The right to data protection is closely linked to the right to privacy, and therefore the actions of the courts and public authorities must be correct, lawful, clear and precise, while at the same time providing for the protection of that right in the event of its violation, both at the national and international level. As part of the binding rules, judicial protection and effective remedies must be available to the individual whenever a violation of a right occurs, which is why it is necessary to ask the following: (1) How and on what basis do courts process individuals' personal data? (2) When do courts act as judicial authorities? (3) Are courts, as a so-called public sector, subject to Information Commissioner's oversight in terms of institutional protection? (4) If the Information Commissioner does not have the power to supervise the work of the courts under the provisions of Article 55(3) of the Regulation, how can an individual enforce their rights? In this article, we will answer these questions in the light of (also comparative) case law and legal literature</dc:description><dc:description xml:lang="sl">Svet se vse bolj in bolj digitalizira, zato morajo sodišča in drugi državni organi pri objavljanju svojih odločitev paziti, da s tem ne prekršijo posameznikove pravice do varstva osebnih podatkov, saj ta v dobi razvoja informacijske tehnologije postaja vse pomembnejša. Pravica do varstva podatkov je tesno povezana s pravico do zasebnosti, zato mora biti delovanje sodišča in državnih organov pravilno, zakonito, jasno in natančno, hkrati pa mora biti urejeno tudi varstvo navedene pravice v primeru nastanka njene kršitve tako na nacionalni kot tudi na mednarodni ravni. Sodno varstvo in učinkovita pravna sredstva morajo biti kot del zavezujočih predpisov posamezniku omogočena vselej, ko se mu pravica krši, zato se je treba vprašati: (1) kako in na kakšni podlagi sodišča obdelujejo osebne podatke posameznikov, (2) kdaj sodišča delujejo kot sodni organi, (3) ali so sodišča kot t. i. javni sektor zavezana z nadzorom informacijskega pooblaščenca v smislu institucionalnega varstva, (4) če informacijski pooblaščenec po določbi iz tretjega odstavka 55. člena Uredbe (EU) 2016/679 nima pristojnosti nadzora nad delom sodišč, kako posameznik potem lahko uveljavlja svoje varstvo pravice.
