The author draws attention to the legal regulation of insurance agents under EU law and the future amendments to the Slovenian Insurance Act. It exposes the insurance broker liability issues towards the insurer and the insurance company, in particular his duty to protect the interests of the policyholder. It also discusses issues relating to the insurance broker performance commission, traditionally paid by the insurance company. The insurance broker conducts the insurance brokerage business in its own name and for its own account and is independent of the insurance companies. Several different types of insurance intermediaries, such as specialized brokers, independent agents and auxiliary agents and others, can be distinguished in practiceV prispevku sta obravnavana pravni položaj in vloga zavarovalnega posrednika kot svetovalca zavarovalca pri sklepanju zavarovalnih pogodb. Avtor opozarja na pravno ureditev položaja zavarovalnega posrednika v okviru prava EU in na bodoče spremembe slovenskega Zakona o zavarovalništvu. Izpostavljena so vprašanja obveznosti zavarovalnega posrednika do zavarovalca in do zavarovalnice, zlasti pa njegova dolžnost varovanja interesov zavarovalca. Obravnavana je tudi problematika v zvezi s provizijo zavarovalnega posrednika za njegovo delo, ki jo tradicionalno plačuje zavarovalnica. Zavarovalni posrednik opravlja posle zavarovalnega posredovanja v svojem imenu in za svoj račun in je neodvisen od zavarovalnice.
