This way the legislator undoubtedly attempted to respond to the critical economic situation, yet the question remains whether the legislation makes it possible and guarantees a prompt beginning of an insolvency proceeding after insolvencyhas been determined. The success of an individual proceeding and the best possible payment of creditors namely depend to a large extend on the latter. According to the practice, the answer to the question above seems to be negative"},{"@xml:lang":"sl","#text":"Delovnopravni položaj delavcev v primeru insolventnosti delodajalca zagotovo predstavlja pomembno področje pravnih razprav in predmet aktivnosti različnih deležnikov, od delodajalcev, delavcev, upraviteljev, sodišč, do države. Nesporno je, da se je zakonodajalec odzval na nadaljnje zaostrovanje gospodarske situacije, ostaja pa vprašanje ali zakonodaja omogoča oziroma zagotavlja dovolj ažuren začetek posameznega insolvenčnega postopka po ugotovljeni insolventnosti. Od slednjega je namreč odvisen tudi uspeh posameznega postopka oziroma čim ugodnejše poplačilo vseh upnikov insolventnega dolžnika.
