It notes that the Public Employees Act does not consistently apply the formal criterion, according to which a matter is presumed to be an administrative matter if a regulation provides for the issuance of an administrative decision, but also provides for legal protection in the administrative sphere against orders and notices, which indicates that these matters are also administrative matters. In addition to the formal criterion, the substantive criterion must also be applied. According to the latter, an administrative matter – irrespective of the designation of the act – is examined (determined) on its merits. To avoid legal confusion caused in practice by inconsistent terminology and opaque statutory provisions, the legislator should define administrative matters more precisely, either by consistently using the term 'administrative decision' or by listing the matters classified as administrative matters taxatively (following the example of the Croatian legislation). However, in any case, the substantive criterion should also be applied (complementary)"},{"@xml:lang":"sl","#text":"Prispevek na podlagi teoretičnih izhodišč in sodne prakse kritično analizira zakonsko ureditev pravnega varstva javnih uslužbencev, ki je razdeljeno med upravno in delovnopravno varstvo, odvisno od oblike akta, zoper katerega se tako varstvo uveljavlja. Ugotavlja, da Zakon o javnih uslužbencih formalnega kriterija opredelitve upravne zadeve, po katerem se šteje, da gre za upravno zadevo, kadar je v predpisu predvidena izdaja upravne odločbe, ne uporablja dosledno, temveč varstvo v upravni sferi zagotavlja tudi zoper sklepe in obvestila. Poleg formalnega kriterija je treba torej izhajati tudi iz materialnega kriterija, po katerem se upravna zadeva – ne glede na poimenovanje akta – presoja (identificira) po vsebini. V izogib pravni zmedi, ki jo nepoenotena terminologija in nepregledna ureditev v praksi povzroča, bi moral zakonodajalec upravne zadeve v Zakonu o javnih uslužbencih bolj natančno opredeliti, bodisi z dosledno uporabo pojma “upravna odločba” ali s taksativnim naštevanjem zadev, ki se uvrščajo med upravne zadeve, kot je to storil hrvaški zakonodajalec.
