The author presents dilemmas and solutions of the case law in this field. She also tackles questions of joinder of claims in commercial matters and the consequences in revision proceedings of applying the wrong procedural rules. The distinction between civil and commercial matters, which is the consequence of the functional division of work in court is necessary to define matters which are resolved by judges, panels and divisions of court, specialized for commercial matters. As the differences between procedural rules in civil and commercial matters are few, it is doubtful whether sufficient grounds for special rules in commercial matters continue to existPrispevek se ukvarja s pojmom gospodarskega spora, ki ga opredeljujejo subjektivna ali objektivna merila ali pa kombinacija enih in drugih. Prikazane so dileme in rešitve sodne prakse s tega področja. Obravnavano je tudi vprašanje objektivne kumulacije v gospodarskem sporu in vprašanje, kakšne posledice ima vodenje postopka po napačnih postopkovnih pravilih v revizijskem postopku. Razmejitev med rednim pravdnim postopkom in postopkom v gospodarskih sporih, ki je posledica funkcionalne delitve dela znotraj sodišča, je potrebna že zato, da bi lahko opredelili zadeve, ki jih rešujejo sodnik, senat ali oddelek, specializiran za reševanje gospodarskih sporov.
