Besides the European Commission, also the role of the European Parliament has increased in this respect. The faith of all existing bilateral investment treaties between a member state and a third county or between two member states, remains unknown. Regulation no. 1291/2012 has enforced a transitional regime for all bilateral investment treaties concluded and in force between a member state and a third country - so called EXTRA-EU BITs. S tem je EU edina dobila pristojnost sklepati bilateralne investicijske sporazume. Na tem področju se je poleg Evropske komisije okrepila tudi vloga Evropskega parlamenta. Odpira pa se vprašanje, kakšna bo usoda obstoječih investicijskih sporazumov, tistih, sklenjenih med državo članico in tretjo državo, ter tistih, sklenjenih med samimi državami članicami. Za bilateralne investicijske sporazume, ki so sklenjeni med državo članico in tretjo državo, tako imenovane extra-EU BIS, velja prehodni režim, ki ga je uvedla Uredba EU št. 1291/2012.
