The author critically deals with objections of the Judicial Council against the mentioned constitutional changes and analyses the argumentation of the Judicial Council and of the Expert Group of the Constitutional Commission considering recognised international legal standards and recommendations, as well as constitutional principle of separation of powersV okviru postopka spreminjanja poglavja slovenske ustave o sodstvu je največ strokovnih polemik povzročil predlog novega 131. člena ustave, po katerem bi se povečalo skupno število članov sodnega sveta, predsednik republike ne bi bil več predlagatelj kandidatov za člane sodnega sveta, ki jih voli državni zbor, slednji pa bi volil člane sodnega sveta z dvotretjinsko večino glasov navzočih poslancev.
