Therefore, the argument that a new law has to be passed because the existing one is old cannot be convincing, especially if it has been amended many times. It is far more important that the content of the law still reflects the ever-changing relations in the society. Influences for modifying the law may be internal and external. Among first are the acknowledged and legally regulated deficiencies and those who are not detected or regulated. External influences are the ones outside of mandatory health insurance, especially in the form of Constitutional Court decisions and EU law. Advantages of incremental changes are that smaller units can be amended rather fast, without discussing the entire system. In the long run, more comprehensive modernisation in a new legislative act may be even more important. It enables thorough debate and more comprehensive regulation of mandatory health insurance and the entire social security system"},{"@xml:lang":"sl","#text":"Starost zakona ne pove veliko o njegovi vsebini. Zato argument, da je treba sprejeti nov zakon, ker je obstoječi star, ne vzdrži, še posebej, če je ta večkrat noveliran. Bolj pomembno je, ali vsebina zakona še ustreza spremenjenim razmerjem v družbi. Dejavniki, ki vplivajo na spreminjanje zakona so notranji in zunanji. Med prve štejemo dve vrsti vplivov, in sicer zaznane pomanjkljivosti v sistemu obveznega zdravstvenega zavarovanja, ki jih je zakonodajalec z normativnimi posegi primerno uredil in nezaznane oziroma neurejene pomanjkljivosti v tem sistemu. Med zunanje dejavnike štejemo vplive zunaj obveznega zdravstvenega zavarovanja, predvsem v oliki odločitev našega Ustavnega sodišča in pravnega reda EU. Prednosti posameznih sprememb so, da uredijo določeno manjšo notranje zaključeno celoto hitro in brez poseganja v celoten sistem. Dolgoročno pa je pomembnejša celovita prenova v novem zakonu.
