His analysis of several examples of hate speech by some Slovenian politicians illustrate his main points, which may be summarised as follows. Any definition (and thereby regulation) of hate speech is contextual. It is constituted by a consent about the delimitation of permissible types of expressions of hate from the forbidden ones. Indifferencetowards such a delimitation leads to the adiaphorisation of the problem. Its overcoming therefore does not begin with the definition of impermissible speech but with a consent about the context in which the definition is used. Here, there are only two choices. The more tolerant approach that,concerned with free speech, defines hate speech less restrictively is contextually confined to logically consequent actions and to reasoned actions with unpredicted effects. The more restrictive position extends the attribution of hate speech to all expressions of hate within non-reasoned but effective actions. These are the only choices available. The criminalisation of other categories of actions would threaten the democratic society, as would if none of those choices are taken"},{"@xml:lang":"sl","#text":"V prvem delu prispevka avtor opozori na temeljne premike v etičnih stališčih, ki označujejo posamezno družbeno obdobje. Problematična značilnost postmoderne družbe je porast brezbrižnosti (adiaforizacije) do ključnih etičnih dilem, tudi do posledic in odgovorne uporabe besed. V drugem delu je v zvezi s sovražnim govorom predstavljena tipologija socialnih ravnanj (po Paretu), ki je podlaga kontestualne analize. V zadnjem besedila je predstavljena analiza konkretnih primerov sovražnega govora nekaterih slovenskih politikov, ki ilustrira glavne poudarke tega prispevka. Te lahko povzamemo v nekaj ugotovitvah.Definicija oz. regulacija sovražnega govora je kontestualna. Vzpostavlja se z konsenzom o razmejitvi še dopustnih tipov izražanja od onih, ki so prepovedani. Brezbrižnost do potrebnih razmejitev vodi v adiaforizacijo problema. Njeno preseganje se zato ne začne (šele) z definiranjem nedovoljene govorice, temveč s konsenzom o kontekstu, v katerem uporabljamo definicijo prepovedanega. Tu pa lahko izbiramo samo med dvema možnostima.Če se odločimo za tolerantnejši pristop, ko v skrbi za svobodo izražanja določamo definicije sovražnega govora z manj restriktivnim posegom, potem ga je treba kontekstualno zamejiti le na logična ravnanja in na namerno početje, a z drugačnimi učinki od predvidenih. Naslednja varianta, ki gre v smeri restriktivnejše regulacije pa raztegne kvalifikacijo sovražnega govoratudi na vse izraze sovražnosti v nenamernem početju z dejanskimi učinki.To sta edini izbiri, ki sta na voljo. Z morebitnim kriminaliziranjem sovraštva tudi na ostale kategorije ravnanja bi ogrozili temelj demokratične družbe.
