While the Pact promises more effective and solidarity-based migration management, many provisions raise serious concerns about fundamental rights protection. Particularly worrying is the expanded use of border and accelerated procedures, which may lead to systematic detention and erosion of procedural safeguards. Access to legal aid remains fragmented and dependent on national regulations, threatening equal access to protection. Legal remedies often lack an automatic suspensive effect, meaning that applicants may be returned before their appeals are heard. The article warns that the Pact’s success will depend heavily on its implementation and the political will of Member States. Without proper enforcement, the new legal framework risks entrenching existing shortcomings and undermining the right to asylum within the EU"},{"@xml:lang":"sl","#text":"Avtor obravnava pravico do sodnega varstva v kontekstu novega Pakta o migracijah in azilu, ki ga je EU sprejela decembra 2023. Čeprav Pakt obljublja učinkovitejše in solidarnostno upravljanje migracij, številne določbe sprožajo resne pomisleke glede spoštovanja temeljnih pravic. Posebno skrb vzbuja širitev mejnih in pospešenih postopkov, ki lahko vodijo v sistematično pridrževanje in znižanje procesnih jamstev. Pravna pomoč ostaja razdrobljena, pogosto pogojena z nacionalnimi ureditvami, kar ogroža enak dostop do zaščite. Pravno sredstvo pogosto nima samodejnega zadržanja učinka, kar pomeni, da so lahko prosilci odstranjeni iz države, preden je njihova pritožba sploh obravnavana. Avtor opozarja, da bo uspeh Pakta večinoma odvisen od njegovega izvajanja in politične volje držav članic.
