Consideration of diversity in companies is in line with the principle of equality or the prohibition of discrimination on the basis of personal circumstance, which is one of the fundamental norms of both national legislation and international organisations. Research and discussions have thus far mainly focused on ensuring gender diversity in terms of gender balance, to which Western countries have largely responded in two ways: by setting legally binding quotas for women or non-binding recommendations. The paper analyses the importance of diversity also in terms of other personal characteristics, i.e. age, nationality, race, geographical origin, religion, education, and the like, with the central research question being whether consideration of diversity is an obligation of companies when forming governing bodies or the personal right of individuals wishing to participate on such bodies. In addition to legal arguments, the economic aspects of consideration of diversity in the composition of governing bodies is presented, especially in terms of the impact of diversity on business performance and productivity of companies. Economic findings can significantly contribute to the formation of arguments in favour of appreciation and implementation of corporate diversity"},{"@xml:lang":"sl","#text":"Prispevek se osredotoča na preučevanje raznolikosti pri korporativnem upravljanju, to je na sestavo organov upravljanja, vključno z delavskimi predstavniki. Upoštevanje raznolikosti v gospodarskih družbah je skladno z načelom enakosti oziroma prepovedjo diskriminacije na podlagi osebnih okoliščin, ki je ena od temeljnih norm nacionalnih zakonodaj in tudi mednarodnih organizacij. Dosedanje raziskave in razprave so se večinoma omejevale na zagotavljanje raznolikosti glede spolne uravnoteženosti, na kar so se zahodne države večinoma odzvale na dva načina: z določitvijo zakonsko obveznih kvot za ženske ali z nezavezujočimi priporočili. V prispevku analiziramo pomen raznolikosti tudi glede drugih osebnih značilnosti (na primer starost, narodnost, rasa, geografsko poreklo, verska pripadnost, izobrazba ipd.), pri čemer je osrednje raziskovalno vprašanje, ali je upoštevanje raznolikosti obveznost gospodarskih družb pri oblikovanju organov upravljanja oziroma ali je to omejeno na pravico posameznika, da kandidira za posamezno korporativno vlogo. Poleg pravnih argumentov predstavimo tudi ekonomske vidike upoštevanja raznolikosti pri sestavi organov upravljanja, zlasti glede vpliva raznolikosti na uspešnost poslovanja in produktivnost gospodarskih družb.
