Regarding formal conditions, particular attention is paid to the obligation of the employer to notify the worker of the alleged violations and provide him the opportunity to defend himself; the employer must further inform the worker about the duration of notice period and prior to ordinary termination of the employment contract for reasons of culpability, call the worker%s attention in writing to the fulfilment of obligations and to the possibility of termination. Regarding substantive reasons for termination, the emphasis is on the explanation of actual reasons for the termination, the scope of judicial review of the reasons for the termination of employment contract, as well as the assessment of the possibility to continue the employment relationship until the expiry of the notice period in the event of the employer's extraordinary termination of employment contract"},{"@xml:lang":"sl","#text":"V prispevku je prikazana novejša sodna praksa v zvezi z nekaterimi formalnimi in vsebinskimi pogoji za zakonitost odpovedi pogodbe o zaposlitvi. Med formalnimi pogoji se tako posebej ukvarjam z obveznostjo delodajalca, da delavca seznani z očitanimi kršitvami in mu omogoči zagovor; rokom za odpoved ter obveznostjo delodajalca, da pred redno odpovedjo iz krivdnega razloga delavca pisno opozori na izpolnjevanje obveznosti in možnost odpovedi.
