The author establishes that the freedom of the press is seriously threatened in today's global society, and due to the proliferation of sensationalist media the personality rights of those individuals on which the media reports are also threatened to an ever greater extent. He is in favour of governmental authorities taking on a more active role in regulating the position of the media in society, as well as of the limited introduction of awards of punitive damages for sensationalist \"yellow\" press. As his method of argumentation, the author applies an analysis of the case law of the ECHR, taking the findings of legal theory in the field of human rights law into account"},{"@xml:lang":"sl","#text":"Avtor v prispevku obravnava vprašanje kolizije med, na eni strani, svobodo tiska in, na drugi strani, pravico do zasebnosti ter do osebnega dostojanstva,kot je opredeljena v sodni praksi Evropskega sodišča za človekove pravice (ESČP). Ugotavlja, da je v globalni družbi svoboda tiska zelo ogrožena, zaradi razcveta senzacionalističnega tiska pa so vedno bolj ogrožene tudi osebnostne pravice oseb, o katerih tisk poroča. Zavzema se za aktivnejšo vlogo državnih oblasti pri urejanju položaja medijev v družbi in za restriktivno uvedbo kaznovalnih odškodnin za senzacionalistični tisk.
