The Supreme Court has dealt with the issues initiated by the lawsuits of the civil servants and also their employers. The first were concerned with the right of the employers to (unilaterally) intervene into the rights already recognised to the workers, and the second, on the duty of civil servants to return overpaid remuneration"},{"@xml:lang":"sl","#text":"V prispevku je predstavljena sodna praksa Vrhovnega sodišča v zvezi s tistim delom zakonske ureditve plač v javnem sektorju, ki se nanaša na prepoved priznanja večjih pravic, kot jih za javne uslužbence določajo zakon, predpisi in drugi akti, izdani na njihovi podlagi ter kolektivne pogodbe. Vrhovno sodišče se je ukvarjalo z vprašanji, ki so jih s tožbami sprožili tako javni uslužbenci kot delodajalci.
