However, it is unclear whether such legal institute is consistent with the existing Slovenian system of copyright law. The latter is based on the monistic theory, according to which the copyright is a uniform right on the author's work. Hence, the author can neither transfer it (in whole or in part) not irrevocably waive it. Author is only able to charge his right with the right of another person. To introduce the waiver of performing rights in Slovenian law, the monistic theory that is currently in force has to be replaced by the dualistic theory, according to which the parts of copyright are separable and transferrable. Such a solution would allow authors to accelerate the circulation and use of their musical works more than it is possible under current system of mandatory administration of small musical rights. However, this could also have negative consequences for authors who would not be able to change their decision on waiver, even if so desired by the author later. In order to protect the benefits of young emerging authors the law could instead introduce the collective management of small rights on a contractual basis. Thus, each author could by himself decide whether the rights will be asserted through a collective society, or will he allow free use of his works. In order to protect the interests of members of collective societies, the law could subsequently introduce legal presumptions and contractual penalties in favour of collective societies"},{"@xml:lang":"sl","#text":"Najnovejši predlog sprememb ZASP predvideva uvedbo instituta odpovedi malim pravicam. Vendar je nejasno, ali institut odpovedi avtorskim pravicam spada v sistem slovenskega avtorskega prava. Ta namreč temelji na monistični teoriji, po kateri je avtorska pravica celovita pravica na avtorskem delu. Zato je avtor ne more niti v celoti niti delno prenesti ali se ji nepreklicno odpovedati, temveč jo lahko le obremeni s pravico drugega. Da bi bila odpoved malim pravicam sistemsko ustrezna, bi moral zakon sprejeti dualistično teorijo prava, po kateri so avtorske pravice ločene in ločljive. Taka rešitev bi sicer omogočila avtorjem večje razpolaganje z malimi pravicami kot po veljavnem pravu, v skladu s katerim jih obvezno upravlja kolektivna organizacija. Vendar bi to za avtorje lahko imelo tudi negativne posledice, saj svojih odločitev o odpovedi pravicam, tudi če bi se kasneje izkazale za nepravilne, ne bi mogli več spremeniti. Za varovanje koristi mladih neuveljavljenih avtorjev bi lahko zakon namesto tega določil kolektivno upravljanje vseh malih pravic na pogodbeni podlagi. Tako bi se vsak avtor lahko sam odločil, ali bo pravice uveljavljal prek kolektivne organizacije ali pa bo dovolil brezplačno uporabo svojih del.
