As companies have certain fixed costs, despite the reduction in the scope of operations, which also includes labour costs, which in labour-intensive activities can make up the majority of their costs, they must reduce these expenses in order to ensure the sustainability of operations at lower revenues. For labour costs, the first attempt in this direction is to reduce the salaries of employees and, in extreme cases, to terminate their employment. In this paper, I analyse the legal framework and case law in relation to both measuresV času izrednih razmer, kot je letošnja pandemija koronavirusne bolezni, pride do drastičnega padca ekonomskih aktivnosti in posledično prihodkov gospodarskih družb. Ker imajo te kljub zmanjšanju obsega poslovanja določene fiksne stroške, kamor spadajo tudi stroški dela, ki v delovno intenzivnih dejavnostih lahko sestavljajo pretežni del stroškov, morajo za zagotovitev vzdržnosti poslovanja ob nižjih prihodkih te stroške znižati. Pri stroških dela je prvi poskus v tej smeri znižanje plač zaposlenih, v skrajnem primeru pa tudi odpuščanje.
