European Court of Human Rights recently delivered a few judgments on respect of this right in the proceedings before the constitutional court. In the case of Milatova and others v. the Czech Republic the Court ruled that that written submissions of one party to the proceedings before a constitutional court must be served on its opponents. In two other cases the Court underlined the requirement of impartiality of the constitutional court judges and emphasized the principle of objective impartiality of the Court. In addition, the Court considered two decisions on compliance with the requirements for lodging a constitutional appeal which breached the applicants' rights to access the courtEna temeljnih človekovih pravic je pravica do poštenega sojenja, ki jo varuje tudi 6. člen Evropske konvencije o človekovih pravicah. Evropsko sodišče za človekove pravice je pred kratkim v nekaj primerih odločalo o spoštovanju te pravice v postopku pred ustavnim sodiščem. V primeru Milatova in drugi proti Češki je ESČP odločilo, da mora ustavno sodišče strankam postopka vročati vsa pisanja nasprotne strani. V dveh primerih je ESČP posebej izpostavilo zahtevo po nepristranskosti ustavnih sodnikov in pri tem poudarilo, da mora biti nepristranskost sodišča objektivizirana.
