In the context of the above, the article examined the issue of protection of the freedom of association, which in certain cases severely interferes with the right to free economic initiative. The law presented in the article in some cases restricts the employer in their decision whether or not to terminate the employment contract of the employee representative. The article specifically emphasises situations in which the decision to terminate the employment contract of the employee representative is not exclusively up to the employer, but the termination arises from external circumstances independent of the employer</dc:description><dc:description xml:lang="sl">Prispevek obravnava varstvo delavskih predstavnikov po veljavni delovnopravni zakonodaji ter analizira sodno prakso in njen razvoj. V okviru navedenega se prispevek ukvarja s problematiko varstva sindikalne svobode, ki v določenih primerih močno poseže v pravico do svobodne gospodarske pobude in delodajalca omejuje pri njegovi odločitvi, ali bo delavskemu predstavniku, ki v skladu s 112. členom Zakona o delovnih razmerjih uživa varstvo pred odpovedjo, odpovedal pogodbo o zaposlitvi.
