The identified key future challenges include the regulation of financial restructuring procedures, which have been experiencing a decline in recent years, the incentivisation of timely initiation of insolvency proceedings, and the high costs associated with bankruptcy procedures. Additionally, the article discusses the re-evaluation of debt discharge regulations and the necessary preparations for the forthcoming Directive on the harmonisation of certain aspects of insolvency law. Notably, the author also examines the unique process of preparing the H amendment, which significantly deviated from past practices that, in the author's opinion, were notably more effective. The article advocates for a more inclusive approach to proposal preparation, urging the involvement of a diverse range of experts"},{"@xml:lang":"sl","#text":"Avtor ob začetku zakonodajnega postopka novele ZFPPIPP-H obravnava nekatere izzive insolvenčne zakonodaje, ki se jim v bližnji prihodnosti ne bo mogoče izogniti. Med temeljne izzive prihodnosti uvršča izzive ureditve postopkov finančnega prestrukturiranja, ki jih je v zadnjih letih vse manj, vprašanje reševanja spodbud za pravočasen začetek postopkov zaradi insolventnosti in visoke stroške stečajnih postopkov, vnovični razmislek o ureditvi odpusta obveznosti ter priprave na Direktivo o harmonizaciji nekaterih vidikov insolvenčnega prava, ki je trenutno še v evropskem zakonodajnem postopku.
