Since the available bankruptcy estate was not sufficient to pay off the priority claims of the employees, the workers demanded payment from the company's founder by which they were previously employed. Though founding them on different legal basis, they did not succeed with their claims before the court, since according to the present legislation, neither the founding company nor the transfer employer is deemed responsible for the debts of the respective company. The authoress concludes that such regulation is not fair and believes that the legislation should be amended so that the transfer company would subsidiary guarantee for priority claims pursuant to labour relationship against the employer / transferee in bankruptcy</dc:description><dc:description xml:lang="sl">Članek obravnava položaje, ko je delavcem prenehalo delovno razmerje na podlagi odpovedi pogodbe o zaposlitvi zaradi začetka stečaja nad delodajalcem. Stečajna masa, ki je bila na razpolago ni zadoščala niti za poplačilo prednostnih terjatev delavcev, zato so ti zahtevali poplačilo od družbe ustanoviteljice, pri kateri so bili tudi v preteklosti zaposleni. Pred sodiščem s svojimi zahtevki niso uspeli, čeprav so za utemeljenost zahtevkov uveljavljali različne pravne podlage. Po sedanji pravni ureditvi za dolgove družbe ne odgovarja družba ustanoviteljica, niti delodajalec prenosnik.
