A., Trieste - 1951 ALLIED MILITARY GOVERNMENT British - United States Zone-Free Territory of Trieste Order No. 46 CENTRAL COMMISSION OF PROFESSIONS - AMENDMENT TO GENERAL ORDER No. 20/1945 WHEREAS by General Order No. 20 dated 20 October 1945, as amended, among other 'provisions for the re-organization of Free Professions, a Central Commission was established with the powers and duties specified in Article XII of said General Order No. 20, and WHEREAS said Commission has never functioned and it is now necessary to modify the Commission and to amend General Order No. 20 in that part thereof relating to the establishment and composition of said Commission ; NOW, THEREFORE, I, CHARLES C. BLANCHARD, Brigadier General U.S. Army, Director General, Civil Affairs, ORDER: ARTICLE I The Articles X, XI and XII of General Order No. 20 dated 20 October 1945, are hereby cancelled and the following new Articles substituted therefor : „Article X - Establishment of Central Commission of Professions „A Central Commission of Professions is hereby established .with the powers and „duties specified in Article XII hereof with seat at the Court of Appeal.“ „Article XI - Composition of Central Commission of Professions „The Central Commission of Professions shall be composed of a magistrate, to be „appointed by the President of the Court of Appeal, who shall be the chairman, and by „one representative from each of the Orders and Colleges, having not less than twenty „members in its Roll, except Notaries. Said representatives shall be elected by the Council „of each Order or College within one month after the election of the Council and shall „assume office as soon as appointed by decree of the President of the Court of Appeal. „The chairman and members’ tenure of office shall be one year ; they shall, however, „continue in office until their successors are appointed. A Vice President and a Secretary „shall be elected by the Commission itself.“ „Article XII - Powers and duties of Central Commission of Professions „The Central Commission of Professions shall perform all duties and shall be „vested with all the power and authority conferred by the Professional Laws and Regulations upon the Central Commissions of each Profession, except Notaries and Lawyers „and Attorneys. In addition, the Central Commission shall have the power to issue Regulations governing its own work and procedure, which shall become effective after „approval by the President of the Court of Appeal.“ article II As to the first appointment to the Central Commission of Professions subsequent to the publication of this Order, the time-limit of one month after the election of the Council of each Order or College, within which said Councils must elect their representatives to the Central Commission of Professions, shall be substituted by a time-limit of one month after the effective date of this Order. The names of the members so elected shall be immediately communicated to the President of the Court of Appeal, who will issue his decree appointing the chairman and members of the Central Commission of Professions as soon as possible. BLANCHARD Brigadier General U.S. Army Ref. : LD/AI51/22 Director General, Civil Affairs Order No. 47 IMPROVEMENT OF TUBERCULOSIS BENEFITS FOR THE CHILDREN OF THE INSURED WORKERS WHEREAS it is deemed advisable and necessary to extend the age limits of the children and of those so considered by law, as well as of the brothers and sisters living with the insured workers and supported by them, for the eligibility to the tuberculosis benefits, in that part of the Free Territory of Trieste, administered by the British- United States Forces, NOW, THEREFORE, I, CHARLES C. BLANCHARD, Brigadier General U.S. Army, Director General, Civil Affairs, ORDER: ARTICLE I Section 1. — The maximum age limit of 15 years for eligibility to benefit from the tuberculosis treatment fixed by Article 69, paragraph II, sub para c) and d) and paragraph III of R.D.L. 4 October 1935, No. 1827, for the children and for those so considered by law, brothers and sisters living with the workers insured against the tuberculosis and supported by them shall be hereby extended to respectively 17 years, for the persons at the charge of those insured who have the qualification of workers (operai), and to 20 years, for those persons who are at the charge of the employees (impiegati). Section 2. —• The age limit of 17 years contemplated by the preceding Section shall be hereby extended to 20 years, if the person supported attends a professional or secondary school, diocesan or regional seminary and religious institute and provided this person does not perform paid work. Section 3. — For those persons who are contemplated by the preceding Sections, wTho are regularly inscribed with Universities or University Institutes, Academies of Music and Fine Arts, eclesiastic Athenaeums for higher studies and who are not in possession either of a University degree or of an equivalent certificate, the age limit shall be further extended till completion of the University studies, but not beyond the 26th year of age, provided these persons be shown to be supported by the insured workers. Section 4. — The persons contemplated by the preceding Sections who, owing to their studies, are residing in other localities than those of the head of family, shall not be subject to the obligation of living with the insured worker. ARTICLE II The present Order shall become effective on the date of its publication in the Official Gazette and shall be operative as from the 14 February 1951. BLANCHARD Brigadier General U.S. Army Ref. : LD¡AI51I32 Director General, Civil Affairs Order No. 48 DETERMINATION OF THE RATES OF CONTRIBUTIONS IN AGRICULTURE DUE FOR THE YEAR 1951 WHEREAS it is deemed necessary to determine the rates of contributions in agriculture due for the year 1951, in that part of the Free Territory of Trieste administered by the British-United States Forces (hereinafter referred to as the „Zone“), NOW, THEREFORE, I, CHARLES C. BLANCHARD, Brigadier General U.S. Army, Director General, Civil Affairs, ORDER: ARTICLE I The contributions provided for by „Articolo Unico“ of R.D.L. 28 Novembre 1938, No. 2138, and due in the Zone for the year 1951, shall be those set forth in the table attached to this Order. ARTICLE II Section 1. — The rates of contributions as set forth in the attached table shall apply to the working days ascertained in respect of each enterprise in accordance with R.D.L. 28 November 1938, No. 2138, and with the rules for its application. Section 2. — As regards those enterprises employing fixed salaried workers, the number of their days of attendance shall be computed, for the purpose of contributions, in the amount of 300. In those cases where the above mentioned fixed salaried workers attend to both agricul- tural work and cattle, such working days shall be deducted from the number of those established in total for the enterprise for cultivation of the land and the attendance of cattle. On the contrary, in those cases where they attend exclusively either to agricultural work or to cattle, the 300 days shall be deducted from the number of those established for the cultivation of the land or for the attendance of cattle respectively. Section 3. — As regards „aziende coloniche“ and „aziende mezzadrili“, the number of days employed by each working member of the family shall be calculated for the purpose of contributions, in the amount of 240. Section 4. —- The owners of rented land shall pay the rates as shown in the attached table in respect of „salariati fissi“ and „giornalieri di campagna“, for each working day of fixed salaried workers employed by them and for each working day charged to them for works of ground improvement and soil regulation, in terms of Article 5 of R.D.L. 24 September 1940 No. 1949. ARTICLE III Whenever during the year 1951 there should be any change in the rates of contributions set forth in the present Order, pursuant to the provisions governing the Social insurance treatment („assicurazioni e prestazioni“) for which the application of the above contributions is established, the rates fixed in the table attached to this Order shall be modified accordingly by special subsequent provisions. ARTICLE IV The contribution for family allowances in respect of those workers who are not qualified as employees in the agriculture sector of „Cassa Unica“ for family allowances shall be fixed at the rate of 49.— Lire per each working day. ARTICLE V The lessors of the land leased on a share-cropping basis („concedenti dei fondi a mezzadria e colonia“) shall retain the amount of the contributions which may be due by the „colono“ or „mezzadro“ on behalf of any workers employed for works performed for the „colono“ or „mezzadro“. In terms of Art. V of Order No. 462, dated 11 September 1947, the share of the contribution due by the worker shall be retained by the employer from the salaries paid. The share to be borne by the worker shall be Lire 7,12 for each working day of a man, and Lire 3,56 for each working day of a woman or child.
