She emphasizes that the special regulation of the rights and obligations of civil servants compared to workers must stem from the special nature of the work of a civil servant, which is in the public interest, so that the legislator cannot be accused of arbitrariness. She notes that public interest is an undefined legal concept; its definition is not found in the Constitution of the Republic of Slovenia, because it is determined at the legal level and is assessed in each individual case.
