In the event of a dispute, the decision is made by the court. After this decision the position of the worker is different. The fewest problems in mutual relationship occur in cases when the reinstatement and reparation of the worker is possible. In all other cases it is up to the employee to carry out the procedures for the realisation of the rights recognised under the employment relationship, including among others also the status of an insured person. V primeru spora ugotovitev o tem sprejme sodišče. Položaj delavca je po tej odločitvi različen. Najmanj težav pri ureditvi medsebojnih razmerij je v primeru, ko je mogoča reintegracija in reparacija.
