She emphasizes that the special regulation of the rights and obligations of civil servants compared to workers must stem from the special nature of the work of a civil servant, which is in the public interest, so that the legislator cannot be accused of arbitrariness. She notes that public interest is an undefined legal concept; its definition is not found in the Constitution of the Republic of Slovenia, because it is determined at the legal level and is assessed in each individual case. The state is the guardian of the public interest, but at the same time, in the role of employer, it must also protect the civil servant, as the weaker party in labor relations, so it must balance both interests</dc:description><dc:description xml:lang="sl">Avtorica v prispevku obravnava vpliv javnega interesa na določitev posebnega delovnopravnega položaja javnega uslužbenca. Poudarja, da mora posebna ureditev pravic in obveznosti iz delovnega razmerja javnih uslužbencev v primerjavi z delavci, izhajati iz posebne narave dela javnih uslužbencev, ki je v javnem interesu, da zakonodajalcu ni mogoče očitati arbitrarnosti oziroma samovoljnosti pri urejanju njihovega položaja. Ugotavlja, da je javni interes nedoločen pravni pojem; njegove opredelitve ne najdemo v Ustavi RS, ker se določa na zakonski ravni in se presoja v vsakem primeru posebej.
