It analyzes constitutional issues on the case of the principled opinion of the Commission on the prevention of corruption. His conclusion is that the provision of protection in the proceedings before the courts of general jurisdiction and, consequently, the exclusion of judicial protection in the proceedings before the court in an administrative dispute means that effective judicial protection is not guaranteed against individual acts referred to in the second paragraph of Article 157 of the Constitution, which interfere with personal rights"},{"@xml:lang":"sl","#text":"V prispevku avtor opozarja na nekatere ustavnopravna vprašanja uporabe pravila subsidiarnosti upravnega spora pri zagotavljanju sodnega varstva na podlagi drugega odstavka 157. člena Ustave. Ustavnopravna vprašanja analizira na primeru načelnega mnenja Komisija za preprečevanje korupcije. Njegova sklepna ugotovitev je, da očitna neprilagojenost postopka pred sodiščem splošne pristojnosti v tovrstnih sporih na eni strani in v imenu tega postopka odrekanje sodnega varstva v postopku pred sodiščem v upravnem sporu pomeni, da zoper posamične akte iz drugega odstavka 157. člena Ustave, kadar se z njimi posega v osebnostne pravice, ni zagotovljeno učinkovito sodno varstvo.
