There is material gap between the role of BAMC in the recovery process of the banking sector and in the restructuring process of the corporate sector that was foreseen with the so called bad bank legislation and the actual role of BAMC in the mentioned processes. The role of BAMC was limited to the transfer of bad assets from the banks and to the management of those assets. In managing bad assets, BAMC faces complex legal and fiscal questions that are related to its state ownership. The Irish model of the state bank offers a case study on how to avoid those obstacles"},{"@xml:lang":"sl","#text":"Družba za upravljanje terjatev bank (DUTB) je operativna že nekaj več kot dve leti. Način, kako dejansko poteka proces sanacije bančnega sistema in prestrukturiranja realnega sektorja, in vloga tako imenovane slovenske sistemske slabe banke pri tem bistveno odstopata od procesa in predvsem od vloge DUTB, kot je bila predvidena z Zakonom o ukrepih RS za krepitev stabilnosti bank. Vloga DUTB se je omejila le na prenos slabega premoženja s komercialnih bank in na upravljanje tega premoženja. Ravno pri upravljanju premoženja pa se DUTB srečuje s kompleksnimi pravnimi in fiskalnimi izzivi, ki so povezani z njenim državnim lastništvom.
