Legalization of the contract of inheritance would cause greater freedom in disposing of the private property. Razpolaganje za primer smrti je omejeno z nujnim deležem in z neveljavnostjo dednih pogodb. Te omejitve ovirajo vnaprejšnje urejanje dedovanja v različnih življenjskih situacijah. Ustava prepušča določanje načina in pogojev dedovanja zakonodajalcu. Ta bi z dopustitvijo dednih pogodb omogočil večjo svobodo pri razpolaganju s posameznikovim premoženjem.
