A.» Trlesta - 1952 ALLIED MILITARY GOVERNMENT British - United States Zone-Free Territory of Trieste Order No. 12 DECLARATION OF PUBLIC UTILITY AND URGENT AND UNDELAYABLE NECESSITY OF CONSTRUCTION OF A HIGH TENSION LINE FOR THE TRANSMISSION OF ELECTRIC ENERGY FROM PROSECCO RAILWAY STATION TO BORGO GROTTA GIGANTE IN THE COMMUNE OF SGONICO WHEREAS it is deemed advisable to authorize the „Società Elettrica della Venezia Giulia“ to construct and operate a line for the transmission of electric energy at the voltage of 10.000 volts which, starting from the trans former-cabin at the Prosecco Railway Station will end at Borgo Grotta Gigante in the Commune of Sgonico ; WHEREAS, during the enquiry no claims or objections have been lodged and permissions for the respective crossings have been obtained by said Society from the Forest Guard Branch of Venezia Giulia Police Force, Ispettorato delle Telecomunicazioni, Amministrazione Provvisoria delle Ferrovie del Territorio, Comune di Sgonico ; WHEREAS the Ufficio del Genio Civile and Ispettorato Generale del Genio Civile and U.S. V.S. have expressed their favourable opinion, NOW, THEREFORE, I, JOHN L. WHITELAW, Brigadier General U. S. Army, Director General, Civil Affairs, ORDER: ARTICLE I The Società Elettrica della Venezia Giulia (SELVEG) —hereinafter referred to as the „Società“ — is hereby authorized to construct and operate an electric line with a voltage of 10.000 volts, which starting from the transformer-cabin at the Prosecco Railway Station will end at Borgo Grotta Gigante in the Commune of Sgonico. ARTICLE II In accordance with Article 115 of the Consolidated Text 11 December 1933 No. 1775 all the works and installations needed for the construction and operation of the above mentioned electric line are hereby declared to be of public utility. In accordance with Art. 116 and 33 of the Consolidated Text 11 December 1933 No. 1775 and Art. 71 and subséquents of the Law 25 June 1865 No. 2359 as amended by the Law of 18 December 1879 No. 5188 series 2nd the carrying out of the works of construction of the electric line mentioned in the preceding Article and of the installations connected therewith are hereby declared urgent and undelayable. ARTICLE IV Section 1. — The expropriations and works shall be initiated within one month and shall be completed within three months from the date of publication of this Order. Section 2. — Within two months from the same date the „Società“ shall submit to the „Ufficio del Genio Civile“, Trieste, as per Art. 116 of the Consolidated Text 11 December 1933 No. 1775, the detailed plans of the stretches of the line affecting private property with respect to which it is necessary to proceed in accordance w ith the above mentioned Law 25 June 1865 No. 2359. ARTICLE V ,The line shall be constructed in conformity with the technical designs laid down in the project attached to the ,,Societa“’s application of 14 August 1951 and shall be subject to the final test of the „Ufficio del Genio Civile“ Trieste. ARTICLE VI This authority is granted under the safeguard of tho rights of third parties and under observance of all existing regulations governing lines for the transmission and distribution of electric energy and of the special provisions of the Administrations concerned in accordance with Art. 10 of the Consolidated Text 11 December 1933 No. 1775. Consequently the „Società“ shall assume full responsibility with respect to the rights of third parties and the possible damages that could in any way be caused by the construction of the electric line, protecting the Administration against all claims or troubles arising from third parties which might consider themselves damaged. ARTICLE VII The „Società“ shall carry out all such new works or modifications which according to the Law might be prescribed for the protection of public or private interest within the time-limits that will be fixed, for such purpose ; in case of non-fulfilment the penalties provided for by the Law shall be applied. Section 1. — For the expenses of superintendence and of final test entrusted to the ,,Uf-ficio del Genio Civile“ the „Società“ shall deposit at the Treasury Section, Trieste, at disposal of said Ufficio the amount of 20,000 Lire (twenty thousand). Section 2. — As a security for the obligations deriving from the present authority and for those with respect to the third parties the „Società“ shall deposit at the „Cassa Deposit! e Prestiti“ the amount of 20,000 Lire (twenty thousand). Section 3. — The validity of the present authority is subject to the previous depositing of the aforesaid amounts. All expenses connected with the present authority shall be to the charge of the „Società“. ARTICLE IX The general plan and the summary report of the works attached to this Order are marked iespectively as „Annex A“ and „Annex B“, and shall be deposited at the Department of Legal Affairs of Allied Military Government where they may be freely inspected by all persons interested. Army Ref. : LD¡A¡52¡4 Director General, Civil Affairs Order No. 13 AMENDMENT TO ORDER No. 167/1951 REORGANIZATION OF PROCEEDINGS OF ASSIZE WHEREAS it is deemed advisable to amend Article XLVIII of Order No. 167, dated 23 October 1951, relating to the reorganization of proceedings of Assize, in that part of the Free Territory of Trieste administered big the British-XJnited States Forces, NOW, THEREFORE, I, JOHN L. WHITELAW, Brigadier General U. S. Army Director General, Civil Affairs, ORDER: ARTICLE I Article XLVIII of Order No. 167, dated 23 October 1951, is hereby repealed and substituted by the following : „So long as the Court of Assize and the Court of Assize of Appeal are not functioning „with the conposition provided for in the present Order, there will function, in Trieste, a Court „of Assize composed of a Councillor of the Court of Appeal, as President, a judge, both appointed by a Decree of the First President of the Court of Appeal, and. six popular judges, who are „in possession of the requisites provided for by Article VI of the present Order, chosen in accord-„ance with the provisions at present in force. „The present Court of Assize of Trieste, composed as provided for by this Order, will „assume the functions of second grade judge in respect of the Court of Assize referred to in the „foregoing paragraph. „The First President of the Court of Appeal shall provide, by a decree, for the completion of the number of popular judges needed in terms of the foregoing paragraph, if on the „effective date of this Order the Court of Assize of Appeal has already been convened. „For trials in course the Court of Assize of Appeal shall maintain the composition provided for by Order No. 239 dated 22 December 1950.“ ARTICLE II This Order shall become effective on the date of its publication in the Official Gazette.
