The central issue in contemporary expropriation law is the assessment of public interest, which must be evaluated through the proportionality test. In Slovenia, the legal framework is shaped by the Constitution and the Spatial Planning Act (ZUreP-3), complemented by sectoral legislation such as the Mining Act and the Water Act. Expropriation for the exploitation of mineral resources and water is justified, as these are natural assets of strategic significance, constitutionally recognized as matters of public interest. The state acts as the holder of this interest, yet decision making body must carefully balance in each case the restriction of property rights against the broader societal benefit of ensuring access to essential resources. This balance safeguards both individual rights and sustainable management of natural wealth"},{"@xml:lang":"sl","#text":"Razlastitev kot poseg v ustavno varovano lastninsko pravico je dopustna le, če so hkrati izpolnjeni trije pogoji: obstoj javne koristi, izvedba poštenega in z zakonom urejenega postopka ter določitev primerne odškodnine. Osrednje vprašanje sodobnega razlastitvenega prava je ugotavljanje in presoja pogoja javne koristi, pri tem pa je treba upoštevati tudi strogi test sorazmernosti. Slovenski pravni okvir tvorita Ustava Republike Slovenije in Zakon o urejanju prostora, dopolnjujejo pa ga specialni predpisi, kot sta Zakon o rudarstvu in Zakon o vodah. Razlastitev za izkoriščanje mineralnih surovin in vodnih virov je utemeljena, saj gre za naravne dobrine strateškega pomena, ki jih Ustava opredeljuje kot dobrine posebnega pomena. Država nastopa kot nosilka javnega interesa, vendar se mora pri odločanju o razlastitvi v vsakem primeru posebej tehtati sorazmernost med omejitvijo lastninske pravice in ciljem zagotavljanja naravnih dobrin v dobro širše skupnosti.
