With high incomes and big negative externalities the question arises whether or not and to what extent the regulation of internet gambling is beneficial. The article first discusses EU and Slovenian regulation of internet gambling by discussing the European Court of Justice cases in the gambling field and the adherence of Slovenian regulation to the ECJ decisions. The second part of the article examines the economic rationale of ECJ gambling decisions and concludes that the ECJ decisions make economic sense, since they intend to increase the welfare in society. The article concludes that the monopoly in the internet gambling sector might be more beneficial for the economy than the competition</dc:description><dc:description xml:lang="sl">Z razvojem tehnologije so se igre na srečo na daljavo (angl. on-line gambling, v nadaljevanju: spletne igre na srečo) izredno razširile, z njimi pa tudi želja po dobičku ter vrsta negativnih stranskih učinkov - negativnih eksternalij ter vprašanje, kako pravno urediti prirejanje iger na srečo oziroma ali sploh urediti. V članku sta najprej predstavljeni evropska in slovenska ureditev trga (spletnih) iger na srečo prek sodne prakse Sodišča Evropske unije s kratkim komentarjem skladnosti slovenske ureditve. V nadaljevanju je ekonomski pogled na urejanje spletih iger na srečo s ciljem ponazoriti, da je rezultat, do katerega je doslej vodila sodna praksa Sodišča Evropske unije, mogoče utemeljiti tudi z načeli ekonomske analize prava in maksimiranja družbene blaginje.
