The author stems from the elements of the definition of the strike and the related issues, then proceeds to the problems regarding the issue of organisation and implementation of the strike, in particular the strikes in state bodies and public services. The article further lists some views of the case-law in assessing the lawfulness of the strikesV prispevku so podane nekatere ugotovitve v zvezi z izvajanjem zakona o stavki, ki je potreben spremembe, saj ni usklajen s konceptom pravice do stavke v Ustavi in (glede nekaterih vprašanj) s stališči nadzornih organov Mednarodne organizacije dela in Evropske socialne listine. Avtor izhaja iz elementov opredelitve stavke in vprašanj s tem v zvezi, nato problematike organiziranja in izvedbe stavke ter še posebej stavke v državnih organih in javnih službah.
