In doing so, they question whether the measures taken during the coronavirus epidemic are in fact the same for everyone or whether they have a greater effect on a particular group of people. The authors find that the measure of closing schools and kindergartens affected parents with younger children significantly more than those who did not have children. Researches also show that the measure affected women more than men. Thus, the authors conclude that the measure of closing schools and kindergartens is indirectly discriminatory. The authors then explain what conditions must be met for a measure to be constitutional and permissible despite discrimination. The authors question whether an adequate proportionality test was carried out before the adoption of the school and kindergarten closure measure, taking into account the aspect of discrimination, and point out that the aspect of gender and unequal employment opportunities of parents, especially women, must be taken into account in order to pursue the goal of equal treatment and the reduction of the pay gapAvtorici se v prispevku osredotočita na vprašanje, kakšne so posledice ukrepa zaprtja šol in vrtcev za starše, predvsem matere, z vidika plačne vrzeli in neenakih možnosti do dostopa na trg dela. Pri tem se vprašata, ali so ukrepi, ki so bili sprejeti med epidemijo koronavirusne bolezni, res enaki za vse ali pa so bolj prizadeli določeno skupino ljudi. Ugotavljata, da je ukrep zaprtja šol in vrtcev precej bolj prizadel starše z mlajšimi otroki v primerjavi s tistimi, ki otrok nimajo; raziskave prav tako kažejo, da je ukrep bolj vplival na ženske kot na moške. Zato skleneta, da je ukrep zaprtja šol in vrtcev posredno diskriminatoren. V nadaljevanju pojasnjujeta, kateri pogoji bi morali biti izpolnjeni, da bi bil ukrep kljub diskriminatornosti lahko ustavnoskladen in dopusten. Sprašujeta se, ali je bil pred sprejetjem ukrepa zaprtja šol in vrtcev opravljen tudi ustrezen test sorazmernosti glede na obravnavani vidik diskriminatornosti, in opozarjata, da je vidik spola in slabših zaposlitvenih možnosti staršev, predvsem žensk, nujno upoštevati pri nadaljnjih politikah, da bi se lahko približali želenemu cilju enake obravnave in zmanjševanju plačnih vrzeliTEXTznanstveno časopisjejournalsSlovenian National E-content AggregatorNational and University Library of Slovenia
