Podrobneje predstavlja družbeni in zgodovinski okvir, v katerem so nastajale in se uveljavljajo zaščita (etnične) manjšine in njihove posebne pravice, kot specifičen segment celote temeljnih človekovih pravic in svoboščin. V tem kontekstu analizira naravo, vsebino in vlogo države (zlasti nacionalne države kot njene specifične oblike) in mednarodne skupnosti ter njuno prepletanje in soodvisnost.
