Fixed-term employment contract has same legal characteristics as a contract of indefinite duration, with the exception of limited duration. The duration is stipulated by the date or other circumstances (e.g. the execution of works, return of the absent worker etc.). Due to the legal nature and characteristics of a fixed-term employment the legal norms governing such form of employment should be interpreted narrowly and strictly. Also the legal institutes restricting the conclusion offixed-term employment contracts (e.g. objective conditions for such employment form, the prohibition of discrimination and limiting sequential conclusions of multiple fixed-term employment contracts - chaining) should be considered. The article discusses the concept and legal characteristics of a fixed-term employment, the essential characteristics of Employment Relationships Act, case law of the Supreme Court of the Republic of Slovenia and selected judgments of the EU Court"},{"@xml:lang":"sl","#text":"Delovno razmerje za določen čas je izjema od pravila, to je sklenitve pogodbe o zaposlitvi za nedoločen čas. Pogodba o zaposlitvi, sklenjena za določen čas, ima enake pravne značilnosti kot pogodba za nedoločen čas, z izjemo omejenega trajanja. Trajanje je določeno z datumom ali z drugimi okoliščinami (na primer izvršitev dela, vrnitev odsotnega delavca in podobno). Zaradi pravne narave in značilnosti delovnega razmerja za določen čas je pravne normeo njem treba ozko in strogo razlagati. Ob tem je upoštevati še pravne institute, ki omejujejo sklepanje delovnega razmerja za določen čas, na primer objektivne pogoje za to obliko dela, prepoved diskriminacije, omejevanje zaporednega sklepanja več pogodb o zaposlitvi (veriženje) in podobno. Članek obravnava pojem in pravne značilnosti delovnega razmerja za določen čas, bistvene značilnosti ZDR, ZDR-A in ZDR-1, sodno prakso Vrhovnega sodišča Republike Slovenije in nekatere sodbe Sodišča Evropske unije.
