It is of lesser importance whether this is done with a new legislative act or mere amendments to the existing one. The starting point is the Constitution of the Republic of Slovenia, based on international standards when regulating fundamental human rights to social security and to healthcare. All principles and rules of social insurance apply also to the compulsory health insurance. With regulation of a public scheme, intervention into the private market and all the pitfalls that come with it can be avoided. In the present paper, constitutional provisions and legal relations under the compulsory health insurance are analysed. It is established that updating all of them would be required, i.e. determining the scope of insured persons, funding, administration and, most of all, providing healthcare for the compulsory health insuranceUreditev obveznega zdravstvenega zavarovanja mora slediti spremenjenim razmerjem v družbi. Pri tem je manjšega pomena, ali se to zgodi z novim zakonom ali s spremembami obstoječega. Izhodiščna točka je Ustava RS, oprta na mednarodno ureditev temeljnih človekovih pravic do socialne varnosti in zdravstvenega varstva. Tudi za obvezno zdravstveno zavarovanje veljajo vsa načela in pravila socialnih zavarovanj. Z ureditvijo javnega sistema se je mogoče izogniti poseganju na zasebni trg in vsem pastem, ki jih to prinese s seboj. Analizirane so ustavne določbe in posamezna pravna razmerja obveznega zdravstvenega zavarovanja. Ugotovljeno je, da je prenova potrebna na vseh področjih, tj. pri opredelitvi kroga zavarovanih oseb, financiranja, določanja pravic, upravljanja zbranih sredstev in predvsem izvajanja zdravstvene dejavnosti za obvezno zdravstveno zavarovanjeTEXTznanstveno časopisjejournalsSlovenian National E-content AggregatorNational and University Library of Slovenia
