National Assembly decides on permissibility to call the referendum. In case of a dispute between the proposer of the referendum and the National Assembly, which rejected to call a referendum, the Constitutional Court will decide on this matter. The dispute will be focused on the question whether the National Assembly rejected to call the referendum on a law that is formally and substantially excluded from referendum by the Constitution. Moreover, a constitutional review of permissibility to call a referendum on other laws is not excluded, especially when protecting important constitutional principles and values. One could assume that the Constitutional Court will follow its settled case law and the criteria set thereby, in particular the doctrine on prohibition of referendum, i.e. the doctrine on abuse of legislative powersS spremembo 90. člena Ustave Republike Slovenije referendum ni več dopusten za štiri skupine zakonov. O dopustnosti razpisa referenduma o teh zakonih bo odločal Državni zbor, v sporu med predlagateljem referenduma in Državnim zborom, ki bo zavrnil razpis referenduma, pa bo odločalo Ustavno sodišče. Predmet spora bo vprašanje, ali gre v konkretnem primeru (materialno in formalno) za zakon, ki je z Ustavo izključen iz referendumskega odločanja. Poleg tega pa ni izključena presoja dopustnosti referenduma tudi o drugih zakonih, zlasti zaradi varstva pomembnih ustavnih vrednot.
