Enforcement of these rights is particularly complex due to sometime untransparent and very differentiated types of processing by various stakeholders - from social media providers to other subjects which use social media for business purposes. The main challenges are the delimitation of roles and competences between data controllers, joint controllers and data processors, and interpretation of legal grounds for further processing. The later includes among others digital behavioural marketing and profiling, as well as legality and legitimacy of business models based on further processing of personal data. At the EU level, these challenges are being addressed through the reform of regulation and legal framework of the following fields: protection of personal data, digital markets and digital services, data management, artificial intelligence and media freedom. Emerging challenges stemming from the nature of social media are creating a unique boom for privacy protection and in particular data protection. An optimistic natural development of data protection law would bring explanations and application of existing rules tailored to the needs of modern technology in particular with regard to the definition of personal data, anonymisation, fundamental principles defined by Article 5 of the GDPR and legal basis defined by Articles 6 and 9 of the GDPR. It seems that adequacy of these explanations and applications will determine whether speedy development of various systems of artificial intelligence will be human friendly or not"},{"@xml:lang":"sl","#text":"Pojav družbenih omrežij je varstvo zasebnosti, ki zajema varstvo osebnih podatkov v nadzorni pristojnosti Informacijskega pooblaščenca ter varstvo širše pravice do zasebnosti in osebnostnih pravic v pristojnosti sodišč ter temelji na 8. členu EKČP in 7. ter 8. členu Listine EU, postavil pred nove izzive, med katerimi so pravna kategorizacija in narava objav glede na ciljne javnosti ter večplastnost obdelav osebnih podatkov. Zlasti je zapleteno uveljavljanje teh pravic zaradi nejasnih in raznolikih tipov obdelav s strani različnih deležnikov (ponudnikov družbenih omrežij ter drugih subjektov, ki jih uporabljajo v poslovne namene). Izziv so predvsem razmejitve med upravljavci, skupnimi upravljavci in pogodbenimi obdelovalci, ter pravne podlage za nadaljnjo obdelavo. Pri slednjem gre za vprašanja tako vedenjskega oglaševanja in profiliranja kot tudi legitimnosti in zakonitosti poslovnih modelov, ki temeljijo na nadaljnji obdelavi podatkov. Na ravni EU je obravnavi teh izzivov namenjena reforma med seboj prepletajočih se pravnih okvirov regulacije, tj. varstva osebnih podatkov, digitalnih trgov in storitev, upravljanja podatkov, umetne inteligence in svobode medijev. Varstvo zasebnosti in posebej osebnih podatkov doživlja zaradi posebne narave družbenih omrežij nov razcvet. Kot naravno pot razvoja prava varstva podatkov je ob optimistični napovedi mogoče pričakovati moderni tehnologiji prilagojene načine razlage in aplikacije veljavnih pravil zlasti glede pojma osebnih podatkov, pojma anonimizacije, temeljnih načel varstva podatkov iz 5. člena ter pravnih podlag iz 6. in 9. člena Splošne uredbe.
