New act should be passed. A draft of such an act was prepared and should soon face the parliamentary discussion, where certain solutions might still be modified. The present article analyses the draft act from the perspective of introductory norms, containing also basic principles of health care and health insurance, modified scope of insured persons, more legally precise definitions of rights, and new shape of relations with health care providers. It is emphasised that certain recent modification of other legislative acts, such as on health care provision or patients% rights may also influence mandatory health insurance. Special attention is devoted to the EU law and its latest construction by the Slovenian social courts (of distinct instances), which have raised quite some uneasiness and interest also in general public"},{"@xml:lang":"sl","#text":"Dlje časa prevladuje prepričanje, da spreminjanje obstoječega Zakona o zdravstvenem varstvu in zdravstvenem zavarovanju (ZZVZZ) ne more več slediti spremenjenim razmerjem v družbi. Sprejeti je treba nov zakon. Osnutek ZZVZZ-1 je pripravljen in naj bi bil kmalu vložen v parlamentarno razpravo, kjer se posamezne rešitve lahko še spremenijo. Prispevek analizira osnutek zakona z vidika novih splošnih določb, ki vsebujejo tudi temeljna načela, preoblikovanja kroga zavarovanih oseb, določnejše pravne opredelitve pravic in novega načina urejanja odnosov z izvajalci zdravstvene dejavnosti. Poudarjeno je, da nekateri pravkar spremenjeni zakoni, npr. o zdravstveni dejavnosti in o pacientovih pravicah urejajo tudi snov obveznega zdravstvenega zavarovanja.
