For the trade secret holder, legal measures that can be applied with the aim of protecting their trade secrets are crucial. In a civil procedure, in which the confidentiality of a trade secret is endangered throughout the entire procedure, these measures are regulated by the Civil Procedure Act (ZPP), with some special provisions in the Trade Secrets Act. Even though legal provisions aimed at protecting trade secrets are relatively new, their reach is in fact rather limited. The article analyses the current legislation and procedural measures provided by applicable law at each stage of the procedure. Moreover, it also points out deficiencies of the current legislation alongside some open questions, and offers answers by presenting the view of the legal theory and relevant legal rules"},{"@xml:lang":"sl","#text":"Poslovna skrivnost, katere ključna lastnost je njena zaupnost, je vsak dan izpostavljena različnim tveganjem, povezanim z njenim razkritjem, in to ne le v poslovni praksi, ampak tudi med pravdnim postopkom, v katerem se uveljavlja sodno varstvo. Za imetnika poslovne skrivnosti so ključnega pomena ukrepi, ki jih veljavna zakonodaja ponuja za ohranitev zaupnosti te poslovne skrivnosti. Za pravdni postopek, v katerem je zaupnost poslovne skrivnosti ogrožena skozi celoten potek, so ti ukrepi urejeni predvsem v Zakonu o pravdnem postopku, s posameznimi specialnimi določbami v Zakonu o poslovni skrivnosti. Čeprav gre za razmeroma nove zakonske določbe, namenjene izrecno varstvu poslovne skrivnosti, pa je njihov obseg v resnici precej omejen. Prispevek analizira veljavno pravno ureditev in možne ukrepe v posamezni fazi pravdnega postopka.
