At the end of drawing of the European funds, some administrative authorities adopted the view that, due to the strict nature of Slovene public procurement legislation, a special public procurement procedure should be carried out for each amendment caused by the implementation of additional works, unforeseeable urgent works, or even more work. This article addresses the issue of conformity of the FIDIC texts with the Slovene public procurement legislation, in particular the significance and the role of Article 13 of the FIDIC Yellow and Red Books, contractual obligations of the parties to the construction contract, and the impact of the content of the construction contract on the Employer's duty to carry out additional public procurement procedures in the event of any derogations from the published technical specifications and the list of worksKo je Evropska komisija Republiki Sloveniji za izvedbo javnih razpisov, ki sredstva črpajo iz Kohezijskega sklada, priporočila uporabo besedil FIDIC, ni nič kazalo na hude zaplete ob izteku Operativnega programa za obdobje 2007-2013. Ob koncu črpanja evropskih sredstev so namreč nekateri upravni organi zavzeli stališče, da bi bilo zaradi strogosti slovenske zakonodaje s področja javnega naročanja treba izvesti poseben postopek javnega naročanja za vsako spremembo, ki je posledica izvedbe dodatnih del, nepredvidenih nujnih del in celo več del. Prispevek obravnava problematiko skladnosti besedil FIDIC s slovensko zakonodajo s področja javnega naročanja, predvsem pomen in vlogo 13. člena FIDIC, ter pogodbene obveznosti strank sklenjene gradbene pogodbe in vpliv vsebine gradbene pogodbe na naročnikovo dolžnost izvedbe dodatnih postopkov javnega naročanja v primeru morebitnih odstopanj od objavljenih tehničnih specifikacij in popisov delTEXTznanstveno časopisjejournalsSlovenian National E-content AggregatorNational and University Library of Slovenia
