise considered, for the purpose of this Order, as still suspended all proceedings within the provisions of Section 1 above, where, though an order revoking the suspension has been issued, no final sentence has been passed, on the effective date hereof. Section 4 — The amnesty shall be extended to those who in the same still suspended proceeding are accused of complicity in offences set forth in Section 1 or of offences connected therewith in the sense of Article 45, Code of Penal Procedure. ARTICLE II Amnesty is granted for offences for which a sentence has been passed in cases where the condamned person has been granted conditional liberty pursuant to Article 7 of the Law 9 July 1940. No. 924. The amnesty shall not apply to those to whom the conditional liberty has been revoked for the reason of having committed a crime. ARTICLE III Amnesty is granted for offences for which a sentence has been passed whereby the execution of the punishment has been delayed pursuant to Articles 9 and 10 of the Law 9 July 1940, No. 924. 846 A.M. Gazette - Vol. II, No. 27 - 11 September 1947 ARTICLE IV Security measures suspended or delayed pursuant to Articles 8 and.9 of the Law 9 July 1940, No. 924, are hereby revoked without requiring a re-examination. ARTICLE V Pardon is granted for penalties of fine or imprisonment the execution of which has been delayed or suspended owing to considerations of the family situation, pursuant to Article G of the Law 9 July 1940, No. 924, and Article 3 of the R. D. 5 April 1943, No. 354. ARTICLE VI There shall be exempted from the benefits set forth in the Articles 1, 3, 4 and 5 hereof all those who have been sentenced to one or more penalties of imprisonment exceeding one year for an intentional or preterihtentional crime committed after the proceeding had been suspended or after the execution of the penalty or of the security measure had been delayed or suspended. ARTICLE VII The application of the benefits set forth in the Articles 1, 3, 4 and 5 hereof shall be excluded as to second and successive offenders in cases provided for by the second and the following paras of Article 99, Penal Code, and as to habitual offenders or professional offenders or offenders showing criminal tendency, pursuant to Article 151, Penal Code. ARTICLE VIII For the purpose of computing penalties as to the application of amnesty : a) The penalty shall be considered established by the law for each committed or attempted offence; v 5) the increase of penalty depending on continuation shall hot be taken into account ; c) aggravating circumstances shall be taken into account ; d) extenuating circumstances, save the age, shall not be taken into account. ARTICLE IX The amnesty shall not be applied in cases where the accused, before the sentence will be pronounced ordering the quashing of the proceeding for the extinction of the offence due to amnesty, should declare that he does, not whish to partake of the benefit. ARTICLE X This Order shall come into effect on the date of its publication in the Allied Military Government Gazette. Dated at TRIESTE, this 8th day of September, 1947. JAMES J. Gazette - Vol. II, No. 27-11 September 1947 847 Order No. 460 (309 A) NEW SCHEDULES FOR THE PURPOSE OF OCCUPATIONAL ACCIDENT INSURANCE OF CONVENTIONAL WAGES FOR CREWS ENGAGED ON PROFIT SHARING BASIS WHEREAS it is deemed advisable and necessary to modify the schedules for the -purpose of occupational accident insurance of conventional wages established for crews engaged on -profit sharing basis by Order No. 3og, dated 4 February 1947, in that part of Venezia Oiulia administered by the Allied Forces ; NOW. THEREFORE, I, JAMES J. OARNES, Colonel Infantry, Senior Civil Affairs Officer, ORDER: ARTICLE I NEW SCHEDULE OF MONTHLY CONVENTIONAL WAGES The rates contained in the schedules of monthly conventional wages for crews engaged on profit sharing basis, embarked on sailing vessels, on sailing vessels with auxiliary motor, on motor-sailing vessels, and on fishing vessels, ^as referred to in the Ministerial Decrees of 27 May 1940, increased pursuant to Order No. 309, dated 4 February 1947, shall be further multiplied by four with effect as and from 1 January 1947. ARTICLE II DAILY AVERAGE WAGES The daily average wages shall be equal to one thirtieth (1 : 30) of the monthly conventional wages referred to in Article 1 hereof. / ARTICLE III VALUE OF FOOD ALLOWANCE („PANATICA“) For the purpose of the mentioned Ministerial Decrees of 27 May 1940, the value of the food allowance (panatica) shall be equal to four times the amounts establishd for each „Com-partimento Marittimo“ by the respective Headquarters as increased by Order No. 309, dated 4 February 1947. ARTICLE IV EFFECTIVE DATE This Order shall become effective on the date of its publication in the Allied Military Government Gazette. Dated at TRIESTE, this 6th day of September 1947. JAMES J. Gazette - Vol. II, No. 26-1 September 1947 Order No. 461 PROVISIONS CONCERNING EVICTIONS IN COMMUNES WITH EXCEPTIONAL SHORTAGE OF DWELLING HOUSES AND BUSINESS PREMISES WHEREAS it is deemed advisable and necessary to make provisions concerning evictions in Communes where there is an exceptional shortage of dwelling houses and business premises, in that part of Venezia Giulia administered by the Allied Forces ; NOW, THEREFORE, I, JAMES J. CARNES, Colonel Infantry, Senior Civil Affairs Officer, ORDER: ARTICLE I PROVISIONS CONCERNING EVICTIONS IN COMMUNES WITH EXCEPTIONAL SHORTAGE OF DWELLING HOUSES AND BUSINESS PREMISES Section I. ■— In Communes where a Housing Committee has been established in accordance with General Order No. 10, dated 4th August 1945, the date by which sentences and orders (ordinanze) ordering evictions from property used for dwelling houses and business premises are to be enforced, shall be fixed by the Area President who shall issue the appropriate order after consulting the Housing Committee. The Housing Committee before expressing an opinion must have heard the lessee and may also have heard the lessor. Section 2. — Before fixing the date of eviction the Area President will take the following factors into consideration : 1. — the difficulty the tenant may have in getting other accomodation ; 2. — the conditions of the tenant as compared with those of the person who is. to occupy the property ; 3. — whether the tenant has justifiable reasons for continuing to reside in the Commune. The eviction shall in no case be ordered to take place on a date beyond a period of a six months from the date of lodging of the request for eviction. ARTICLE II EFFICACY OF AREA PRESIDENT’S ORDER The Area President’s Order (decreto) fixing the date for the eviction shall be final. In exceptional cases the eviction may be postponed for a further period of not more than three months, provided that the non-compliance, if any, of the terms of the contract, has ceased. ARTICLE III APPLICABILITY OF THIS ORDER This Order only applies to Orders passed by the Civil Courts and not to evictions by the Housing Committees.
