It allows employers to terminate an employment contract for employees and civil servants who meet the conditions for acquiring the right to an old-age pension without giving a justified operational reason or without substantiating it. After analysing the provisions on forced retirement, we can conclude that they constitute a violation of international legal norms binding on Slovenia. Furthermore, it remains doubtful whether the measure, in the form and manner adopted, meets all the requirements of the principle of proportionality</dc:description><dc:description xml:lang="sl">Prispevek analizira delovno- in socialnopravna vprašanja, ki se zastavljajo v zvezi z ukrepom t.i. prisilne upokojitve, kot ga določa Zakon o interventnih ukrepih za pomoč pri omilitvi posledic drugega vala epidemije COVID-19 (ZIUPOPDVE). Gre za ukrep, ki delodajalcem omogoča, da delavcem in javnim uslužbencem, ki izpolnjujejo pogoje za pridobitev pravice do starostne pokojnine, odpovejo pogodbo o zaposlitvi brez navedbe utemeljenega poslovnega razloga oziroma brez utemeljitve slednjega.
