Trieste - 1950 ALLIED MILITARY GOVERNMENT British - United States Zone-Free Territory of Trieste Order No. 116 TEMPORARY RAISING OF MAXIMUM AGE LIMIT FOR PUBLIC COMPETITIONS WHEREAS it is deemed advisable to raise the maximum age limit established by the provisions in force for admission to public competitions, in that pa/rt of the Free Territory of Trieste administered by the British-United States Forces, NOW, THEREFORE, I, CLYDE D. EDDLEMAN, Brigadier General U.S. Army, Director General, Civil Affairs, ORDER: ARTICLE 1 The maximum age limits established by the provisions in force, including special provisions, for admission to public competitions, and for direct appointments, in cases contemplated by the law, in Administrations of the State and of Public Bodies as well as of concerns depending on same, is hereby raised by five years until 31 December 1954. The raising of the maximum age limit contemplated by the preceding paragraph shall be added to those contemplated by all other provisions in force, provided the age of 45 years is not exceeded. ARTICLE II The provisions of the preceding Article shall apply also to the admission to public competitions which have already been called for on the effective date of this Order, provided the time-limit for the filing of the applications has not elapsed. In such case the said time-limit shall be extended by 30 days. The Administration announcing the competition shall immediately give notice thereof by the same means of publicity used for the announcement. - ARTICLE III This Order shall become effective on the date of its publication in the Official Gazette. Army Ref. : LD]Af50\125 Director General, Civil Affairs Order No. 117 PROVISIONS CONCERNING AMOUNTS OF INDEMNITIES TO BE GRANTED TO THE WORKERS COMPULSORILY INSURED AGAINST OCCUPATIONAL ACCIDENTS AND DISEASES IN INDUSTRY WHEREAS it is deemed advisable to issue -provisions concerning the amounts of indemities to he granted to workers benefiting from compulsory insurance against occupational accidents and diseases in industry in that part of the Free Territory of Trieste administered by the British- United States Forces (hereinafter referred to as the „Zone“), NOW, THEREFORE, I, CLYDE D. EDDLEMAN, Brigadier General U.S. Army, Director General, Civil Affairs, ORDER: PART I MODIFICATIONS AND COMPLEMENTARY PROVISIONS TO R.D. No. 1765, DATED 17 AUGUST 1935 AND TO SUBSEQUENT AMENDMENTS THERETO ARTICLE I Paragraphs 2 and 3 of Article 24 of R.D. No. 1765, dated 17 August 1935, concerning compulsory insurance against occupational accidents and diseases in industry, as amended by article 2 of Legislative Decree No. 14, dated 25 January 1947, extended to the Zone by Order No. 350, dated 19 April 1947, and by Article I of Order No. 300, dated 19 July 1948, are hereby repealed and substituted by the following : „When it is ascertained that the occupational accident or disease causes a permanent disablement so to impair the working capacity by more than the ten per cent (10%) for occupational accidents and by more than twenty per cent (20%) for occupational diseases, there shall be paid, with effect as from the day subsequent to that of discontinuance of payment of the indemnity due for temporary disablement, a disablement annuity proportioned to the degree of such disablement on the basis of the following quotas of the pay calculated according to the provisions laid down in articles 39 through 42. „1) in cases of disablement from 11% to 60%, a quota increasing according to the degree of disablement, as per attached table, from 50% to 60% ; „2) in cases of disablement from 01% to 100% a quota equal to the degree of disablement. Monthly annuities shall be rounded off to the nearest ten ; those equal to or higher than the five lire fraction to the next higher ten, those less than said fraction of five Lire to the nearest lower ten. „In cases of total permanent disablement where it is indispensable that the disabled worker be continuously and personally attended, in addition to his annuity, a complementary allowance of 3000 Lire monthly shall be paid to him for the whole duration of said attendance. No complementary allowance shall be paid when the personal attendance is given either directly by the Insurance Institute in hospitals („luogo di rieovero“) or by other Bodies.“ ARTICLE II Article 27 of R.D. No. 1765, dated 17 August 1935, as amended by article 3 of D.L. No. 14, dated 25 January 1947, extended to the Zone by Order No. 350, dated 19 April 1947, by Article I of Order No. 300, dated 19 July 1948 shall hereby be further amended as follows :, а) No. 2) of the first paragraph is hereby substituted by the following: „20% to each legitimate, illegitimate recognized or recognizable, and adopted child, until 18 years of age ; 40% in case of orphans of both parents, and, in ease of adoptive children if both adopting parents have died. In case of survival of disabled children, the annuity shall be paid to the disabled child for the entire duration of said disablement.“ б) The last sentence of the third paragraph and the fourth paragraph are hereby respectively substituted by the following : „The allowance shall amount to Lire 12,000 in case of the spouse surviving without children younger than 18 years or disabled ; the allowance shall amount to Lire 16,000 in case of the spouse surviving with children younger than 18 years or disabled whether legitimate, illegitimate recognized or recognizable, or adopted, and in case of survival of children only if younger than 18 years or disabled ; and to Lire 8000 in all other cases. In respect of workers of maritime shipping and maritime fishing enterprises, the allowance shall be equal to one monthly pay ; with a minimum as shown in the amounts indicated in the preceding paragraph.“ ARTICLE III The third paragraph of article 39 of R.D. 17 August 1935, No. 1765, as amended by Article I of Order No. 300, dated 19 July 1948, is hereby substituted by the following : „In any case the annual pay shall be computed from a minimum of 120,000 Lire to a maximum of 270.000 Lire ; for members of the staff of the maritime shipping and fishing enterprises to a maximum of 427, 500 Lire for masters and chief engineers, 360,000 Lire for deck chief officers and engine first officers, and 315,000 Lire for other officers.“ ARTICLE IV The word „wage“ („salario“) laid down in R.D. No. 1765, dated 17 August 1935, and in subsequent complementary and amending provisions, is hereby substituted by the word „pay“ („retribuzione“). PART II REVALUATIONS AND GENERAL PROVISIONS ARTICLE V Section 1. — With effect as from 1 January 1949, death annuities and those due for cases of permanent disablement finally made payable at a rate from .35% to 100% for occupational accidents or diseases, pursuant to R.D. No. 1765, dated 17 August 1935, in course on the above date, shall be revalued according to principles laid down in Article I of the present Order on the basis of a yearly pay of: а) 120,000 Lire in cases of permanent disablement of a degree from 35% to 49% and in case of survivors ; б) 150,000 Lire in cases of permanent disablement of a degree from 50% to 79% ; c) 180,000 Lire in cases of permanent disablement of a degree from 80% to 100%. Section 2. — Similar provisions shall apply in respect of these annuities which will be made payable subsequent to the afore mentioned date for accidents or diseases occurred up to and including the same date. Section 3 — For members of the staff of the maritime shipping and maritime fishing enterprises the revaluation shall be made on the basis of the following yearly pays in connection with the cases foreseen in paragraphs a, b and c of Section 1 of the present Article : 1) For ship masters and chief engineers 190,000 Lire, 237,500 Lire and 285,000 Lire respectively ; 2) for deck chief officers and engine first officers, 160,000 Lire, 200,000 Lire and 240,000 Lire respectively ; 3) for other officers, 140,000 Lire, 175,000 Lire and 210,000 Lire respectively. ARTICLE VI With effect as from 1 January 1949, the invalids of work („grandi invalidi del lavoro“) paid out in capital pursuant to law (T.U.) No. 51, dated 31 January 1904, and to R.D. No. 928, dated 13 May 1929, assisted in terms of article 61 of R.D. No. 1765, dated 17 August 1935, shall be granted a monthly continuative allowance, of 5000 Lire as to those grand invalids permanently disabled up to the 89%, and of 7000 Lire as to those permanently disabled from 90% to 100% ; said allowance shall absorb allowances previously granted. ARTICLE VII Section 1. — With effect as from 1 January 1949, the recipients of annuities for life constituted in terms of the provisions laid down in article 15 of the law (T.U.) No. 51, dated 31 January 1904, as well as disabled persons entitled to annuities for life by virtue of the provisions laid down in article 111, Regulations No. 1889, dated 21 November 1928, for the enforcement of D.L.L. No. 1450, dated 23 August 1917, shall be granted a monthly continuative allowance of 3,000 Lire as to those permanently disabled from 50% to 79%, of 5,000 Lire as to those from 80% to 89%, and of 7,000 Lire to those from 90% to 100% ; said allowance shall absorb allowances previously granted. Section 2. — The „Istituto Nazionale per Tassieurazione contro gli infortuni sul lavoro“, who will charge the single managements with their pertinent burdens, shall have a right to reimbursement from the Bodies sub article 48 of R.D. No. 1765, dated 17 August 1935, according to their respective competence. ARTICLE VIII Section 1. —- Recipients of annuities made payable in terms of R.D. No. 1765, dated 17 August 1935, for occupational accidents, occured up to and including 31 May 1946, involving a permanent finally established disablement of not more than 20%, may request the Insurance Institute, not prior to expiration of a period of 4 years from the date of constitution of the annuity, for payment, in settlement of all relative rights, of an amount equal to the capital value of the further annuities due to them, which value shall be calculated on the basis of the tables sub article 49 of the above mentioned R.D., as approved by Ministerial Decree dated 16 February 1938, and amended by Ministerial Decree dated 31 July 1942, and shall be increased by 10%. Section 2. — Should a new accident occur indemnifiable with a permanent disablement annuity, which disablement coincides with the one that had made the redeemed annuity payable, the procedure shall be in accordance with the principle laid down in article 11 of R.D. 15 December 1936 No. 2276, and in article 52 of the Regulations approved by R.D. No. 200, dated 25 January 1937. ARTICLE IX The amendments and complementary provisions foreseen in Articles I, IX and III of the present Order shall apply to occupational accidents occurred from 1 January 1949 and to occupational diseases that have become manifest as from such date. ARTICLE X Section 1. — With effect as from 1 January 1949, the additional rate of 7% on premiums chargeable to the employer as per article 14 of D.L. No. 14, dated 25 January 1947, extended to the Zone by Order No. 350, dated 19 April 1947, for the covering of the burdens met in payment of the cost of living allowances is hereby abolished. The provisions laid down in the first paragraph of article 11, amended by Order No. 97, dated 27 December 1947, and in articles 12 through 15 of D.L. No. 14, dated 25 January 1947, extended to the Zone by Order No. 350, dated 19 April 1947, and the provisions set forth in Articles II and III of Order No. 300, dated 19 July 1948, are hereby repealed. Section 2. — The provisions concerning the cost of bread indemnities set forth with other provisions shall remain unaltered, exception made for those concerning the additional rates or premiums in respect of workmen’s compensation which are hereby abolished. ARTICLE XI The provisions of the present Order shall also apply to the personnel employed with the autonomous transportation concerns and with the Post and Telephone services indicated sub No. 2 of Article 48, R.D. No. 1765, dated 17 August 1935, and to the personnel employed with the maritime shipping and maritime fishing enterprises. ARTICLE XII Section 1. — The instalments of annuities, including the additional complementary amounts, paid or to be paid by the „Istituto Nazionale per 1’assicurazione contro gli infortuni sul lavoro“ to permanent disabled workers and survivors, as a result of accidents arisen from war risks, shall be to the State’s burden. Section 2. — The said instalments of annuities shall be reimbursed to the afore mentioned Institute by applying the modalities laid down, pursuant to article 48, last paragraph of R.D. No. 1765, dated 17 August 1935, in Ministerial Decrees 19 January 1939, 27 September 1940 and 20 November 1947, concerning the management of social insurance against occupational accidents and diseases of personnel employed with the State Administrations. Section 3. — The amounts of the instalments of.annuities and the additional complementary amounts paid up to and including 30 June 1948 shall be reimbursed by the State to the above mentioned Institute by five yearly instalments of an equal amount, with effect as from the financial year 1949-1950. Section 4. — The instalments of annuities and the additional complementary amounts paid by the afore mentioned Institute during each financial year shall be reimbursed in the subsequent financial year starting from the year 1949-1950. Section 5. No payment shall be made by the State for interests or for quotas of general administrative expenses in addition to the reimbursements contemplated by the preceding Section. ARTICLE XIII Section 1. — The provisions laid down in the preceding Article shall also apply to the „Casse Mutue Marittime Tirrena, Adriatica e Mediterranea per gli Infortuni e le malattie“. Section 2. — The amounts already paid or which will be paid to the above mentioned „Casse Marittime“ by the „TTnione italiana di riassicurazione“ on the basis of the convention stipulated with them and dated 15 November 1941 shall remain with the said „Casse Marittime“ and be computed on account of the reimbursements which the State is due to pay in accordance with present Order. Section 3. — Should the amounts paid by the „Unione italiana di riassicurazione“ up to and including 30 June 1948 be lower than the amount of the instalments of annuities and the additional complementary amounts paid by the „Casse Marittime“ up to said date, the reimbursement by the State shall be restricted to the balance ; should, on the contrary, the amount be exceeding the surplus, increased by the subsequent payments if any, made by the „Unione Italiana di riassicurazione“, shall be taken into account and deducted from the reimbursements due for the financial year 1948-1949 and subsequent ones. ARTICLE XIV The present Order shall come into force on the date of its publication in the Official Gazette and be effective as from 1 January 1949. Dated at TRIESTE, this 20th day of June 1950. EDDLEMAN, Brigadier General U. S. Army, Director General, Civil Affairs, ORDER: ARTICLE I Section 1. — The Plan attached to Order No. 102 dated 12 May 1949 marked „Annex A“ is substituted with the Plan attached to this Order and marked as „Annex A 1“. The limits of the area of the Zaule Industrial Port are therefore accordingly modified. Section 2. — The Plan marked „Annex A 1“ shall be deposited at the Department of Legal Affairs where it may be freely inspected by all persons interested. ARTICLE II Section 1. — The following new paragraph shall be added to Section 2 of Art. II of Order No. 102 dated 12 May 1949: „During the period up to 31st December 1958 inclusive, the following goods shall be exempt from the licence duty established by R.D.L. 13 May 1935 No. 894 as subsequently amended : „ a) all materials used in the construction, modification and enlargement of industrial establishments within the Zaule Industrial Port. ,,b) alia machinery destined for permanent installation in the industrial establishments within the Zaule Industrial Port.“ Section 2. — Section 3 of Article II of Order No. 102 dated 12 May 1949 is hereby cancelled and substituted by the following : „Section 3. — The Registry tax and the tax on inscription in the Land-registers relating to deeds of expropriation or of purchase of property within the Zaule Industrial Port made by the State or by the „Ente Porto Industriale di Zaule“ as well as the same taxes relating to deeds of first transfer of such property to third parties for the purpose of establishing new industries and the construction of accessory buildings for the operation of such industries are hereby fixed at Lire 500.— provided that such deeds are made within the 31 December 1950.“ This Order shall become effective on the day of its publication in the Official Gazette and shall be operative as from the 1st March 1950. EDDLEMAN Brigadier General U.S. Army Ref. : LDIA/50/69 Director General, Civil Affairs Order No. 119 SUPER TAX ON WORKERS’ INCOMES — AMENDMENTS TO GENERAL ORDER No. 25 WHEREAS it is deemed advisable to amend Article 33 of General Order No. 25 dated 29 November 1945 concerning the super-tax on workers’ incomes in that part of the Free Territory of Trieste administered by the British- United States Forces (hereinafter referred to as the „Zone“), NOW, THEREFORE, I, CLYDE D. EDDLEMAN, Brigadier General U. S. Army, Director General, Civil Affairs, ORDER : ARTICLE I The last paragraph of Article 33 of General Order No. 25 dated 29 November 1945 is hereby repealed and substituted by the following: „The filing of the declaration is compulsory for the portion of work incomes exceeding the amount on which the super-tax is withheld by the employer for payments to the State as well as for any other incomes, when they are to be added to the work income, irrespective of the amount of the latter. The assessment of the tax and the relative collection from the individual income earners shall be made under the rules of procedure in force for all other tax-payers, taking into account, for the determination of the rate of tax, the aggregate amount of the work income and of the other incomes.“ ARTICLE II For the purpose of the foregoing Article and as an exception to any other contrary provision in force in this Zone, any request for repayment of taxes paid in excess shall be filed not later than 30 days after the day following the effective date of this Order. Army, Director General, Civil Affairs, ORDER: ARTICLE I The first part of the third paragraph of Article 1 of Law 17 August 1941, No. 1043, is hereby amended to read as follows : „When real estate is split, the parties concerned shall produce, together with the documents required for the execution of the conveyance, a certified extract from the relative land-map with the details of the splitting, such extract to be signed by a civil engineer or by a „dot-tore in scienze agrarie“, a „geometra“, „perito agrimensore“ or „perito agrario“ duly inscribed in the rolls of the respective profession.“ ARTICLE II This Order shall become effective on the date of its publication in the Official Gazette. EDDLEMAN Brigadier General U.S. Army Ref. : LDfAf30fll7 Director General, Civil Affairs Order No. 121 ALLOCATION OF MONOPOLY SHOPS TO PERSONS WHO WERE DEPRIVED OF THE AUTHORIZATION TO OPERATE THEM ON RACIAL GROUNDS WHEREAS it is deemed advisable to allocate Monopoly shops to persons who were deprived of the authorization to conduct them on racial grounds in that part of the Free Territory of Trieste administered by the British-United States Forces, NOW, THEREFORE, I, CLYDE D. EDDLEMAN, Brigadier General U. S. Army, Director General, Civil Affairs, ORDER: ARTICLE 1 The Department of Finance (Monopoly Administration) is hereby empowered to directly allocate, in terms of art. 85 of R.D. 14 June 1941, No. 577, and as an exception to the provisions of Articles 92, 93 and 94 thereof, vacant Monopoly shops to such persons as have been deprived of the authorization to conduct equivalent shops in consequence of the application of racial law provisions. In order to be granted such concession the persons concerned shall prove that they possess the necessary shop premises, or any other premises considered fit by the Administration, and the adequate means as well as the possibility and capacity of personally operating the shop. ARTICLE II The provisions of the foregoing Article shall also apply to persons operating Monopoly shops who were deprived of the relative authorization on account of their anti-fascist activities, provided that this fact result, beyond any possibility of doubt, from the documents in possession of the Administration. This provisions shall be operative up to three years after its effective date. ARTICLE III This Order shall become effective on the date of its publication in the Official Gazette. Pasta sold in parcels weighing up to a maximum of 5 kgs. shall also be sealed and labelled and bear such indications as set forth in the preceding paragraphs. ARTICLE II The aircraft material referred to in the first paragraph of Art. II of Order No. 73, dated 14 April 1949, shall include aircraft instruments, radio installations and parts thereof. The following words shall be added to the third paragraph of aforesaid Article II: „upon agreement with the Department of Commerce“. ARTICLE III The second paragraph of Art. V of Order No. 73, dated 14 April 1949, is hereby repealed. The reimbursement of the excise duty on fuels and lubricants in respect of which customs duty has already been, paid, and consumed on or after 1 July 1947 for the operation of aircraft used for air transportation services, shall be made at the request of the party concerned and on the basis of the consumption ascertained, taking into account the power of the engines and the hours flown. ARTICLE IV Air pilotage schools for civilians shall be granted, within the limit of 1000 tons per annum of fuel and 100 tons per annum of lubricants, the exemption from customs duty, licence dues, and excise duty, from the corresponding additional frontier duty, and from turnover tax in respect of fuel and lubricants destined exclusively for the operation of aircraft used in the said schools for teaching purposes. ARTICLE V Pending contrary provisions, the period of exemption from licence dues in favour of the goods hereinafter specified is hereby further extended : 1) Pit coal and coke (items 564 and 564 bis of the Customs tariff) ; 2) residues from the processing of petroleum oils, to be directly used as fuel (items 643 b 6 alfa of the Customs tariff); 3) crude, natural petroleum oils imported for processing (items 643-a 2 of the Customs tariff), so far as concerns the quantity corresponding to the fuel oil obtained therefrom and taken out from, or consumed as fuel in, refining establishments. The privilege referred to in the foregoing paragraph is hereby extended to residues from the processing of petroleum oils (item 643-b, 6-beta, of the Customs tariff) imported for processing, so far as concerns the quantity corresponding to the fuel oil obtained therefrom and taken out from, or consumed as fuel in, refining establishments. Tale condizione si presume adempiuta quando il complesso degli operai lavoranti a cottimo nel medesimo reparto con la stessa tariffa nei periodi sopra indicati, abbia realizzato un utile medio di cottimo non inferiore al suddetto 20%, il che non esclude la revisione delle tariffe nei casi in cui detto complesso di operai venga riconosciuto di capacità ed operosità superiore alla normale. ANTICIPO DI RIVALUTAZIONE Sempre con la medesima decorrenza, a titolo di anticipo sulle future rivalutazioni sa-ariali, verrà corrisposta una quota giornaliera come sotto indicato : operai specializzati ...................... L. 56 operai qualificati ....................... „ 24 manovali specializzati.................... „ 12 donne di l.a categoria ................... „ 16 donne di 2. a categoria .................. „ 8 ARTICOLO 7 ORARIO DI LAVORO La durata normale del lavoro è quella stabilita dalla legge con le relative deroghe ed eccezioni. Per ogni ora di lavoro compiuto dall’operaio oltre le ore 44 e fino alle 48 settimanali, l’azienda corrisponderà all’operaio stesso, in aggiunta alla sua retribuzione, il 5% del minimo di paga base contrattuale della categoria alla quale egli appartiene. Il lavoro cessa di massima alle ore 13 del sabato. Le ore in tal modo non lavorate nel pomeriggio del sabato possono essere recuperate a regime normale negli altri giorni della settimana, purché non si superino le nove ore giornaliere e le 48 settimanali. Per gli orari settimanali inferiori alle 44 ore il recupero a regime normale delle ore del pomeriggio del sabato, negli altri giorni della settimana, non potrà avvenire oltre le 8 ore giornaliere. Per gli impianti che richiedono un lavoro ininterrotto di 7 giorni alla settimana, la durata normale del lavoro (48 ore settimanali) risulterà dalla media di 3 settimane con un massimo di 8 ore giornaliere, eccezione fatta per il giorno di cambio di turno nel quale si potrà raggiungere un massimo di 12 ore. Tale prolungamento di lavoro, per la parte eccedente le 8 ore giornaliere, sarà considerato straordinario e retribuito come tale. E’ considerato lavoro straordinario quello eseguito oltre l’orario massimo e cioè 8 ore giornaliere o 48 settimanali salvo le deroghe ed eccezioni di legge. Il lavoro notturno decorre dalle 12 ore successive all’ inizio del turno del mattino, tuttavia non si considera notturno il lavoro compiuto dalle ore 6, nei limiti di un’ora giornaliera, per la predisposizione del funzionamento degli impianti. Restano ferme le disposizioni di legge circa il divieto di adibire a lavoro notturno le donne e i fanciulli. ARTICOLO 8 GRATIFICA NATALIZIA L’azienda è tenuta a corrispondere per ciascun anno all’operaio considerato in servizio, in occasione della ricorrenza natalizia, una gratifica ragguagliata a 200 ore di retribuzione globale di fatto, che per i cottimisti si intende riferita al guadagno medio delle ultime due quindicine o delle ultime quattro settimane. Nel caso di inizio o di cessazione del rapporto di lavoro durante il corso dell’anno, il lavoratore ha diritto a tanti dodicesimi della gratifica natalizia quanti sono i mesi di anzianità di servizio presso l’azienda. La frazione di mese superiore ai 15 giorni viene considerata a questi effetti come mese intero. PARTE III NORME COMUNI ARTICOLO 9 INDENNITÀ’ DI CONTINGENZA I dipendenti, cui si riferisce il presente lodo, godranno dal 15 aprile 1950, dell’indennità di contingenza, nella misura e nelle forme in vigore nel settore industriale. ARTICOLO 11 MAGGIORAZIONE DEL 10% Gli impiegati e gli operai non retribuiti a cottimo o con altra forma in incentivo, avranno diritto ad una maggiorazione del minimo di paga o stipendio tabellare, pari al 10%. ARTICOLO 12 FESTIVITÀ’ Nelle festività infrasettimanali previste dalla legge, in occasione delle quali il contratto di categoria prevede l’obbligo di corrispondere la retribuzione globale ancorché non ci sia prestazione d’attività, è sancito identico obbligo anche per le aziende cui si riferisce il presente lodo. ARTICOLO 13 DECORRENZA E DURATA Il presente lodo decorre dal 15 aprile 1950 e verrà a scadere il 15 ottobre 1950. Sarà ammessa una revisione del medesimo, anteriore alla scadenza, solamente nel caso in cui il trattamento economico dell’analoga categoria di lavoratori disciplinati dal rispettivo contratto di lavoro, avesse a subire modificazioni.
