The right to protection against poverty and social exclusion is defined by the European Social Charter (amended) as an independent right. The author notes that the Constitution of the Republic of Slovenia does not stipulate an independent human right to protection against poverty and social exclusion, but contains a number of human social rights and fundamental freedoms and constitutional principles that are important for social inclusion and eradication of poverty. The content of these rights is filled by the Constitutional Court with its decisions; some of them are presented in this article"},{"@xml:lang":"sl","#text":"Avtorica v prispevku obravnava nekatere človekove pravice iz Ustave Republike Slovenije, ki lahko pomembno vplivajo na zmanjševanje revščine in socialne izključenosti. Pravico do varstva pred revščino in socialno izključenostjo določa Evropska socialna listina (spremenjena) kot samostojno pravico. Avtorica ugotavlja, da Ustava Republike Slovenije sicer ne določa samostojne človekove pravice varstva pred revščino in socialno izključenostjo, vendar vsebuje vrsto človekovih socialnih pravic in temeljnih svoboščin ter ustavnih načel, ki so pomembna za socialno vključenost in odpravljanje revščine.
