Mobility of people has never been so intense in daily migration, business or pleasure trips. The trend can be expected to continue. Transportation is clearly subject to economic laws in the sense that operators endeavour to reach the highest possible return on investment. The carriers are also targeting a balance between their costs and passenger comfort and quality of services. The article deals with the elements of contracts for the carriage of passengers in national and international legal acts. It focuses on the elements of the contract of carriage of passengers, especially in the manner of execution of the contract for the carriage of passengers, as expected from the carrier. Passengers are not containers, even though some carriers cherish that desire. Passengers have their requirements and their needs. In some cases, provisions are dealing with these issues explicitly (national law), in others they may be implied terms of contract or can be explained through the nature of the contracts (international treaties)Prevoz potnikov je panoga, ki ima vsak dan pomembnejšo vlogo. Mobilnost ljudi še nikoli ni bila tolikšna, pa naj gre za dnevne migracije, poslovne poti ali dopustovanje. Upravičeno lahko pričakujemo, da se bo trend vse večje mobilnosti še nadaljeval. Prevoz je podvržen ekonomskim zakonitostim, saj skušajo prevozniki doseči čim višjo donosnost na vloženi kapital. Prevozniki tako lovijo ravnotežje med svojimi stroški ter udobjem potnikov in kakovostjo storitve. Prispevek obravnava vprašanje pogodbe o prevozu potnikov v nacionalnih in mednarodnih pravnih aktih. Osredinja se na elemente pogodbe o prevozu potnikov, zlasti na način izvršitve pogodbe o prevozu potnikov, kot se pričakuje od prevoznika. Potniki niso zabojniki, čeprav bi si nekateri prevozniki to želeli. Potniki imajo svoje zahteve in potrebe.
